ANTICIPATORY ACTIONS. In accordance with § 110(k) of the NHPA, FEMA or HUD/ GOSR shall not grant assistance to a Sub-grantee who, with intent to avoid the requirements of this Agreement or § 106 of the NHPA, has intentionally, significantly, and adversely affected a historic property to which the assistance would relate, or having legal power to prevent it, allowed an adverse effect to occur. However, FEMA or HUD/ GOSR may, after consultation with the ACHP, determine that extraordinary circumstances justify granting such assistance despite the adverse effect created or permitted by the Sub-grantee, FEMA or HUD/GOSR shall complete consultation for the Undertaking pursuant to Sitpulation III.D. of the Statewide Programmatic Agreement.
ANTICIPATORY ACTIONS. A. MDA shall provide written information to applicants to notify them about the potential for adverse effects related to anticipatory demolition of historic properties and how such actions may jeopardize their application. Additional information will also be presented to applicants during the application process, when visiting MDA regional application centers.
ANTICIPATORY ACTIONS. A. Holy Cross shall not initiate demolition, ground-disturbing activities, or construction within the 25-50 foot perimeter (depicted as a dashed line) around the Church as shown in Appendix C, prior to compliance with the Pre-Demolition Treatment Measures specified in this Agreement. Demolition, ground-disturbance or construction within the perimeter may jeopardize FEMA funding if such activities are initiated beyond the design phase and prior to compliance with the Pre-Demolition Treatment Measures specified in this Agreement.

If mitigating measures are identified by FEMA, after consulting with ACHP, FEMA may determine that circumstances justify granting such assistance despite the adverse effect created or permitted by IDNR In such cases, FEMA will complete consultation for the Undertaking pursuant to 36 C.F.R. § 800.9(c)(2).
ANTICIPATORY ACTIONS. A. FEMA shall not grant assistance to the Applicant should it, or those acting on its behalf, engage in anticipatory actions with the intent to avoid the requirements of this MOA or Section 106 of NHPA that significantly adversely effects an historic property to which the assistance would relate or, having legal power to prevent it, allow such significant adverse effect to occur.

If mitigating measures are determined by FEMA, and after consulting with ACHP, FEMA may determine that circumstances justify granting such assistance despite the adverse effect created or permitted by the applicant, and will complete consultation for the Undertaking pursuant to Stipulation IX.

After consulting with the SHPO and Council, FEMA may determine that circumstances justify granting such assistance despite the adverse effect created or permitted by the applicant, and will complete consultation for the Undertaking pursuant to Stipulation VII.

FEMA shall not grant assistance to the City should it, or those acting on its behalf, engage in anticipatory actions with the intent to avoid the requirements of this MOA or any requirements of the NHPA, significantly adversely affecting a historic property to which the assistance would relate or, having legal power to prevent it, allow such significant adverse effect to occur.
ANTICIPATORY ACTIONS. 1. FEMA shall not grant assistance to a Subgrantee who, with intent to avoid the requirements of this Agreement, Section 106, or 36 C.F.R. Part 800, has intentionally caused a significant adverse effect to a historic property to which the assistance would relate, or having legal authority to prevent it, allowed such significant adverse effect to occur. However, after consulting with the SHPO, FEMA may determine that circumstances justify granting such assistance despite the adverse effect created or permitted by the Subgrantee, and will complete consultation for the Undertaking pursuant to Stipulation III.C.6.

In such cases, FEMA will complete consultation for the Undertaking pursuant to 36 CFR 800.9(c)(2).
