Access Following Commencement. With effect from the Signature Date, SANParks shall grant to the Private Party and shall use all reasonable endeavours to ensure that for the duration of the Project Term the Private Party, the Private Party Parties have such access to the Xxxx Braai site as is required by the Private Party for the carrying out of the Project therein, but subject always to the provisions of this PPP Agreement.
Access Following Commencement. 12.2.1 With effect from the Signature Date, SANParks grants to the Private Party and shall use all reasonable endeavours to ensure that for the duration of the Project Term, the Private Party and the Private Party Parties have such access to the Spa Facility as is required by the Private Party for the carrying out of the Project, subject at all times to the provisions of this PPP Agreement.
12.2.2 With effect from the Expiry Date or the Termination Date, as the case may be, the Private Party’s interest in the Spa Facility shall automatically terminate and the Private Party shall be given access to the Spa Facility only for purposes of giving effect to the provisions of Clause 30 (Effects of Termination).
Access Following Commencement. 10.2.1 With effect from the Operation Commencement Date, SANParks shall grant to the Private Party and shall use all reasonable endeavours to ensure that for the duration of the Project Term the Private Party and the Private Party Parties have such access to the Estate as is required by the Private Party for the carrying out of the Project therein, but subject always to the provisions of this PPP Agreement.
Access Following Commencement. 12.2.1 With effect from the Signature Date, SANParks grants to the Private Party and shall use all reasonable endeavours to ensure that for the duration of the Project Term, the Private Party and the Private Party Parties have such access to the Geelbek Restaurant and with related tourism activities as is required by the Private Party for the carrying out of the Project, subject at all times to the provisions of this PPP Agreement.
12.2.2 With effect from the Expiry Date or the Termination Date, as the case may be, the Private Party’s interest in the Geelbek Restaurant and with related tourism activities shall automatically terminate and the Private Party shall be given access to the Geelbek Restaurant and with related tourism activities only for purposes of giving effect to the provisions of Clause 30 (Effects of Termination).
Access Following Commencement. 10.2.1 With effect from the Operation Commencement Date, SANParks shall grant to the Operator and shall use all reasonable endeavours to ensure that for the duration of the Project Term the Operator and the Operator Parties have such access to the Houseboats as is required by the Operator for the carrying out of the Project therein, but subject always to the provisions of this Management Agreement.
10.2.2 The Operator, for the purposes of the Project, can traverse and carry out the Project in the Kraalbaai area and in addition, also traverse the shortest safe route to Langebaan for the sole purpose of discharging waste and filling water tanks.
Access Following Commencement. 10.2.1 With effect from the Operation Commencement Date, SANParks shall grant to the Private Party and shall use all reasonable endeavours to ensure that for the duration of the Project Term the Private Party and the Private Party Parties have such access to the Abseiling activity as is required by the Private Party for the carrying out of the Project therein, but subject always to the provisions of this PPP Agreement.The Private Party, for the purposes of the Project, can carry out the Abseiling activity and in addition, the standard cable car rate per person per day will be payable to the Table Mountain Aerial Cableway Company Ltd. if the cable car is used as entry or exit point to the operation by the staff and customers.
Access Following Commencement. 10.2.1 With effect from the Operation Commencement Date, SANParks shall grant to the Lessee and shall use all reasonable endeavours to ensure that for the duration of the Project Term the Lessee and the Lessee Parties have such access to the Houseboats at Kraalbaai as is required by the Lessee for the carrying out of the Project therein, but subject always to the provisions of this PPP Agreement.
10.2.2 The Operator, for the purposes of the project, can traverse and carry out the houseboat accommodation services in the Kraalbaai area and in addition, also traverse the shortest safe route to Langebaan for the sole purpose of discharging waste and filling water tanks.
Access Following Commencement. 12.2.1 With effect from the Signature Date, SANParks grants to the Private Party and shall use all reasonable endeavours to ensure that for the duration of the Project Term, the Private Party and the Private Party Parties have such access to the Phabeni Education Centre as is required by the Private Party for the carrying out of the Project, subject at all times to the provisions of this PPP Agreement.
12.2.2 With effect from the Expiry Date or the Termination Date, as the case may be, the Private Party’s interest in the Phabeni Education Centre shall automatically terminate and the Private Party shall be given access to the Phabeni Education Centre only for purposes of giving effect to the provisions of Clause 30 (Effects of Termination).
Access Following Commencement. 12.2.1 With effect from the Signature Date, SANParks grants to the Private Party and shall use all reasonable endeavours to ensure that for the duration of the Project Term, the Private Party and the Private Party Parties have such access to the Treehouse Camp Facility as is required by the Private Party for the carrying out of the Project, subject at all times to the provisions of this PPP Agreement.
12.2.2 With effect from the Expiry Date or the Termination Date, as the case may be, the Private Party’s interest in the Treehouse Camp Facility shall automatically terminate and the Private Party shall be given access to the Treehouse Camp Facility only for purposes of giving effect to the provisions of Clause 30 (Effects of Termination).
Access Following Commencement. 12.2.1 With effect from the Signature Date, SANParks grants to the Private Party and shall use all reasonable endeavours to ensure that for the duration of the Project Term, the Private Party and the Private Party Parties have such access to the Groote Xxxxxx Estate Tea Room and Restaurant as is required by the Private Party for the carrying out of the Project, subject at all times to the provisions of this PPP Agreement.
12.2.2 With effect from the Expiry Date or the Termination Date, as the case may be, the Private Party’s interest in the Groote Xxxxxx Estate Tea Room and Restaurant shall automatically terminate and the Private Party shall be given access to the Groote Xxxxxx Estate Tea Room and Restaurant only for purposes of giving effect to the provisions of Clause 30 (Effects of Termination).
