Total Performance of the Work definition

Total Performance of the Work means the time when the prerequisites to Total Performance of the Work required by the Contract are fulfilled and the entire Work, except those items arising from the warranty provisions of the Contract, has been performed to the requirements of the Contract Documents and is so declared, in writing, by the Owner.
Total Performance of the Work means when the Contract is deemed to be completed pursuant to the Construction Act, R.S.O. 1990, c. C.30, as such statute is amended or replaced from time to time. If such legislation is not in force or does not contain such definition, Total Performance of the Work shall have been reached when the entire Work, except those items arising from the provisions of Bid Document, has been performed to the requirements of the Contract Documents and is so certified by the Town, or, if a Consultant has been appointed, the Consultant; “Town” means The Corporation of the Town of Aurora or its authorized agent or representative as designated to the Contractor but does not include the Consultant;
Total Performance of the Work has the meaning set forth in the Craft Construction Contract.

Examples of Total Performance of the Work in a sentence

  • Where the City wishes to use or occupy part or all of the Work prior to Total Performance of the Work, it shall give written notice to the Contractor pursuant to GC13 - Occupancy and if requested the Contractor shall promptly notify the City in writing of the additional premium cost, if any, to maintain property and boiler insurance, which shall be at the City's expense.

  • Immediately following the issuance of the Certificate of Completion for all of the Work, the Contractor, in consultation with the Consultant, shall establish a reasonable date for Total Performance of the Work (which date will be deemed to be the date for the same set out in the Project Schedule if such date is specified).

  • When the Contractor considers that Total Performance of the Work has been achieved, the Contractor shall submit its final application for payment.

  • Halifax Water shall retain all right, title and interest in any reports or documents generated pursuant to the Scope of Work, whether or not this Contract is terminated prior to Total Performance of the Work.

  • The policy shall include Halifax Water as an insured, be continuous from the commencement of this Contract and continue for two years following termination of this Contract or Total Performance of the Work, whichever is later.


More Definitions of Total Performance of the Work

Total Performance of the Work means that the Contractor has performed and certified all obligations, other than warranty obligations under the Contract Documents, and is so certified by the City;
Total Performance of the Work means when the entire Work has been performed to the requirements of the Contract Documents and the Consultant has issued a written certificate to the Owner confirming that the Work has been completed in accordance with the requirements of the applicable lien legislation in the jurisdiction of the Place of the Work.”
