ASSOCIATION RIGHTS. A. Duly authorized representatives of the Association shall be permitted to meet with employees, subject to the following: 1. The representative(s) shall check in and out at the work location upon arrival and departure. 2. Visits with employees at their work location shall not be permitted during student contact time or during a period of assigned duty. Visits with individual teachers shall not require prior notice. 3. The administrator will facilitate the visit by assigning a reasonable location for the Association representative to confer with employees. The location should provide a reasonable degree of privacy so that the union and employee(s) may speak confidentially. Further, when reasonably possible such location should not be adjacent to the administration offices. 4. Upon request, the representative(s) shall have his/her presence announced by the posting of a notice and/or over the intercom system, outside the student day. Such announcement shall include the location and time of the visit, and may be made by either the administrator or the site Association representative. 5. The Association, with the administrator’s consent, shall be permitted to use a work location’s facilities for holding meetings which include employees from other work locations, provided such meetings are held outside the employee duty day and the Association bears the actual cost of such meetings at the lowest cost category. 6. At the beginning of each school year, the Association will be provided a mutually agreeable time on the agenda during the district-wide orientation to speak to new employees. 7. If new employee orientation(s) are held during the school year, the Association will be notified at least two (2) weeks prior to the opening session(s) of the orientation(s). Subsequently, the District will receive notification from the Association one (1) week prior with their intent to attend the orientation session. The CTA President/designee will be given the same opportunity to speak to new employees as at the district- wide orientation. B. Site Association Representatives 1. Upon conclusion of any faculty meeting, the site Association Representative shall be given the opportunity to make announcements relating to Association business. Continued attendance by employees shall be voluntary. Once a month the site Association Representative(s) shall be given the opportunity to hold a meeting during non-student contact time of all instructional personnel at a school site to make announcements relating to Association business. Attendance by employees shall be voluntary. The site Association Representative(s) shall be given an opportunity to send an Association-approved email message related to Association business to all instructional personnel at a school site. 2. The site Association Representative may use the work location’s facilities for the purpose of conducting professional meetings during non-student contact times. Such meetings shall be arranged in advance with the administrator and shall not be unreasonably denied. 3. When the site Association Representatives are either involuntary transferred, or have grade/subject assignment changes and room changes on the work location’s campus, the transfer or changes, shall be reviewed by the CTA President and the Superintendent or their designee. The site Association representative must request such a review in writing, and submit the request to the Association within ten (10) days of the transfer or change. 4. The Association will provide each site administrator the name of the CTA Association Representative at his/her school within six weeks of the beginning of each school year. Notification will be given of any changes throughout the year. 5. The Association shall provide and maintain a current list of site Associations Representatives and provide such a list and updates to the Human Resources Department designee(s). 6. The site Association Representative and the Administrator may meet monthly to discuss implementation of the contract and issued within the work location. C. When a PERC sanctioned representation challenge occurs, the challenging organization shall be granted no greater access rights than the Association.

No other teacher union shall be given this right. F. Association representatives may meet with employees during the workday, providing the visit does not interfere with class instruction. G. The Association shall be granted, at no cost, the right to use the district’s facilities for holding meetings which include employees from other work locations, provided such meetings are held outside the employee duty day and the to conduct Association bears the actual cost of such meetings business at the lowest cost categoryreasonable times. 6. The Association shall have the right of review at all reasonable times any 26 material in the possession of the District to the extent permissible under 27 applicable law and to the extent such material is necessary to the 28 Association’s negotiation and administration of this Agreement, provided, 1 however, that such material is reasonably obtainable, not confidential in 2 nature, and does not consist of a work product prepared for negotiations or 3 for contract administration. 4 a. The District will furnish the Association with a complete agenda for 5 each regular meeting of the Board of Education, excluding executive 6 sessions, Xxxxx Act sessions, and personnel items. Agendas will be 7 furnished as soon as possible prior to regular Board meetings. 8 7. The Association may designate a site representative at each school and/or 9 department of work and shall provide and maintain the District with a current list of site Associations Representatives such 10 representation. 11 8. Grievance Representative shall be given reasonable release time to assist 12 in the investigation and processing grievances, including reasonable 13 access to employees connected therewith and to provide such Contract related 14 information to employees. 