ASSOCIATION RIGHTS. On or before September 1 A. The Association and its representatives will be allowed to use District buildings for meetings when rooms are available and scheduled with the building principal for the purpose of transacting Association business.
B. The Association will be allowed to use District facilities and equipment including computers with internet access, copy equipment, calculating machines and all types of audiovisual equipment at reasonable times when such equipment is not otherwise in use. All consumable items used will be paid for by the Association. The Association agrees to repair any equipment damaged as a result of its use. E. Upon request the District shall provide to the Association information as required under the statute which will assist the Association in carrying out its responsibility as the bargaining representative.
F. The Association and its representatives will have access to all employees during times which will not interrupt instruction. Representatives duly authorized by the Association who participate during working hours in negotiations, grievance proceedings, or meetings with representatives of the District, shall suffer no loss of pay. G. The association shall be afforded a one (1) hour block of time during the Union President workday to meet with new employees as a group on the names and addresses new employee orientation day, prior to the first student instruction day.

A member may cancel their membership outside of the aforementioned cancellation period but shall be responsible for all remaining dues and assessments of the current membership year and by such cancellation acknowledges that he/she is foregoing any rights specifically reserved to members of the Association.
I. The Board will include all new Bargaining Unit Members in new staff orientation at the beginning of the school year. Bargaining Unit Members who are hired after the start of the school year will receive orientation within 21 days of the first work day. New Bargaining Unit Members shall be paid his/her hourly rate of pay for all time spent in an orientation that is held outside the member’s contract day and/or year.
J. The Board shall provide written notice, to the Association president and vice-president, of the date, time, and location of all staff orientations not less than ten (10) calendar days prior to any orientation meeting.

ASSOCIATION RIGHTS. On 3.1 The Association may use District facilities upon notification. The Association agrees to comply with reasonable District rules and regulations governing use of school facilities. Association representatives conducting organization business shall, upon arriving at a site, report initially to the office of the principal to announce their presence and purpose. Such visits shall be scheduled only during the employee’s duty free lunch period or before September 1 non-duty hours. The Association shall ensure that the District has a current list of authorized Association representatives.

3.4 Authorized representatives of the Association shall be permitted to transact Association business on their non-duty time, as long as it does not interfere with the instructional program.
3.5 The District shall provide an up-to-date directory including unit members’ addresses, phone numbers, and e-mail addresses, which will be accorded available on the following privileges:District website by the first week of October.

ASSOCIATION RIGHTS. On or before September 1 Section 1. Attainment of each educational objectives of the District requires mutual understanding and cooperation between the Board, the Administrative and Supervisory Staff and the Professional Teaching Personnel. To this end, free and open exchange of views is desirable and necessary, with all parties in deliberation leading to the determination of matters of mutual concern.
Section 2. The Association and its representatives shall have the right to use school yearbuildings for meetings outside of school hours provided that when special custodial service is required, the Board will provide may make a reasonable charge if a custodian is needed.

Employees shall have the right to examine, in the presence of the person responsible for the files, the contents of their personnel file in their building and the central office except for those documents that are exempt by law. Copies of the contents of the file which are not required to bargain on subjects reserved restricted may be made available to the management and direction employee subject to a fee schedule.
Section 10. An employee shall examine all material of an evaluative nature to be placed in their personnel file prior to its inclusion in the file. Article II: Association Rights (cont'd.)
Section 11. The Association shall have the use of the governmental unit except as affect institutional bulletin boards, mailboxes and other communication media.
Section 12. Employees shall have the right to organize, join and assist the Association and to participate in professional negotiations with the Board. The Board shall not discriminate against any employee with respect to hours, wages, hours, terms and conditions of employmentemployment for reason of membership in the Association, participation in negotiations with the Board, or the institution of any grievance, complaint or proceeding under this Agreement.
Section 13. Within thirty (30) days of ratification of the Agreement, the Board shall have sufficient copies of the Agreement prepared and delivered to the Association for its distribution to each employee in the bargaining unit.
Section 14. In an attempt to keep the Association informed, an agenda of all regular and special meetings of the Board will be provided to the Association President(s) prior to the meeting, along with minutes of the preceding meeting.
Section 15. The Board shall not issue individual employee salary statements during negotiations before agreement has been reached between the Board and the Association. However, the Board may issue individual contracts to new employees.
