PPP Rights. 5.2.1 The grant of the PPP Rights to the Private Party shall entitle and oblige the Private Party to: The exclusive right to design, operate, manage and maintain the Estate for gain for the duration of the PPP Agreement; conduct and manage all facets of the Project and to operate and maintain the Estate, infrastructure and/or equipment used for or in connection with the Project; generate, charge and collect revenues from the execution of such PPP Rights; the obligation to use the Project Site in accordance with the terms of this PPP Agreement; access to the Protected Area and access for the Private Party’s employees, subject to the normal Protected Area’s operating rules and hours on the same basis as SANParks’ employees.
PPP Rights. 5.1 Exclusive Grant of PPP Rights at the Geelbek Restaurant and with related tourism activities
5.1.1 Subject to the terms of this PPP Agreement, SANParks hereby grants the PPP Rights to the Private Party, on an exclusive basis, for the Project Term.
5.1.2 For the duration of the Project Term, SANParks undertakes not to:
5.1.2.1 establish restaurant facilities or any other facilities which involve any preparation and/or sale of food and/or beverage products including but not limited to reheating, rehydrating and/or regeneration of food and/or beverage products at the Geelbek Restaurant;
5.1.2.2 grant the PPP Rights or any other rights referred to in this Clause 5 to any third parties, provided that SANParks reserves the right to manage and operate the Day Visitor Area and present a variety of tourism products thereat, inclusive of food preparation.
5.1.3 The Parties acknowledge that the Geelbek Precinct has been open for public viewing; accordingly, the Private Party shall be obliged to grant access thereto to the public.
5.2 Geelbek Restaurant and with related tourism activities Rights
5.2.1 The grant of the PPP Rights to the Private Party shall entitle the Private Party to:
5.2.1.1 the exclusive right to operate a restaurant and with related tourism activities in the Geelbek Precinct area;
5.2.1.2 provided that the Private Party shall allow access to the Geelbek Restaurant and with related tourism activities to the public;
5.2.1.3 the right to use the Day Visitor Area after hours for a xxxx braai offering to its patrons;
5.2.1.4 generate, charge and collect revenues from the exercise of the PPP Rights;
5.2.1.5 use the Geelbek Restaurant and with related tourism activities in accordance with the terms of this PPP Agreement;
5.2.1.6 access by the Private Party and its employees to the Protected Area, subject to the normal Protected Area’s operating rules and hours as set by SANParks from time to time;
5.2.1.7 provide day and night drives as part of its service offering to its patrons, provided that such drives shall be conducted with vehicles complying with the standards and requirements as may be determined by SANParks from time to time;
5.2.1.8 be permitted to erect structures for the related tourism activities to the Geelbek precinct, provided that such walkway shall be designed by a professional engineer and complies with the requirements of the South African Heritage Resource Agency (SAHRA) and/or any other requirements as may be reasonably set by SAN...

PPP Rights. 5.1 Exclusive Grant of PPP Rights at the Groote Xxxxxx Estate Tea Room and Restaurant
5.1.1 Subject to the terms of this PPP Agreement, SANParks hereby grants the PPP Rights to the Private Party, on an exclusive basis, for the Project Term.
5.1.2 For the duration of the Project Term, SANParks undertakes not to:
5.1.2.1 establish restaurant and functions facilities or any other facilities which involve any preparation and/or sale of food and/or beverage products including but not limited to reheating, rehydrating and/or regeneration of food and/or beverage products at the Groote Xxxxxx Estate Tea Room and Restaurant
5.1.3 The Parties acknowledge that the Groote Xxxxxx Estate has been open for public viewing; accordingly, the Private Party shall be obliged to grant access thereto to the public.
PPP Rights. 5.1 Exclusive Grant of PPP Rights at the Phalaborwa Gate Xxxx Braai Facility
5.1.1 Subject to the terms of this PPP Agreement, SANParks hereby grants the PPP Rights to the Private Party, on an exclusive basis, for the Project Term.
5.1.2 For the duration of the Project Term, SANParks undertakes not to:
5.1.2.1 establish any other xxxx braai facility at the Phalaborwa Gate;
5.1.2.2 establish game drives which involve any offering of xxxx breakfast or xxxx dinner\braai in the Phalaborwa Gate;
5.1.2.3 grant the PPP Rights or any other rights referred to in this Clause 5 to any third parties.
