Warranty. Except for the following article 14, CAENELS products are covered by a 12 (twelve)-month guarantee, from the lack of conformity in accordance with legislative decree no. 24/02 implemented by the 1999/44/EC directive. Products with 24 (twenty-four) or 36 (thirty-six)-month guarantee period are clearly indicated in the quotation. This period starts from the delivery date of each product to customer. Warranty includes, for the above mentioned period, the repair and/or substitution interventions of the defective products, to be held in CAENELS premises in Basovizza, Trieste (Italy) or in Xxxxxxxxx, Xxxxx (Xxxxx). Substituted parts are and will remain CAENELS property. Shipping costs will be at customer’s charge unless otherwise agreed by written form. The repair will not cover defects due to causes occurred for an inappropriate use of the products. The anomalies and/or defects must be notified immediately to CAENELS in written form. The notification shall be made by the customer within 5 days from the goods receipt date in case of obvious defect; in case of hidden defect CAENELS must be informed immediately and no later than one week from the date in which the defect is detected. Otherwise it will be excluded from the warranty. Claims referred to partial deliveries do not give to customer the right to reject the fulfilment of the complete contract. Customer declares to be aware and to have read the information on the instructions for using CAENELS products. Products on which an out-of-warranty repair is performed are covered by a 12 (twelve)-month guarantee period on the replaced or newly installed parts/components only; the repaired products will anyhow be covered by a 4 (four)- month period in its entirety.

Warranty. The supplier guarantees the conformity of the products supplied, i.e. the lack of defects in materials and workmanship and their full compliance with the terms of the Agreement signed by the parties. The guarantee is valid for twelve months from the date of delivery of the products to the final User, which shall be that date found in Supplier or Retailer sales documentation, meaning the invoice date in the case of direct user delivery, or the date of transport documentation in the case of transport and/or transporter means delivery. For substituted products or components, the guarantee is valid from the day of their redelivery to the user. Any product flaws and/or defects noted by the user during the period of the guarantee must be reported by means of a certified letter with return receipt addressed to the Supplier within no later than eight days from delivery for evident defects and eight days from their discovery for hidden defects. Once reported writing has been regularly received, the Supplier will undertake, at his choice – within a reasonable term according to the extent of the objection – to repair or substitute free of charge the products or parts thereof which proved to be defective. The return of the defective goods should always be authorised by the supplier in writing. Furthermore the goods must be returned in their original packaging. The replacement or reparation shall generally be ex works, meaning that the Customer shall be responsible for all costs and risks related to the transportation of faulty products. However, if the Supplier, in agreement with the Customer, believes it is more appropriate to carry out the necessary replacement or reparation work in the Customer's premises, the Customer shall also be expected to pay traveling and accommodation expenses of the technicians provided by the Supplier, in addition to guaranteeing the availability of all the equipment and auxiliary staff required to carry out the tasks in the quickest and safest way. The guarantee shall be terminated whenever products have been assembled or utilised incorrectly or else whenever not in conformity with directions supplied by the Manufacturer, or if any products have received insufficient maintenance or if they have been modified or tampered with. Warranty. GHISALBA S.p.A. guarantees good quality and manufacturing of the products sold at the conditions indicated in the declared technical specification for a period of 12 months starting from delivery date to the BUYER - unless upon other written agreement - Warranty does not extend to products that are defective, and or damaged due to natural attrition, incompetence, negligence tampered or repaired by third parties not in agreement with and exceeding XXXXXXXX S.p.A ‘s technical specifications or damaged accidentally. The prompt intervention under warranty on behalf of GHISALBA S.p.A. is subordinated to the compliance with the payment conditions from the BUYER. For product substituted und warranty GHISALBA S.p.A. will refund transport costs of the goods returned using the forwarder chosen by XXXXXXXX S.p.A. GHISALBA S.p.A. will be not liable for the extra costs of dismantling , installation and starting of the product repaired or replaced. 8.1 Nothing is due to the BUYER for the time during which the plant has been inactive; nor the BUYER may claim for compensations or allowances regarding expenses, accidents, direct and/or indirect damages occurred. The parts replaced under warranty remain property of GHISALBA S.p.A. and must be returned free of charge to GHISALBA S.p.A. head office. 8.2 Repairs or replacements under warranty, will be at discretion of GHISALBA S.p.A. , will be executed on GHISALBA S.p.A. premises or other warehouses or on buyer’s site. In any case the traveling expenses for GHISALBA S.p.A. personnel will be at the BUYER’s charge.For products substituited under warranty GHISALBA S.p.A. will refund transport costs of the goods returned using the forwarder chosen by XXXXXXXX S.p.A. GHISALBA S.p.A. will be not libale for the extra costs of dismantling, installation and starting of the product repaired or replaced. For operations to be executed on the BUYER’s site, the BUYER must supply GHISALBA S.p.A. with all the instruments and the auxiliary personnel at his charge. 8.3 The BUYER may ask to test the Products on BUYER’S site. The intervention will be executed by XXXXXXXX S.p.A.’s personnel at BUYER’s charge. Excluded from the warranty are those goods and parts subjected to wear consumption ( electrical contacts ). In no case the terms of loss and limitations are to be considered extended with ref. The art. 1512 of the civil law.
