Total Performance of the Work definition

Total Performance of the Work means the time when the prerequisites to Total Performance of the Work required by the Contract are fulfilled and the entire Work, except those items arising from the warranty provisions of the Contract, has been performed to the requirements of the Contract Documents and is so declared, in writing, by the Owner.
Total Performance of the Work means when the Contract is deemed to be completed pursuant to the Construction Act, R.S.O. 1990, c. C.30, as such statute is amended or replaced from time to time. If such legislation is not in force or does not contain such definition, Total Performance of the Work shall have been reached when the entire Work, except those items arising from the provisions of Bid Document, has been performed to the requirements of the Contract Documents and is so certified by the Town, or, if a Consultant has been appointed, the Consultant; “Town” means The Corporation of the Town of Aurora or its authorized agent or representative as designated to the Contractor but does not include the Consultant;
Total Performance of the Work has the meaning set forth in the Craft Construction Contract.

Examples of Total Performance of the Work in a sentence

  • The date for Total Performance of the Work identified in such schedule shall not be later than the Scheduled Date for Total Performance of the Work.

  • Notwithstanding any transfer of title to the Work or any portion thereof to the Owner, the Contractor shall be responsible for and bear the risk of Loss with respect to the Work (including Products delivered to the Site, whether or not incorporated into the Work) until the date of Total Performance of the Work.

  • Scheduled Date for Total Performance of the Work means the scheduled date for Total Performance of the Work as set out in row C.5 of the Information Sheet, or if no such date is set out, the number of Calendar Days or Working Days after the Commencement Date specified in row C.5 of the Information Sheet.

  • Damage shall not affect the rights and obligations of either party under the Contract except that the Contractor shall be entitled to such reasonable extension of time for Substantial and Total Performance of the Work as the Engineer/Architect may decide.

  • Final Certificate for Payment means the certificate issued on Total Performance of the Work.


More Definitions of Total Performance of the Work

Total Performance of the Work means that the Contractor has performed and certified all obligations, other than warranty obligations under the Contract Documents, and is so certified by the City;
Total Performance of the Work means when the entire Work has been performed to the requirements of this Contract and is so certified by the Owner.
Total Performance of the Work means, for each part of the Project, the Work is deemed to be completed pursuant to Section 2(3) of the Construction Lien Act (Ontario) and is so certified by the applicable Prime Consultant or by agreement between the Owner and the Project Manager;
Total Performance of the Work means when the entire Work, except those items arising from the provisions of Section 19.01, has been performed to the requirements of the Contract Documents and is so certified by the Ministry Representative;

Total Performance of the Work means when the entire Work has been performed to the requirements of this Agreement and is so certified by the Owner.
Total Performance of the Work has the meaning given to such term in the Construction Contract. “Travelers” means Travelers Guarantee Company of Canada.
