Xxxxx Fargo Loan Documents definition

Xxxxx Fargo Loan Documents means the Xxxxx Fargo Credit Agreement and the other Loan Documents (as defined in the Xxxxx Fargo Credit Agreement), each as amended (including any amendment and restatement thereof), modified, renewed, refunded, replaced, or refinanced in whole or in part from time to time, including any agreement extending the maturity of, consolidating, or otherwise restructuring (including adding subsidiaries of the Company as additional obligors thereunder) all or any portion of the Xxxxx Fargo Indebtedness under such agreement or any successor or replacement agreement and whether by the same or any other agent, lender, or group and whether or not increasing the amount of Xxxxx Fargo Indebtedness that may be incurred thereunder.

Xxxxx Fargo Loan Documents means, collectively, (i) that Loan and Trust Agreement dated as of April 1, 2006 (the “4/1/06 Loan Agreement”) among Borrower, County of Fillmore, State of Nebraska, as issuer (“Issuer”), and Xxxxx Fargo Bank, N.A., as trustee (“Trustee”), as Borrowers obligations and liabilities under the 4/1/06 Loan Agreement have been assigned to and assumed by XXX Xxxxxxxx pursuant to that Assignment and Assumption Agreement dated as of November 14, 2006 among Borrower, XXX Xxxxxxxx, Issuer and Trustee, (ii) that Promissory Note dated April 27, 2007 among Borrower, issuer and Trustee, (iii) that Subordinate Deed of Trust and Construction Security Agreement by Borrower in favor of Trustee, (iv) that Tax Regulatory Agreement dated as of April 27, 2006 from Borrower and Issuer to Trustee and (v) that Continuing Disclosure Agreement as of dated April 1, 2006 between Borrower and Trustee, together with all amendments, supplements, agreements, documents, exhibits, schedules and certificates contemplated thereby or entered into in connection with any of the foregoing.

Xxxxx Fargo Loan Documents means the Amended and Restated Credit Agreement dated as December 7, 2001, by and among Hauser, BIE, Technical, ZetaPharm, Xxxxxx Natural Products, Inc., and Xxxxx Fargo, as amended, and the notes and other agreements entered into pursuant to such Agreement.

• Promptly upon their becoming available to the Company, copies of all agreements containing forbearance arrangements, extensions of payment dates and/or maturity dates, or other temporary financial accommodations provided in connection with the Xxxxx Fargo Loan Documents or the Senior Note Documents.

Xxxxx Fargo Loan Documents collectively, (i) the Credit Agreement, dated as of March 25, 1997, between the Borrower and Xxxxx Fargo, (ii) the promissory note made by the Borrower to Xxxxx Fargo pursuant thereto and (iii) all other documents executed and delivered by the Borrower or any of its Subsidiaries in connection therewith.

(f/k/a Norwest Bank, National Association)) (“Xxxxx Fargo”), as Trustee for the Registered Holders of First Union National Bank Commercial Mortgage Trust, Commercial Mortgage Pass-Through Certificates, Series 2000-C2: (a) that certain Promissory Note dated as of May 1, 2000, executed by Richland Assisted, L.L.C. (“Richland LLC”) in favor of Original Lender and evidencing the Loan; (b) that certain Deed of Trust, Fixture Filing, Assignment of Leases, Rents and Profits and Security Agreement dated as of May 1, 2000, executed by Richland LLC, as grantor, in favor of Chicago Title Insurance Company, as trustee, for the benefit of Original Lender, as beneficiary, and recorded in the official records of Xxxxxx County, Washington on May 1, 2000 as Instrument No. 2000-010510 (the “Deed of Trust”); and (c) any other document, agreement or instrument which now or hereafter evidences and/or secures the Loan, together with any replacements, substitutions, supplements, modifications or amendments thereof or thereto (including, without limitation, any amendment to such documents made in connection with Landlord’s acquisition of the Premises and assumption of the Loan).

Xxxxx Fargo Loan Documents means those certain loan documents executed in favor of Xxxxx Fargo, including (i) that certain Combination Loan and Security Agreement (Contract Number 404858-700), dated October 10, 2013, by and between HPS, as Debtor, and Xxxxx Fargo, as Secured Party, (ii) that certain Combination Loan and Security Agreement (Contract Number 404858-701), dated June 11, 2013, by and between HPS, as Debtor, and Xxxxx Fargo, as Secured Party, and (iii) any guaranty executed by a Seller Indemnitee related thereto.

Xxxxx Fargo Loan Documents means (a) the Second Amended and Restated Credit Agreement dated August 2, 2017, by and between Kinergy Marketing LLC, Pacific Ag.