PPP Rights. 5.1 Exclusive Grant of PPP Rights at the Boulders Retail Facility with related tourism activities as set out in the bid documents.
5.1.1 Subject to the terms of this PPP Agreement, SANParks hereby grants the PPP Rights to the Private Party, on an exclusive basis, for the Project Term.
5.1.2 For the duration of the Project Term, SANParks undertakes not to:
5.1.2.1 establish any other curio retail shop facility on the Boulders Facility;
5.1.2.2 provide an on the go quality and value-for-money food and beverage services to SANParks’ customers at the Boulders Retail facilities
5.1.2.3 grant the PPP Rights or any other rights referred to in this Clause 5 to any third parties, provided that SANParks reserves the right to manage and operate the Day Visitor Area and present a variety of tourism products thereat, inclusive of food preparation.
5.1.3 The Parties acknowledge that the Boulders Retail Facility has been open for public viewing, accordingly, the Private Party shall be obliged to grant access thereto to the public.
PPP Rights. 5.1 Exclusive Grant of PPP Rights at the the Kiosk and Retail Curio Shop Facility
5.1.1 Subject to the terms of this PPP Agreement, SANParks hereby grants the PPP Rights to the Private Party, on an exclusive basis, for the Project Term.
5.1.2 For the duration of the Project Term, SANParks undertakes not to:
5.1.2.1 establish any other Kiosk and Retail Curio Shop in the Dinosaur IC of the GGHNP outlined in this PPP Agreement;
5.1.2.2 grant the PPP Rights or any other rights referred to in this Clause 5 to any third parties, provided that SANParks reserves the right to manage and operate the Day Visitor Area and present a variety of tourism products thereat, inclusive of food preparation.
5.1.3 The Parties acknowledge that the Facility will open for public viewing; accordingly, the Private Party shall be obliged to grant access thereto to the public.
PPP Rights. 5.1 Exclusive Grant of PPP Rights at the Nkuhlu Precinct Facility
5.1.1 Subject to the terms of this PPP Agreement, the PPP Rights for the purposes of the Project are granted by SANParks to the Private Party on an exclusive basis during the Project Term.
5.1.2 During the period of this PPP Agreement, SANParks undertakes :
5.1.2.1 not to establish or operate any new tourism facilities comprising accommodation or restaurant facilities in close proximity being a 5 kilometer radius from Nkuhlu (except if agreed with the Private Party);
5.1.2.2 not to grant to any third parties the rights referred to in clause 5 and to ensure no third party operates or establishes any such facilities referred to in Clause 5 at the Nkuhlu Picnic Site.
5.1.3 The Private Party is obliged to operate, manage and maintain the Nkuhlu Picnic Site Facility as a public facility, open to all visitors to the Park, and shall not be permitted to bar entrance to the public.
5.1.4 For the purposes of this Clause 5, the grant of exclusive rights is limited to the PPP Rights, expressly, to conduct and operate the Nkuhlu Picnic Site Facility (including rights for a restaurant and retail facility at the site), rights to construct and operate a 15 bed lodge at the site (building plans approved by SANParks), affording a xxxx braai product at the site as well as an astronomy product.
PPP Rights. 5.1 Exclusive Grant of PPP Rights at the NAMAQUA FLOWERS BEACH LUXURY MOBILE TENTED CAMP
5.1.1 Subject to the terms of this PPP Agreement, SANParks hereby grants the PPP Rights to the Private Party, on an exclusive basis, for the Project Term.
5.1.2 For the duration of the Project Term, SANParks undertakes not to:
5.1.2.1 grant the PPP Rights or any other rights referred to in this Clause 6 to any third parties provided that SANParks reserves the right to manage and operate the Day Visitor Area and present a variety of tourism products thereat, inclusive of food preparation.
5.1.3 The Parties acknowledge that the NAMAQUA Precinct has managed open access to the public; accordingly, the Private Party shall be obliged to grant managed access thereto to the public everyday between the operational hours of the NAMAQUA National Park.
