Common use of Annual Vacation Cancellation Clause in Contracts

Annual Vacation Cancellation. (a) The Employer will make every reasonable effort not to cancel vacation leave once it has been approved. If a Nurse's vacation is approved and then cancelled by the Employer causing the Nurse to lose a monetary deposit on vacation accommodations and/or travel and providing the Nurse does everything reasonably possible to mitigate the loss, and providing the Nurse notifies the Employer that the monetary deposit will be forfeited, the Employer will reimburse the Nurse for the monetary deposit. (b) The Employer will make every reasonable effort not to require a Nurse to return work after she/he has commenced paid vacation leave. Nurses will be recalled from vacation in the reverse order of Seniority, except where the Employer establishes the need for special skills and qualifications. (c) The Nurse returning to work from paid vacation leave, shall be paid two times (2 x) her or his regular hourly rate for each hour(s) worked during the entire period of vacation cancelled by the Employer whether the Nurse was previously scheduled to work the hour(s) or not. (d) The vacation credits shall not be reduced for the previously scheduled vacation time that was rescheduled to work. Further the Nurse shall be permitted to reschedule her or his vacation leave at a time mutually agreed between the Nurse and the Employer. (e) Where a Nurse has commenced paid vacation and is required to return to work, she or he shall be reimbursed for reasonable expenses that she or he incurs: i) in proceeding to his or her place of duty; and ii) in returning to the place from which he or she was recalled if she or he immediately resumes vacation leave upon completing the assignment for which he or she was required to work.
