Anti-Spam. Customer agrees that Customer is aware and will follow any legislation from any level of government that pertains to the Services being used. This includes complying with legislation based on where Customer is located, where recipients of any messages sent from the Service are located and where Service Provider is located. For further clarity, this includes the United States CAN-SPAM Act. Service Provider will NOT be held responsible for any breach of CAN-SPAM or any other spam legislation whatsoever whether enforced by a governing agency or any other agent or party. Customer agrees that any penalty, fine or any other discipline for breach of CAN- SPAM or any other legislation will be Customer’s sole responsibility. Customer further agrees to indemnify Service Provider from any penalty of any kind whatsoever that arise from Customer breach of CAN-SPAM or any other spam legislation. Anti-Spam. An anti-SPAM and a second anti-virus service will be run on all e-mail destined for the domain(s) of The Customer as defined in service agreement where applicable. By virtually eliminating SPAM before it is sent to The Customer, The Customer will save substantial bandwidth usage on their line(s). The Customer can choose to opt-out for this service.
Anti-Spam. SIBS does not authorize the use of its proprietary computers, servers, routers and computer network to accept, transmit, distribute unsolicited bulk email sent from the Internet to SIBS Customers (or to others). It is a violation of SIBS policy, and the law, to send or cause to be sent to, or through, the SIBS network email that makes use of or contains invalid or forged headers, invalid or non-existent domain names or other means of deceptive addressing. SIBS considers such email to be unlawful and a violation of SIBS policy, and any attempt to send or cause such email to be sent to, or through, the SIBS network is unauthorized. Moreover, any email relayed from a third party’s mail servers without the permission of that third party, or any email that hides or obscures, or attempts to hide or obscure, the source of an email constitutes an unauthorized use of the SIBS network. SIBS does not authorize the harvesting or collection of screen names from the Service for the purpose of sending unsolicited email. Unauthorized use of the Services in connection with the transmission of unsolicited email, including the transmission of email in violation of this policy, may result in civil, criminal or administrative penalties against the sender and those assisting the sender.
Anti-Spam. Except as disclosed in Section 3.1(48) of the Company Disclosure Letter, or as otherwise not reasonably be expected to have a Material Adverse Effect, each of the Company and its Subsidiaries: (i) is in compliance with applicable Anti-Spam Laws, (ii) has a valid express consent, that complies, in all material respects, with the consent requirements under applicable Anti-Spam Laws, to install or cause to be installed any computer program on another person’s computer system (including cookies, pixels, and similar tools), and (iii) has an express or implied consent that complies with the consent requirements under applicable Anti-Spam Laws, or is otherwise permitted under applicable Anti-Spam Laws, to send Commercial Electronic Messages to each Electronic Address in its marketing and advertising database, including to customers, prior customers, prospective customers, end users of Company Platforms and other third party contactors, in the manner it does in the conduct of its business as currently conducted.