15 9. The Association President or designee shall receive a list and updates total release time 16 equivalent to sixteen (16) hours per week. 17 a. Additional release time up to eight (8) hours per week will be provided 18 to other employees selected by the Association President. ASSOCIATION RIGHTS. A. Duly authorized representatives Names, addresses, telephone numbers, dates of hire, position and building assignment of newly-hired support staff members will be provided to the Association President, which may include electronic methods of communication, within 5 working days of the Board meeting at which the Employees were hired. B. The Association shall also have the right to hold its general membership meetings on school district property provided such meetings in no way interfere with any aspect of the instructional or extracurricular programs, and provided that such meetings entail no additional maintenance or custodial expenses, and that the facilities are available. When such meetings entail additional maintenance or custodial expenses, the Board may make a reasonable charge for such expense. The Association shall contact the Superintendent or building principal regarding the availability of the desired school district facility and make advance reservations for such prior to scheduling any meeting which is to be held on school district property. C. The President of the Association or his/her designee shall be permitted given notice of any regular meeting of the Board held other than as normally scheduled and of any special meeting. Non-confidential items in the Board Packet will be emailed to D. The Board shall receive Association recommendations for amendment of Board policy and for its fiscal programs. Upon the request of the Superintendent, Association representatives will make themselves available to elaborate upon such proposals. E. The Board shall provide the Association, upon request, with regularly prepared information germane to matters within the scope of negotiations. This shall include, but not necessarily be limited to, the current annual financial audit, tentative budget, adopted budget, monthly payment of bills report, the monthly financial report, and monthly investment report. F. The Association may use District mailboxes and email for the purpose of informing members of dates, times, location and contact people for events and meetings. G. The Association may use a designated bulletin board in each building for the purpose of informing members of dates, times, location and contact people for events and meetings. H. Neither the Board nor the Association shall discriminate against any Employee by reason of his membership or lack thereof in the Association, his participation or lack thereof in any activities of the Association or in negotiations with the Board, or his institution of or refusal to institute any grievance or proceeding under this agreement. Any Employee who is summoned or requested to attend a meeting with Administration, that is investigatory in nature and which the Employee reasonably believes may result in discipline, shall be afforded union representation. I. The Board shall place on the agenda of each regular Board meeting for consideration under “Communications” any matters brought to its attention by the Association so long as these matters are made known in writing to the Superintendent at least five (5) business days prior to the regular meeting. If requested by the Superintendent, Association representatives will meet with him promptly to review and discuss such matters. The Superintendent and Association representatives may meet on a mutually agreed upon date each J. The Superintendent or his/her designee shall receive and consider input from the Association prior to final approval of the school calendar. K. In the event the Association desires to send a representative(s) to conferences, conventions or other meetings, the representative(s) may be excused without loss of salary, provided that the frequency of excused leave shall not impair the District’s operations. A written request for such leave shall be submitted to the Superintendent by the President of the Association for his/her approval. The granting or denial of such request shall not establish a practice or precedence. Association leave will not exceed eight (8) days per school year, two (2) of which may only be used when students are not in attendance, with the Association reimbursing the District for the cost of any substitutes that might be used. L. When any Employee is required to appear before the Board or before any Board committee concerning any matter which could directly affect the continuation of that Employee in his/her employment, the Employee shall be given reasonable prior written notice of the reasons for such meeting or interview and shall be entitled to have a representative of the Association present to represent him/her during such meeting or interview. When any Employee is required to meet with employeesthe Superintendent or a principal for an investigatory interview the Employee reasonably believes may result in discipline, the Employee may have a representative present at such meeting. M. One official personnel file shall be kept for each Employee. Each Employee shall have the right, upon request, to review the contents of his/her own official district personnel file. Such review shall be during normal office business hours, but not including the hours students are scheduled to be in the schools, and in the presence of a designated Employee of the Board. A representative of the Association may, at the Employee’s request, accompany the Employee in this review. The Employee shall have opportunity to place a written response to the material in this file, if such shall be submitted within twenty-five (25) employment days of the date the material was first shown to the Employee. No Employee shall remove any material from the official district personnel file. Confidential material, such as recommendations by colleges, or universities, or evaluations of an Employee by previous employers, shall not be subject to review by the followingEmployee. The Association will provide each site administrator the name of the CTA Association Representative at his/her school within six weeks of the beginning of each school year. Notification will be given of any changes throughout the year. 5. The Association shall provide and maintain a current list of site Associations Representatives and provide such a list and updates to the Human Resources Department designee(s). 6. The site Association Representative and the Administrator may meet monthly to discuss implementation of the contract and issued within the work location. C. When a PERC sanctioned representation challenge occurs, the challenging organization shall be granted no greater access rights than the Association.