Section 16. In the development of the operating procedures, we recognize the value and desirability of employee involvement and encourage their recommendations.
Section 17. The Association Board of Directors shall meet at regular monthly intervals with the Superintendent of Schools to discuss matters of common concern. These matters may include, but are not limited to
(1) practices that affect the welfare of pupils and/or employees, (2) alleged injustices that may develop because of the lack of Board or administrative policy, (3) the professional conduct of staff, and (4) matters that reflect on the continuation, modification, School District and/or the teaching profession.
Section 18. The teaching staff shall be informed of any new program or deletion project for utilization of an existing provision special state or federal funds and the views of the Association shall be considered by the administration and Board of Education.
Section 19. Any teacher who is a member of the Association shall be granted payroll deduction of dues upon receipt of a collective bargaining agreementsigned dues deduction request form. A public employee or exclusive representative may raise a legitimate complaint or file a grievance based on the collective bargaining agreement.
E. The union Executed dues deduction request forms shall be permitted during furnished to the fall and winter Business Manager prior to the first of each school the month in which the deduction goes into effect. ASSOCIATION RIGHTS. On or 2.1 Upon prior arrangement with the site-based administrator, Association members may hold meetings before September 1 of each and after regular duty hours on school yearproperty.
2.2 After reaching an understanding with the principal, the Association shall be permitted to use, at no cost to the District, computers and copiers after school hours on workdays before the building is closed and the work area is still open. Association Representatives may use the district email system to communicate information to members during break time, lunch, before and after school hours.
2.3 The Association shall be permitted to post notices of activities and the matters of Association concern on an appropriate and specifically assigned bulletin board in each school/worksite. In schools or worksites where bulletin boards do not exist, the Association will be responsible for purchasing such a board for posting Association notices and this should be in a place readily accessible to employees. The Association may use employee mailboxes for communications to employees. The principal or worksite supervisor shall receive copies of all materials before them being posted or placed in mailboxes. Any material that disrupts the normal functioning of school activities or is libelous shall not be posted or placed in mailboxes.
2.4 The Board will provide agrees to furnish to the Union President Association in response to reasonable requests, as available through the Superintendent’s office at the expense of the Association, information concerning financial resources and conditions of the school district, as found in the official Board minutes and in accordance with Board policies.
2.5 The Association shall be placed on the agenda of any regular Board meeting in accordance with the names and addresses provisions of bargaining unit membersthe Administrative Procedures Act. Upon requestThe Association shall receive notification at least two (2) days before regular or special Board meetings.
2.6 The School Board shall make all materials available to the public, including the Association, related to the Board will provide agenda at the Union President same time material is made available to Board members via the Xxxxxx County School District website.
2.7 Any employee may request that Association membership dues be deducted from his/her pay. Such deduction may be initiated only after proper receipt of a Continuing Membership Authorization. Such authorization shall continue in effect from year to year thereafter, unless revoked in writing between August 15 to September 15 and April 15 to May 15 of any year. Any employee revoking dues deduction must complete a dues revocation form, obtain the signature of the WCEA president or his/her designated representatives, and deliver the completed form to the Board. All dues deducted by the Board shall be remitted monthly to the Association as deducted. The Association shall indemnify and save harmless the Board from any and all claims, demands, suits, and costs incurred from any action taken or omitted by the Board for the purpose of complying with the names and addressesprovisions of this section. The Board is expressly prohibited from any involvement in the collection of fines, job classificationpenalties, and building assignment or special assessment on behalf of newly-hired bargaining unit membersthe Association. The Association will notify the payroll clerk in writing on or before August 15 each school year stating the annual amount of dues to be accorded deducted. If such notification is not received, the following privileges:amount to be deducted will be the same as the previous school year
A. Use 2.8 The Association may make written recommendations concerning payroll deduction programs to the Superintendent and/or his designee for study and recommendation(s) to the Board.
2.9 Duly authorized representatives of designated bulletin boards, including head custodial rooms, kitchen and main bulletin boards, for posting non-political notices of the Association may be permitted to transact official Association business on school property, provided they make themselves known to the supervisor or designee before their conference with any employee. It is understood that no Association views on matters relating to administration-employee or Board- Association relationship will be discussed in the presence of students. The supervisor may discontinue the Association activities if it is interfering with school activities or supervisor assigned duties.
2.10 A WCSP site representative shall be given an opportunity at the conclusion of each building staff meeting to present brief reports and announcements.
