ACCIDENT MAKE-UP PAY. An employee on being absent from work due to an injury shall be entitled to accident make up pay, being a weekly payment of an amount representing any shortfall between the total weekly amount payable under the Accident Compensation Act 1985 at the date from which liability is accepted under that Act and the weekly amount that would have been paid to the employee at ordinary time rates as of that same date as per clause 9.1, 9.2 & 9.3. “Rates of Pay” provided that: • The injury is accepted and is covered under the Accident Compensation Act, • Accident pay shall not apply in respect of the first two weeks of incapacity, • Accident Pay applies for a period not exceeding 52 weeks. • A casual employee’s entitlement is confined to the eligible amount payable under the Accident Compensation Act.
