Agreement and dispute settlement facilitation. (a) For the purposes of compliance with this Agreement (including compliance with this dispute settlement procedure) where the chosen Employee representative is another Employee of the Employer, he/she must be released by the Employer from normal duties for such periods of time as may be reasonably necessary to enable him/her to represent Employees concerning matters pertaining to the employment relationship including but not limited to:
(i) Investigating the circumstances of a dispute or an alleged breach of this Agreement;
(ii) Endeavouring to resolve a dispute arising out of the operation of this Agreement; or
(iii) Participating in conciliation, arbitration or any other agreed alternative dispute resolution process.
(b) The release from normal duties referred to in this clause is subject to the proviso that it does not unduly affect the operations of the Employer.

a. investigating the circumstances of a dispute or an alleged breach of Section 3 or the National Employment Standards;
b. endeavouring to resolve a dispute arising out of the operation of Section 3 or the National Employment Standards; or
c. participating in conciliation, arbitration or any other agreed alternative dispute resolution process.
77.3.2 The release from normal duties referred to in this clause is subject to the proviso that it does not unduly affect the operations of the Employer.

12.4.1 Investigating the circumstances of a dispute or an alleged breach of this Agreement;
12.4.2 Endeavouring to resolve a dispute arising out of the operation of this Agreement and/or the National Employment Standards; or
12.4.3 Participating in conciliation, arbitration or any other agreed alternative dispute resolution process.
12.4.4 The release from normal duties referred to in this clause is subject to the proviso that it does not unduly affect the operations of the Employer.
Agreement and dispute settlement facilitation. 4.3.1 For the purposes this dispute settlement procedure, where the chosen employee representative is another employee of the employer, he/she will be released from normal duties to the extent that it is reasonably necessary to enable her/him to represent the other employee.
4.3.2 The release from normal duties referred to in this clause is subject to the operational requirements of the employer.
Agreement and dispute settlement facilitation. 64.3.1 For the purposes of compliance with this Agreement (including compliance with this dispute settlement procedure) where the chosen Doctor representative is another Doctor, he/she must be released by his/her Hospital from normal duties for such periods of time as may be reasonably necessary to enable him/her to represent Doctors concerning matters pertaining to the employment relationship including but not limited to:
(a) investigating the circumstances of a dispute or an alleged breach of this Agreement or the NES;
(b) endeavouring to resolve a dispute arising out of the operation of the Agreement or the NES; or
(c) participating in conciliation, arbitration or any other agreed alternative dispute resolution process.
64.3.2 The release from normal duties referred to in this clause is subject to the proviso that it does not unduly affect the operations of the Hospital, having regard to the need to provide for the proper treatment and care of patients at all times and the availability of acceptable alternative arrangements for the carrying out of all other duties from which the Doctor seeks to be released.

For the purposes of compliance with this Agreement (including compliance with this dispute settlement procedure) where the chosen Employee representative is another Employee of the Centre management, he/she must be released by his/her Employer from normal duties for such periods of time as may be reasonably necessary to enable him/her to represent Employees concerning matters pertaining to the employment relationship including but not limited to:
(a) investigating the circumstances of a dispute or an alleged breach of this Agreement or the National Employment Standards
(b) endeavouring to resolve a dispute arising out of the operation of this Agreement or the National Employment Standards; or
(c) Participating in conciliation, arbitration or any other agreed alternative dispute resolution process. The release from normal duties referred to in this clause is subject to the proviso that it does not unduly affect the operations of the Centre management.

For the purpose of compliance with the Agreement (including compliance with this dispute settlement procedure) where the chosen employee representative is another employee of Melbourne Water, he/she must be released by Melbourne Water from normal duties for such periods of time as may be reasonably necessary to enable her/him to represent employees concerning matters pertaining to the employment relationship including but not limited to:
(a) Investigating the circumstances of a dispute or an alleged breach of this Agreement;
(b) Endeavouring to resolve a dispute arising out of the operation of the agreement; or,
(c) Participation in conciliation, arbitration or any other agreed alternative dispute resolution process. The release from normal duties referred to in this clause is subject to the proviso that it does not unduly affect the operations of Melbourne Water.

For the purposes of compliance with this Agreement (including compliance with this dispute settlement procedure) where the chosen employee representative is another employee of the employer, he/she must be released by his/her employer from normal duties for such periods of time as may be reasonably necessary to enable her/him to represent employees concerning matters pertaining to the employment relationship including but not limited to:
(a) Investigating the circumstances of a dispute or an alleged breach of this Agreement;
(b) Endeavouring to resolve a dispute arising out of the operation of the agreement; or,
(c) Participating in conciliation, arbitration or any other agreed alternative dispute resolution process.
12.7.2. The release from normal duties referred to in this clause is subject to the proviso that it does not unduly affect the operations of the employer.
12.7.3. Discussion of grievance or dispute
12.7.4. The dispute or grievance must first be discussed by the aggrieved employee(s) with the immediate supervisor of the employee(s).
12.7.5. If the matter is not settled, the employee(s) can require that the matter be discussed with another representative of the employer appointed for the purposes of this procedure.
