Cancellation. If you cancel a binding booking, the following applies: • Between 0 and 48 hours before the agreed start of the rental, the full total rental price including extras must be paid to Roadsurfer. Due to the declared withdrawal, there is no claim to a value voucher (hereinafter "cancellation voucher") or refund of payments made. • Between 48 hours and 59 days before the agreed start of the rental period, the full total rental price including extras is payable to Roadsurfer. However, you will receive a cancellation voucher worth 50% of the total rental price to be redeemed upon conclusion of a future rental agreement, any claim for reimbursement by the renter beyond this is excluded. If the renter adds a Flex option for a fee when concluding the rental agreement, the following applies to a cancellation between 48 hours and 59 days before the agreed start of the rental period: - Cancellation is free of charge and the tenant receives any payments made back in full or can rebook to any period in the amount of the total rental price. - However, if the total rental price was paid by the renter in whole or in part with a cancellation or gift voucher, the renter will only receive a cancellation voucher in the amount of the cancellation or gift voucher value brought in at the time of payment. - If a rebooking results in a higher total rental price than the one originally agreed upon, the Lessee shall pay the difference. If, on the other hand, the new rental price is lower, the renter will receive a cancellation voucher for the difference compared to the originally agreed rental price. • If at least 60 days before the agreed start of the rental, the cancellation is free of charge and the tenant will be refunded any payments made. However, if the total rental price was paid by the renter in whole or in part with a cancellation or gift voucher, the renter will only receive a cancellation voucher in the amount of the cancellation or gift voucher value brought in at the time of payment. Equipment already booked cannot be cancelled separately from a booking. The cost of equipment, such as bicycle racks or a camping toilet, shall not be refunded in the event of cancellation. Early return of the rented vehicle shall not provide you with any credit, partial refund of the rental price, a cancellation voucher, or a (partial) rebooking for another hire period. Cancellation. Notes purchased by or on behalf of the Issuer, the Guarantor or any of the Guarantor's subsidiaries (where applicable) may be surrendered for cancellation, by surrendering each such Note together with all unmatured Receipts and Coupons and all unexchanged Talons to the Fiscal Agent and, if so surrendered, will, together with all Notes redeemed by the Issuer, be cancelled forthwith (together with all unmatured Receipts and Coupons and unexchanged Talons attached thereto or surrendered therewith). Any Notes so surrendered for cancellation may not be reissued or resold and the obligations of the Issuer and the Guarantor (where applicable) in respect of any such Notes shall be discharged.

Cancellation. (including partial cancellation) of an order at the Customer's request is only possi- ble with Xxxxxxx'x consent. If a request for total or partial cancellation is communicated only within 30 days before the indicative delivery date or, if expressly agreed between the parties, the binding delivery date, as well as in case of refusal of acceptance of the goods by the Customer, Oberalp shall be entitled to apply a penalty of 20% of the value of the cancelled or refused order. The closure of business or cessation of activity shall not exempt the Customer, in case of partial or total order cancellation, from the payment of the corresponding penalties. This penalty is without prejudice to Xxxxxxx’x rights to claim compensation for any further damage.

Ciò che il divieto di patto commissorio vuole evitare è che la situazione di temporanea difficoltà economica in cui si trova il debitore porti ad abusi del creditore che tenti di lucrare sulla differenza di valore tra il credito e la garanzia offerta dal debitore. La disciplina del patto commissorio ha alla base una presunzione di sproporzione tra il credito e il valore del bene che acquisirebbe il creditore in caso di inadempimento77. L’autonomia privata, nella predisposizione del regolamento contrattuale, deve farsi carico di prevedere meccanismi tecnici che valgano a superare l’accennata presunzione di sproporzione tra il valore del credito e quello del bene dato in garanzia.
