Amending the Certification Order. In today’s constantly changing environment it is recognized that the Employer may find need to change the out-of scope organizational structure in a responsive and timely manner. In this regard, the following process shall be followed to ensure the Certification Order of the Saskatchewan Labour Relations Board is continuously updated and remains current: a) Union Informed of Change in Structure The Employer shall inform the Union prior to any change to an out-of scope job title or when the Employer adds or deletes an out-of-scope classification. For changes to an out-of-scope job title and when an out-of-scope classification is added, the Employer shall forward the new job description to the Negotiating Unit Chairperson with copies to the SGEU Staff Representative and SAHO. b) Union Agrees Changes are Out-of-Scope Where the Employer has changed an out-of-scope job title only, or has deleted an out-of-scope classification, the Union and Employer shall submit a joint application to amend the Certification Order of the Saskatchewan Labour Relations Board. Where the Union agrees that an added classification is amended “out-of-scope”, the Union and the Employer shall submit a joint application to amend the Certification Order of the Saskatchewan Labour Relations Board once per year by Letter of Understanding. c) Union Does Not Agree That Changes are Out-Of-Scope Where the Union does not agree that an added classification or an amended classification is “out-of- scope”, and failing settlement of the matter through discussion, the Employer and the Union shall jointly refer the matter to the Saskatchewan Labour Relations Board for resolution in accordance with the Trade Union Act for joint reference of dispute.