2.11 The Association shall be permitted to make brief announcements over the intercom before or after student contact hours with the location permission of the principal.
2.12 Employees who are elected delegates to the state affiliate convention may use personal leave for personal reasons charged against sick leave. Leave forms must be submitted to each affected building principal at least five (5) workdays before the absence. In the event an elected delegate cannot attend due to unforeseen conditions, the Superintendent may make exceptions to the time limit stated herein.
2.13 The right to arbitrate grievances shall be granted to the Association exclusively as the sole and space designated by exclusive bargaining agent and shall not be granted to any other employee or professional organization except as provided for in F.S. 447.307.

ASSOCIATION RIGHTS. On or 2.1 Upon prior arrangement with the site-based administrator, Association members may hold meetings before September 1 of each and after regular duty hours on school yearproperty.
2.2 After reaching an understanding with the principal, the Association shall be permitted to use, at no cost to the District, computers and copiers after school hours on workdays before the building is closed and the work area is still open. Association Representatives may use the district email system to communicate information to members during break time, lunch, before and after school hours.
2.3 The Association shall be permitted to post notices of activities and the matters of Association concern on an appropriate and specifically assigned bulletin board in each school/worksite. In schools or worksites where bulletin boards do not exist, the Association will be responsible for purchasing such a board for posting Association notices and this should be in a place readily accessible to employees. The Association may use employee mailboxes for communications to employees. The principal or worksite supervisor shall receive copies of all materials before them being posted or placed in mailboxes. Any material that disrupts the normal functioning of school activities or is libelous shall not be posted or placed in mailboxes.

2.7 Any employee may request that Association membership dues be deducted from his/her pay. Such deduction may be initiated only after proper receipt of a Continuing Membership Authorization. Any employee revoking dues deduction must complete a dues revocation form, obtain the signature of the WCEA president or his/her designated representatives, and deliver the completed form to the Board. All dues deducted by the Board shall be remitted monthly to the Association as deducted. The Association shall indemnify and save harmless the Board from any and all claims, demands, suits, and costs incurred from any action taken or omitted by the Board for the purpose of complying with the names and addressesprovisions of this section. 2.9 Duly authorized representatives of designated bulletin boards, including head custodial rooms, kitchen and main bulletin boards, for posting non-political notices of the Association may be permitted to transact official Association business on school property, provided they make themselves known to the supervisor or designee before their conference with any employee. It is understood that no Association views on matters relating to administration-employee or Board- Association relationship will be discussed in the presence of students. 2.10 A WCSP site representative shall be given an opportunity at the conclusion of each building staff meeting to present brief reports and announcements.
2.11 The Association shall be permitted to make brief announcements over the intercom before or after student contact hours with the location permission of the principal.
2.12 Employees who are elected delegates to the state affiliate convention may use personal leave for personal reasons charged against sick leave. Leave forms must be submitted to each affected building principal at least five (5) workdays before the absence. In the event an elected delegate cannot attend due to unforeseen conditions, the Superintendent may make exceptions to the time limit stated herein.
2.13 The right to arbitrate grievances shall be granted to the Association exclusively as the sole and space designated by exclusive bargaining agent and shall not be granted to any other employee or professional organization except as provided for in F.S. 447.307.

The Association shall have the right to use the inter-building mail facilities DQG PDLOER[HV 3RQ\ XQOHVV WKH XVH RI DQ HPSOR\HU¶ specifically clarified by Legislation, the U.S. Postal Service, or a court of competent jurisdiction. The Association shall pay for the reasonable cost of all materials, supplies and special services required beyond the normal operation incidental to such uses. ASSOCIATION RIGHTS. On A. The Board agrees to furnish to the Association, at the time of copying for other bodies, one copy of pertinent information concerning the financial resources and conditions of the school district of Xxxxxxxx County, including such items as:
1. Annual financial reports
2. Monthly financial reports
3. Budgetary amendments
4. Tentative annual budgetary proposals upon presentation to the Board
5. Agendas and minutes of Board meetings
6. Financial statements when presented to the Board when prepared
7. Names, addresses of all teachers employed by the Xxxxxxxx County School Board, salaries, rank, certification, and years of experience
8. When agenda is received by Union President, president should check other items the union would like to receive a copy of. President should let county office know within three days, so when the package is picked up by the board members the Union could pick up their package. The Association will reimburse the school district the cost of the printing of such documents as charged the district by the company owing the machines.
