Customer Responsibilities and Restrictions. (a) Customer will (i) maintain the confidentiality of all authentications and passwords for the Subscription Services and immediately notify BMC if it becomes aware that an unauthorized party has gained access such authentications and passwords, (ii) be responsible for use of the Subscription Services by its Users in compliance with this Agreement, (iii) prevent unauthorized access to, or use of, the Subscription Services, and notify BMC promptly of any such unauthorized access or use, (iv) comply with all applicable laws in using the Subscription Services, and (v) be responsible for obtaining its own Apple Push Notification certificate, if the Subscription Services are used to manage devices running iOS. Customer is responsible for the creation and implementation of a privacy policy and end user agreement, if applicable, which will set forth the guidelines of how Customer uses and protects the data and personal information of its Users, and how said Users may utilize the Subscription Services. (b) Customer will not (i) modify, copy or create derivative works based on the Subscription Services; (ii) create Internet “links” to or reproduce any content forming part of the Subscription Services, other than for its own internal business purposes; (iii) disassemble, reverse engineer, or decompile the Subscription Services or part thereof; (iv) interfere with or disrupt the integrity or performance of the Subscription Services; (vi) send or store infringing, obscene, threatening, libelous, or otherwise unlawful or tortuous material, or send or store material in violation of any third party’s privacy rights via the Subscription Services; (vii) send or store viruses or malicious code via the Subscription Services; (viii) attempt to gain unauthorized access to the Subscription Services or its related software, systems, platforms or networks, including any form of security and/or penetration testing; (ix) use any components provided with the Subscription Services separately from the Subscription Services; or (x) distribute, rent, lease or provide the Subscription Services to any third party or use it in a service bureau, outsourcing environment, or for the processing of third party data.

Customer Responsibilities and Restrictions. 3.1. Customer Responsibilities. Customer is responsible for all activities conducted by it or through the accounts of its Users on the SaaS Services. Except for SailPoint’s obligations described in Section 8 (Confidentiality) and Section 9 (Data Security), Customer shall (i) have sole responsibility for the accuracy, security quality, and legality of the Customer Data and the means by which Customer acquired the Customer Data and the right to provide the Customer Data for the purposes of this SaaS Agreement (including ensuring the receipt of all permissions from individuals and other third parties as may be necessary in order to provide the Customer Data for the purposes contemplated in this SaaS Agreement); (ii) be responsible for the security and confidentiality of Customer’s and its Users’ account information; (iii) be responsible for maintaining a back-up of all Customer Data; and (iv) prevent unauthorized access to, or use of, the Services, and notify SailPoint promptly of any such unauthorized access or use.

As between the Parties, Customer will be solely responsible for: (a) Customer’s Environment, including as necessary to enable Authorized Usersaccess and use of the Services; (b) Account Data, Customer Data and Customer Credentials (including activities conducted with Customer Credentials), subject to Datadog’s Processing obligations under this XXXX; (c) providing any required notices to, and receiving any required consents and authorizations from, Customer Component providers, Authorized Users and persons whose Personal Information may be included in Account Data, Customer Data or Customer Credentials; and (d) ensuring use of the Services is only for Customer’s Environment and in accordance with the AUP, Documentation and applicable Third-Party Terms. 7.2. No provision of this XXXX includes the right to, and Customer shall not, directly or indirectly: (a) enable any person or entity other than Authorized Users to access and use the Services; (b) attempt to gain unauthorized access to any Service or its related systems or networks; (c) use any Service to access Datadog Intellectual Property Rights except as permitted under this XXXX; (d) modify, copy or create any derivative work based upon a Service or any portion, feature or function of a Service; (e) resell, distribute or otherwise make available any Service to any third party, including as part of a managed services offering; (f) except to the extent limited by Applicable Law, reverse engineer, disassemble or decompile all or any portion of, or attempt to discover or recreate the source code for, the Services or access or use the Services or Documentation in order to (1) copy ideas, features, functions or graphics, (2) develop competing products or services, or
Customer Responsibilities and Restrictions. (a) Passwords and Unauthorized Access. Customer is responsible for maintaining the confidentiality of the passwords assigned to Customer. Customer will immediately notify APTO if it becomes aware that a password is lost, stolen, disclosed to an unauthorized third party, or otherwise compromised. Customer will be responsible for any and all activities made under Customer’s User Licenses, including without limitation any fees incurred under Customer’s password-protected account. Customer shall (i) use commercially reasonable efforts to prevent unauthorized access to, or use of, the Subscription Services, and notify APTO promptly of any such unauthorized access or use, and (ii) comply with all applicable laws in using the Services.

You are responsible to ensure that the Data you provide in your User Account and Declaration Form is complete and accurate. You agree that you would update us as and when your details change. 3.2 You are to keep your login information including your Data and password safe and to take all reasonable steps to ensure nobody other than yourself can access your account and the Services. All email, personal information or contact information which you are to provide shall be valid and updated. 3.3 You agree that you have the authority to, and are of legal age to, enter into this Agreement. 3.4 You are to ensure that your items are packed safely so that your items can be transported and stored without damage. 3.5 You are not to sub-license or re-sell any of the Services that we offer without our prior written consent.

Customer Responsibilities and Restrictions. (a) Customer agrees that it shall not: (i) modify, make derivative works of, disassemble, reverse compile, or reverse engineer any part of the Services, or in any way attempt to reconstruct or discover any source code or underlying ideas or algorithms of any part of the Services; (ii) access or use the Services in order to build a similar or competitive product or service or for the purposes of bringing an intellectual property infringement claim against Parse; (iii) except as expressly stated herein, copy, reproduce, distribute, republish, download, display, post or transmit in any form or by any means any of the Services; and (iv) attempt to gain unauthorized access to the Services and to make commercially reasonable efforts to prevent unauthorized third parties from accessing the Services. (b) Customer shall not (i) access or attempt to access the administrative interface of the Services by any means other than through the interface that is provided by Parse in connection with the Services, unless otherwise agreed in writing or (ii) intentionally engage in any activity that interferes with or disrupts the Services (or any servers or networks that are connected to the Services). (c) Customer is responsible for all activity occurring under Customers’ accounts for the Services by its Users. Customer shall notify Parse within a commercially reasonable time of any unauthorized use of any user account or any unauthorized use of the Services. Customer may not develop multiple Applications to simulate or act as a single Application or otherwise access the Parse Services in a manner intended to avoid incurring fees. (d) Open source software licenses for components of the Services released under an open source license constitute separate written agreements. To the limited extent that the open source software licenses expressly supersede the terms of this Agreement, the open source licenses govern your agreement with Parse for the use of the components of the Services released under an open source license.
