Approval of Services. The Authority reserves the right to approve decorators, contractors or other service people or agencies employed or engaged by the Customer, who must complete a Third Party Provider Agreement before working in the Center and provide evidence of insurance in certain instances.
Approval of Services. All decorators, contractors or other service people or agencies employed or engaged by the Customer shall be subject to approval by the Authority and must complete a Third Party Provider Agreement before working in the Center, which applies to services provided in the Center, including compliance with applicable rules and regulations and requires evidence of insurance in certain instances.
Approval of Services. In the event that NSMY disputes the amount of any invoice or the amount of services provided, or has any disputes or complaints concerning the Management and Consulting Services provided by NSIMG (such as any failure to perform such services in accordance with this Agreement), NSMY shall provide written notice of such dispute or complaint within sixty (60) days of the date of the invoice for such services. If NSMY fails to provide such written notice with such sixty (60) day period, it shall be deemed to have:
(a) accepted the performance of the services in full and confirmed all of such services were performed in accordance with the requirements of any specific agreement therefor established pursuant to Clause 2.1 and also of this Agreement, including any warranty set forth herein,
(b) accepted the accuracy of such invoice and the validity of all charges on such invoice, and
(c) waived any claim relating to such Management and Consulting Services.
Approval of Services. NSUSA hereby agrees that, by accepting and paying invoices as provided in Article 3 herein, NSUSA will be deemed to have approved the nature and extent of the Management and Consulting Services so invoiced.
Approval of Services. MCM Business Awardee shall deliver the Engagement Agreement between the MCM Business Awardee and the MCM TA Provider governing the proposed scope of Services to the EDC for approval. Execution of this Agreement will serve as notice to proceed with the scope of Services and the Engagement Agreement and is a pre-condition for payment by the EDC hereunder.
Approval of Services. NSPCT hereby agrees that, by accepting and paying invoices as provided in Article 3 herein, NSPCT will be deemed to have approved the nature and extent the Management and Consulting Services so invoiced.
Approval of Services. 14.1 The Services will be deemed to be completed upon receipt by the Main Contractor of a written notification of completion from the Service Provider and the subsequent inspection and acceptance of the Services by the Main Contractor. The Main Contractor is entitled to provisionally or conditionally accept the Service Provider's performance, stating the conditions that must still be fulfilled before the Services can be definitively accepted.
14.2 The approval of the Services must always be given explicitly. Under no circumstances, a tacit approval can be derived, neither from the payment of the invoices of the Service Provider, nor from the lack of complaints during a certain period of time.
14.3 An approval given by the Main Contractor – whether provisional or final – does not release the Service Provider from its obligations under this Agreement.
14.4 Regardless of any approval, the Main Contractor remains fully entitled to any claim and any right or remedy in respect of any default, non-performance, incomplete performance, delay in performance and/or defective performance of the Services, regardless of whether or not the Main Contractor could have discovered the default or use before or upon approval of the Services.
Approval of Services. NSJ hereby agrees that, by accepting and paying invoices as provided in Article 3 herein, NSJ will be deemed to have approved the nature and extent the Management and Consulting Services so invoiced.
Approval of Services. Before Company commercially launches any Service via the Company Connection or prior to modifying any Service that has already been approved, Company will submit each such Service for review and approval through the Gateway Program web site or any other method reasonably requested by T-Mobile. T-Mobile may, in its sole discretion, reject any or all Services submitted for approval. Company will not make any changes to a Service that has already been approved by T-Mobile without obtaining prior approval from T-Mobile.
Approval of Services. The DISTRICT's approval of services or materials furnished hereunder shall not in any way relieve CONSULTANT of responsibility for the technical adequacy of its work. Neither the DISTRICT's review, approval or acceptance of, nor payment for any of the services shall be construed to operate as a waiver of any rights under this Agreement or of any cause of action arising out of the performance of this Agreement. Where approval by the DISTRICT is indicated in this Agreement, it is understood to be conceptual approval only and does not relieve the CONSULTANT of responsibility for complying with all laws, codes, industry standards, and liability for damages caused by negligent acts, errors, omissions, noncompliance with industry standards, or the willful misconduct of the CONSULTANT or its subconsultants. CONSULTANT’s obligation to defend, indemnify, and hold harmless the DISTRICT, and its directors, officers, employees and agents as set forth in Section 6.9 of this Agreement also applies to the actions or omissions of the CONSULTANT or its subconsultants as set forth above in this paragraph.