B. The Association shall have the right to use teacher mailboxes and/or the electronic counterpart for communicating to employees legitimate association business, distributing legitimate association business, or distributing legitimate association literature or ballots to teachers before or after duty hours by the building representative. Email will be used for information and announcements, not for membership recruitment. A copy shall be given to the principal at the same time. The rights guaranteed herein shall not be granted to any other employee organization.
C. The Association will have the exclusive use of a bulletin board at each school center. The bulletin board will be located in the faculty room or in another area frequented by all teachers in the school. The association will provide the bulletin board. The articles will be signed by the Association President or building representative.
D. The Association shall have the right to use school buildings as other non-school groups.
E. Payroll dues deductions will be allowed provided the Association presents a list of members desiring payroll dues deductions to the district office by September 1 15. Signed continuous dues deduction authorization form shall accompany said list from each member desiring payroll dues deduction. Payroll dues deduction shall be continuous until canceled in writing by the member. Said written request for cancellation shall reach the office of the Finance Officer no later than the date the monthly payroll is due in order for the cancellation to become effective the current month. The dues shall be deducted in twenty-four installments; thereupon the Finance Officer shall remit a check monthly to the Association. Employees who enroll during the contractual year may use the payroll dues deduction plan by signing the continuous dues deduction form. The amount to be deducted shall be submitted by the payroll due date following the beginning date of enrollment with a pro rata amount for the remainder of the deduction year.
F. The Association will be given the last place on the agenda of each regular meeting involving the total school yearfaculty to conduct Association business.
G. The principal/designee shall permit employee/non-employee agents of the Association reasonable access to work locations provided that (1) prior notification to the principal specifically permitted by the principal/designee.
H. Upon prior written notification the Superintendent shall grant the Association President or designee up to ten (10) professional release days to conduct Union related activities. If such leave days are taken during regular student contact time, the Union will reimburse the District for the cost of a substitute to relieve the Association President or designee. The Professional days will not carry over from one fiscal year to another. The Professional leave granted does not include per diem, travel or subsistence expense. The days are to be coordinated with the school principal for the mutual benefit of the Association and the District. Such leave will not conflict with school testing days nor create a disruption in the school’s educational programs.
A. Teachers shall have the right to self-organization, to form, join, or assist labor unions or labor organizations, to bargain collectively through representatives of their own choosing, and to engage in concerted activities for the purpose of collective bargaining or other mutual aid or protection.
B. Teachers shall have the right to maintain one's own private and personal life and activities but subject to all provisions of laws and statutes of the State of Florida.
C. At the request of the teachers, they shall have the right to have deducted from their salary, medical hospitalization insurance, annuities, and other deductions as approved by the Board. Additionally, the Board will provide the Union President with the names and addresses of bargaining unit members. Upon request, the Board will provide the Union President with the names and addresses, job classification, and building assignment of newly-hired bargaining unit membersup to two (2) payroll deduction slots to be used for PESCO services. Section 9. Employees shall be permitted to see their personnel file and may duplicate any information in the file except information secured in the course of employing the employee.
Section 10. The Board shall supply the Association with a copy of each job description covered by this Agreement.
Section 11. The Board shall provide the Association president the names of all employee applicants for bargaining unit vacancies within five (5) work days following Human Resources’ disposition concerning the filling of a vacancy(ies).
Section 12. A maximum of two (2) Association negotiating team members, not from the same building, who are regularly scheduled to work during negotiations meetings with the Board’s team may be allowed with permission of the Director of Facilities to participate in such meetings and make up missed work time due to such meetings. This makeup is to be completed before the next school day.
Section 13. The Board shall provide the Association president, within fourteen (14) calendar days after the applicable action, with the following:
A. Names of all newly hired employees;
B. Names of all employees whose employment relationships have been terminated, unless the employee requests his/her name not be provided.
Section 14. The parties agree that the Board will not implement the subcontracting of work performed by bargaining unit employees covered by this Agreement which would result in a layoff and/or a reduction in normal work hours without adhering to the following schedule and provisions:
A. The Association President shall be notified in writing of the specific work area(s) being considered for subcontracting a minimum of ninety (90) calendar days prior to the date of the Board decision to subcontract.
