AGENT’S COMPENSATION AND EXPENSES. As compensation for the services provided by Agent under this Agreement (and exclusive of reimbursement of expenses to which Agent is entitled hereunder). Owner shall pay Agent as follows: 17.1 FOR MANAGEMENT SERVICES The greater of (i) $5,200 per month or (ii) 4% of the total monthly gross receipts from the premises, payable by the 1st day of the current month for the duration of this Agreement. Payments due Agent for Periods of less than a calendar month shall be prorated over the number of days for which compensation is due. The percentage amount set forth in (ii) above shall be based upon the total gross receipts form the premises during the preceding month. The term "gross receipts" shall be deemed to include all collected rents and other income and charges from the normal operation of the Premises, including, but not limited to, rents, parking fees, laundry income, forfeited security deposits, pet deposits, other fees and deposits, special charges listed in paragraph 3.2, or excess interest on security deposits (from paragraph 3.3), and other miscellaneous income. Gross receipts shall NOT be deemed to include the value of units provided to on- site staff, nor the income arising out of the sale of real property or settlement of fire or other casualty losses and items of a similar nature. 17.2 FOR APARTMENT LEASING N/A. 17.3 FOR COMMERCIAL LEASING N/A. 17.4 FOR MODERNIZATION (REHABILITATION/CONSTRUCTION) N/A.
AGENT’S COMPENSATION AND EXPENSES. As compensation for the services provided by Agent under this Agreement (and exclusive of reimbursement of expenses to which Agent is entitled hereunder), Owner shall pay Agent as follows:six percent (6 %) of the monthly gross receipts from the Premises, four percent (4%) payable by the 10th day of the succeeding month for the duration of this Agreement, and two percent (2%) payable by the 10th day of the month following the end of the fiscal year, subject to the provisions of the first mortgage agreement. The term "gross receipts" shall be deemed to include all rents and other income and charges from the normal operation of the Premises, including, but not limited to, rents, rent loss insurance, parking fees, laundry income, interest income and other miscellaneous income including excess interest on security deposits (see Section 3.3) as well as forfeited security deposits, rent loss insurance, pet deposits, other fees and deposits. Gross receipts shall NOT be deemed to include income arising out of the sale of real property or the settlement of fire or other casualty losses and items of a similar nature.

SAMPLE 16.5 Any time of AGENT or AGENT's employee(s) expended in preparation for and attendance to court on OWNER'S behalf, with the exception of eviction court proceedings or small claims cases related to security deposit disputes, will be billed at the rate of $50 per hour. OWNER and AGENT agree such charges will be paid by the OWNER but charged to the TENANT as applicable. 16.6 Normal property management services do not include showing property to real estate agents, inspectors, appraisers, or prospective buyers while property is for sale. Should OWNER request AGENT to perform services not included in normal property management, a fee based at $25 per hour may be assessed. 16.7 AGENT shall receive and retain all TENANT application fees, non-sufficient fund bank fees, move out inspection fees, non-payment delivery notice fees, termination fees, unused pet fees, $10 of pet rent for each pet and late fee charged to tenant and enforced by RentWise Property Management lease agreement.

These expenses include, but are not limited to, advertising and legal fees. 15.5 Any time of Agent or Agent’s employee(s) expended in preparation for and attendance in court on Owner’s behalf will be billed at the rate set forth in the Property Management Fee Disclosure attached as Exhibit “A” to this Agreement. Owner and Agent agree that such charges will be paid by the Owner but charged to the Tenant. 15.6 Normal property management services do not include showing Premises to real estate agents, inspectors, appraisers or prospective buyers while property is for sale. Should Owner request Agent to perform services not included in normal property management, a fee based at $25.00 per hour may be assessed at Agent’s discretion. 15.7 Agent shall receive and retain all Tenant application fees, non-sufficient fund bank fees, move-out inspection fees, non-payment delivery notice fees, and late fees. 15.8 Should any Tenant, during the term of this Agreement, enter into an agreement to purchase any property covered by this Agreement, then Stamar Management Corp shall receive a commission of three percent (3%) of the sale price.
