Toxic material definition

Toxic material means a material in con- centration or amount of such toxicity as to constitute a recognized hazard that is caus- ing or is likely to cause death or serious physical harm.
Toxic material means material that is capable of causing death or serious bodily injury almost immediately on being absorbed through the skin, inhaled, or ingested.
Toxic material means any substance that can be poisonous if inhaled, swallowed, or absorbed into the body through cuts, breaks in the skin, ingestion, or bodily contact.

Toxic material means a material so toxic to man as to afford an unusual hazard to life and health during firefighting or other emergency operations. Examples include parathion, organic phosphates (insecticides and pesticides), and vinyl chloride.

Seller has not received any summons, citation, directive, letter or other communication, written or oral, from any Governmental Authority (a) indicating that the Property is or has been the site of any oil, hazardous waste, or other toxic substance activity or storage, or (b) concerning any intentional or unintentional action or omission on Seller's part which has resulted in the releasing, spilling, leaking, pumping, pouring, emitting, emptying or dumping of "Toxic Material", "Hazardous Substances" or "Hazardous Waste" into waters or onto lands of the state in which the Property is located or into waters outside the jurisdiction of such state where damage may have resulted in the lands, waters, fish, shellfish, wildlife, air and other resources owned, managed, held in trust or otherwise controlled by such state.