B. The Association President shall be given the written specifications being supplied and required of potential subcontractors for the specific work area(s) being considered for subcontracting. These specifications are to be provided within thirty (30) calendar days from the date of notification in Part A above. If the Board fails to comply with either of the provisions specified above (A or B), the Board shall refrain from subcontracting such work until the Board complies with all of the provisions (A and B), commencing with the notification specified in Part A above. Subcontracting in this section covers only work that is now performed by bargaining unit employees during normal working hours. This does not include work that the Board has contracted for maintenance or repairs of buildings.

In the interest of furthering employee-employer relations, a joint Labor/Management Committee will convene from time The Association shall be provided access to time school buildings for the purpose of discussing areas holding general meetings. All dates, times and facilities to be used must be scheduled through the building principal. School facilities will not be used for Association meetings during the regular school day.
Section 4. The Association shall be provided use of mutual concernone (1) bulletin board assigned by the building administrator in each building to carry on their responsibilities as exclusive representatives.
Section 5. Members The Association shall be provided use of the Committee courier mail service during the year to carry on their responsibilities as exclusive representative.
Section 6. The Board shall deduct the sum of the regular membership dues of the Association in eighteen (18) equal deductions for each check in accordance with the established pay schedule of East Allen County School Corporation provided the Association provides the Board with written authorization to make such deductions not later than two (2) weeks prior to the first deduction. Association membership dues shall be on a continuing basis unless revoked, in writing, by the employee to the Association and the Board. Additionally, any adjustment in the Association dues total in subsequent years for employees having already signed the designated form will be released from their duties supplied by the Association not later than two (2) weeks prior to attend such meetingsthe first deduction of each applicable year. Additionally, the Board agrees to accept additional dues deductions submitted after the two (2) weeks prior to the first regular deduction of Association membership dues in accordance with the eighteen (18) deductions and the pay schedule of East Allen County School Corporation. The employer is deductions shall be remitted not required to bargain on subjects reserved less frequently than monthly to the management Association. The Association shall indemnify and direction save the Board harmless against any and all claims, demands, suits or other forms of liability that shall arise out of, or by reason of, action taken by the Board in complying with the provisions of this Section.
Section 7. The Board shall maintain one (1) personnel file per employee. An employee shall be informed prior to material of a derogatory nature being placed in his/her personnel file and shall receive a copy. The material shall be signed and dated by the employee to indicate that he/she has seen it; however, such signature does not indicate agreement with its content. The employee has the right to respond in writing. If he/she chooses to do so, he/she shall respond within thirty (30) calendar days and his/her written response shall be attached to the material and placed in his/her personnel file. Failure of the governmental unit except as affect wagesemployee to respond in writing to any derogatory material shall not be construed to indicate agreement with its content. The content of the material shall not be subject to the grievance procedure; however, hoursin the event of a suspension or termination, terms the content of the material and conditions the written response may be introduced into evidence by either party. An employee shall also have the right to be informed of, receive a copy of, and respond in writing to any formal evaluation. The evaluation shall be signed and dated by the employee to indicate that he/she has seen it; however, such signature does not indicate agreement with its content. Failure of employmentthe employee to respond in writing to any derogatory material contained in the formal evaluation shall not be construed to indicate agreement with the derogatory material. The evaluation, and the continuation, modification, or deletion of an existing provision of a collective bargaining agreement. A public employee or exclusive representative may raise a legitimate complaint or file a grievance based on employee’s written response to the collective bargaining agreement.
E. The union evaluation shall be permitted during the fall and winter of each school year to have a new member orientation during contracted hours on waiver days. This new member orientation shall be no more than 30 minutes. Union and management shall develop a union contact/information sheet to be placed in the new classified hire packetsemployee’s personnel file. The content of the evaluation shall not be subject to the grievance procedure; however, in the event of a suspension or termination, the formal evaluation and written response may be introduced into evidence by either party.
Section 8. When an employee is given a written reprimand that specifically indicates that future suspension and/or termination is possible, the employee shall be informed prior to such written reprimand being placed in his/her personnel file and shall be given a copy. The written reprimand shall be signed and dated by the employee to indicate that he/she has seen it; however, such signature does not indicate agreement with its content.
Section 9. Employees shall be permitted to see their personnel file and may duplicate any information in the file except information secured in the course of employing the employee.
Section 10. The Board shall supply the Association with a copy of each job description covered by this Agreement.
