Common use of DELAYS Clause in Contracts

DELAYS. If Supplier fails implement this Purchase Order, reject it or fail to make delivery, or if the Buyer fails to accept delivery in accordance with the delivery schedule, the other party may cancel the remainder of this Order unless the delay is justifiable, as defined herein. "Justifiable delay" does not constitute breach of this Order, and it means any delay that does not result from fault or negligence of the