Warranty. Motovario S.p.A. guarantees the products sold for one year from the date of delivery, considering use of one daily work-shift. Warranty is limited to repair or replacement, free at our plant, of defective parts due to an ascertained defect of material or manufacture. The parts replaced remain our property. All other compensation is excluded, nor can any direct and/or indirect damage be claimed of any nature, also for the temporary lack of use of the goods purchased. Warranty is excluded for leakage of lubricant caused by normal wear of the oil seals. Warranty is forfeit for products not used in conformity with our instructions or that are anyhow modified, repaired or even partially dismantled. Verifying the compatibility of applications and correct mechanical couplings and electrical connections with the specifications of Motovario products, as indicated in the manufacturer’s catalogues, is solely to the concern and responsibility of the buyer.
Warranty. The supply shall be covered by the standard guarantee as follows: a. The Supplier warrants that the Goods supplied under the Contract are new, unused, of the m ost recent or current models and that they incorporate all recent improvements in design an d materials unless provided otherwise in the Contract. The Supplier further warrants that all Goods supplied under this Contract shall have no defect arising from design, materials or wor kmanship or from any act or omission of the Supplier that may develop under normal use of t he supplied Goods in the conditions prevailing in the purchaser’s country. b. The supplier shall give a warranty of satisfactory performance of the complete equipment/ st ores and warranty shall remain valid for eighteen (18) months from the date of receipt and a cceptance of material at consignee’s end or twelve (12) months from the date of its use/fitme nt/commissioning, whichever is earlier. c. The Purchaser shall promptly notify the Supplier in writing of any claims arising under this w arranty. The Supplier shall, within thirty days, repair or replace the defective Goods or parts thereof, free of cost at the ultimate destination. The Supplier shall take over the replaced par ts/Goods at the time of their replacement. No claim whatsoever shall lie on the Purchaser for the replaced parts/Goods thereafter. d. If the Supplier, having been notified, fails to remedy the defect(s) within thirty days, the Pur chaser may proceed to take such remedial action as may be necessary, at the Supplier's risk and expense and without prejudice to any other rights which the Purchaser may have a gainst the Supplier under the Contract. Further, the supplier shall warrant that the items supplied under the contract/ supply order: i. Not likely to be discontinued or become obsolete till the life of the offered equipment. ii. Is in accordance with the contract specifications.
Warranty means the repairs, fixing and replacement of items as specified in Article 9 of this Contract when these items are damaged, defective, or malfunctioning not on account of the Parking Lot users over a certain warranty period as provided by law on residential housing and this Contract;

Repair interventions do not cover failures that occur due to causes other than normal use or improper use of the products. Any anomalies and/or defects must be immediately notified to CAEN in writing. The notification must be made by the Customer within 5 days of receiving the goods in the case of evident anomalies; in the case of hidden defects, CAEN must be notified immediately and no later than one week from the moment such defects could have been detected. Otherwise, any form of warranty is not applicable. Claims related to partial deliveries do not entitle the Customer to refuse the performance of the entire contract. The Customer declares to be aware of and to have read the information regarding the methods of use of the products.