Section 11. A maximum of two (2) Association negotiating team members, not from the same building, who are regularly scheduled to work during negotiations meetings with the Board’s team may be allowed with permission of the Director of Facilities to participate in such meetings and make up missed work time due to such meetings. This makeup is to be completed before the next school day.
Section 12. The Association President shall be provided the HR Addendum as provided to the President of the EAEA not less than twenty-four (24) hours following each Board of School Trustees meeting.
Section 13. The parties agree that the Board will not implement the subcontracting of work performed by bargaining unit employees covered by this Agreement which would result in a layoff and/or a reduction in normal work hours without adhering to the following schedule and provisions:
A. The Association President shall be notified in writing of the specific work area(s) being considered for subcontracting a minimum of ninety (90) calendar days prior to the date of the Board decision to subcontract.
B. The Association President shall be given the written specifications being supplied and required of potential subcontractors for the specific work area(s) being considered for subcontracting. These specifications are to be provided within thirty (30) calendar days from the date of notification in Part A above. If the Board fails to comply with either of the provisions specified above (A or B), the Board shall refrain from subcontracting such work until the Board complies with all of the provisions (A and B), commencing with the notification specified in Part A above. Subcontracting in this section covers only work that is now performed by bargaining unit employees during normal working hours. This does not include work that the Board has contracted for maintenance or repairs of buildings.

ASSOCIATION RIGHTS. On The Wynford Education Association, as the exclusive bargaining representative for teachers, shall have the following sole and exclusive rights and privileges that are to be afforded to any employee organization.
A. Payroll deduction of professional dues for the teachers of the Wynford Education Association to the United Education Profession (defined as the national Education Association, Ohio Education Association, North Central Ohio Education Association, and the Wynford Education Association), in equal amounts or before as otherwise indicated, with the written authorization of the member, shall be made. Deductions for returning members shall be continuous from year to year unless an employee submits a written withdrawal of membership to the WEA treasurer between August 15 and September 1 30. The Association Treasurer shall notify the Board Treasurer of any such withdrawals. Any payroll deductions for the current membership year made prior to receipt of the withdrawal form will be refunded to the member in the following pay period. Payroll deductions for new participating members shall commence no later than the second pay date following the receipt of the Membership Enrollment Forms by the Treasurer’s office.
B. Fair Share Fee
1. Effective August 1, 2000, and during each year thereafter, the Board will agree to deduct from the paychecks of any new bargaining unit members hired after that date of attainment an annual fair share fee in accordance with the Ohio Revised Code and the below-listed procedure. Any existing bargaining unit member who is as of that date of attainment not a dues paying Union member shall be grandfathered and shall not be required to pay a fair share fee as long as that member is employed in the district. However, once such individuals decide to become dues paying members, they are subject to all provisions of this section.
2. Subject to Division (A) (1) of this article, the Employer shall deduct from the pay of members of the bargaining unit who elect not to become members of the WEA or elect not to remain members of the WEA and have submitted written withdraw under Section A, a fair share fee for the Union‘s representation of such non- members during the term of this contract. Payroll deduction will begin with the first pay on or after January 15th.
3. Notice of the amount of the annual fair share fee (which shall be equal to 100% of the unified dues of the Union) shall be transmitted by the Union to the treasurer of the Board by September 15 of each year during the term of this contract for the purpose of determining amounts to be payroll-deducted, and the Employer agrees to promptly transmit all amounts deducted to the Union.
4. In the case of unit employees newly hired after the beginning of the school year, the Board will provide payroll deduction shall commence on the Union President with first pay date on or after the names and addresses of latter of:
a. sixty days employment in a bargaining unit membersposition, or
b. January 15
5. Upon requestThe Employer further agrees to accompany each such transmittal with a list of names of the bargaining unit members for whom all such fair share fee deductions were made, the Board will provide the Union President with the names and addresses, job classificationperiod covered, and building assignment of newly-hired bargaining unit membersthe amounts deducted for each.
6. The Association will be accorded Union represents to the following privileges:
A. Use of designated bulletin boards, including head custodial rooms, kitchen and main bulletin boards, for posting non-political notices of official Association business in each building with the location and space designated by the building administrator. Each designate bulletin board will be used exclusively for OAPSE information;
B. One copy of the Board meeting agenda;
C. Use of school buildings the same as any organization Employer that an internal rebate procedure has been established in accordance with Section 4117.09 (C) of the Revised Code and that a procedure for challenging the amount of the representation fee has been established Board policyand will be given to each member of the bargaining unit who does not join the Union and that such procedure and notice shall be in compliance with all applicable state and federal laws and the Constitutions of the United States and the State of Ohio.
