Association Dues Deduction. A. As unit members individually and voluntarily authorize the Board of Education of Xxxxxxxxxx County, the Board agrees to withhold organizational dues and other deductions mutually agreed upon with the Association from the unit members' wages and to transmit such funds to the Association. The Board will include the name; the school, office, or department where the unit member is located; and the amount of each deduction with the transmittal of funds. B. Dues or representation fee will be deducted in equal payments during the terms of this Agreement beginning on the first full pay period following the receipt by the Employee and Retiree Service Center of the notice from the Association of the individually signed authorizations. This deduction will remain in effect for the term of this Agreement or until the deduction is canceled or revised in writing by the employee to the Association. The Association shall notify the Employee and Retiree Service Center on or before September 30 of any school year. For a full year, dues will be deducted over twenty (20) pay periods. C. The Association shall indemnify and save the Board harmless against any and all claims, demands, suits, or any other forms of liability that shall rise out of or by reason of action taken or not taken by the Board for the purposes of complying with any list, notice, form, card, or assignment furnished under any such provisions.

The Association shall assume the primary defense of any such claim or lawsuit but the Board shall have the right, at its own cost, to have representatives or legal counsel present at all stages of the proceedings. In assuming the primary defense on the Board’s behalf, the Association will hire and compensate legal counsel. Legal counsel hired by the Association shall confer with the Board or its representatives concerning the defense of claims and lawsuits against the Board. In addition to the costs of legal defense, such indemnification shall extend to payment of all reasonable and necessary expenses of the Board (including, by way of example and not limitation, salary of an administrator for required Court appearance, costs of necessary copies, and any and all claims, demands, suits, or any other forms payment required in favor of liability that shall rise out of or by reason of action taken or not taken the claimant). Those expenses incurred by the Board at its discretion to have its own representatives or legal counsel present at any stage of the proceeding and similar discretionary expenses shall not be the responsibility of the Association. Association Dues Deduction.
A. As The District agrees to deduct an amount equal to one tenth (1/10) of the dues of the Association, including the OEA and NEA dues each month for ten (10) consecutive months from the pay of each teach who is a member of. the Association, beginning with the paycheck for the month of October. Prior to the first dues deduction of the school year, and then for any employee who becomes a member of the Association after the start of the school year, the Association shall notify the District of bargaining unit members individually who have elected to have dues deducted from their paychecks and voluntarily authorize shall identify the Board of Education of Xxxxxxxxxx Countydues to be deducted from each. In addition, the Board agrees Association shall provide a formal letter from the OEA Membership Department that confirms that OEA possesses sufficient documentation of dues deduction authorization for those members. Upon request by the District, the Association shall make available to withhold organizational the District for review the documented proof of dues and other deductions mutually agreed upon deduction authorization for employees. The Association shall also notify the District when a bargaining unit member should no longer have dues deducted. This notification will also include written proof of authorization by the employee. The District shall enact dues deduction changes on the pay period following a written notification.