7. Upon timely demand, non-members may apply to the Union for an advance reduction/rebate of the fair share fee pursuant to the internal procedure adopted by the Union.
8. The Union on behalf of itself and the OEA and NEA agrees to indemnify the Employer for any cost or liability incurred as a result of the implementation and enforcement of this provision provided that:
a. The Employer shall give written notice within ten (10) days, or as soon as practicable, on any claim made or action filed against the Employer by a non- member for which indemnification may be claimed;

ASSOCIATION RIGHTS. On or before September 1 4.1 The SESE Board shall place on the agenda of each school yearSESE Board meeting any matters brought to its attention by the Association under COMMUNICATIONS OF VISITORS OR EMPLOYEES.
4.2 The President of the Association, or the President’s designee, shall be given written notice of the time and location of all regular and special meetings of the SESE Board together with a copy of the tentative agenda or statement of purpose of each meeting at least seventy-two (72) hours prior to the scheduled time of the meeting. In the event an emergency meeting is called as provided for by statute the President of the Association will be notified by telephone at the same time that notification is made to the media and members of the SESE Board.
4.3 One copy of the unofficial minutes from regular or special meetings of the SESE Board (except for closed sessions) shall be mailed to the Association President at the same time SESE Board members receive their copies of said minutes. It is understood that these unofficial minutes may be corrected and/or revised prior to their official acceptance by the SESE Board.
4.4 The SESE Board will provide annually one copy to the Union President with the names Association upon request: • Official Budgets • Official Financial Reports • Federal Projects Budgets • Federal Projects Audits
4.5 Names and addresses of bargaining unit membersnewly hired employees shall be provided to the President of the Association within fifteen (15) days of their employment.
4.6 Should the Association desire to send representatives to IEA/NEA Association activities, up to eight (8) days will be approved per contract year. The employees will be released without loss of pay or benefits. The cost of the substitute will be split between the Association and the District. Upon requestapproval of the SESE Board, an additional four (4) days may be granted, the Board will provide cost of which is to be paid by the Union President with the names and addresses, job classification, and building assignment of newly-hired bargaining unit membersAssociation. The Association will give ten (10) days written notice to the Director or Assistant Director.
4.7 The rights granted herein to the Association shall not be accorded granted or extended to any competing teacher organization.
4.8 Before or after regular work hours the following privileges:Association and its representatives shall have the right to use a designated room in the SESE Central Office building for a meeting place with the approval of the Director, such approval not to be unreasonably denied.
A. Use 4.9 Duly authorized representatives of the Association and the Illinois Education Association shall be permitted to transact official Association business on school property during duty free times of such employees and provided the educational program or employee job duties are not interrupted or employee work schedules are not altered to transact Association business. Duty free is defined as being time before and after the regular employee workday and during the employee’s duty-free lunch period.
4.10 The Association shall have the right to post notices of activities and matters of Association concern on designated bulletin boards, including head custodial roomsat least one of which shall be located in the Central Office. Association materials may not be delivered except during regularly scheduled trips to schools for delivery of services for the District.
4.11 The local Association shall be allowed to use office equipment, kitchen and main bulletin boardsexcluding computers used by confidential employees, for posting non-political notices of official Association business in each building with the location and space designated by the building administrator. ASSOCIATION RIGHTS. On All rights listed below are sole and exclusive rights of the Association.
A. Association days shall not be considered as work days within the school calendar. Those twelve (12) month employees scheduled to work on such days may, at their option, attend the meeting or before September 1 work their scheduled day. Those who attend must provide proof of attendance, i.e., registration receipts, turned into the central administrative office, unless the receipts are not given at the time of the meeting. When receipts are not given at the meeting, they will be turned in as soon as possible. B. The Association shall be entitled to send a maximum of two (2) official delegates to its annual assemblies. The Association shall be permitted given an opportunity to address staff during the fall and winter of each school year annual in-service for up to have a new member orientation during contracted hours on waiver days. Union and management If there is a separate meeting with new hires, the Association president or designee will be given time on the agenda to speak with them for up to 15 minutes. Representatives of the Association may make announcements during school or bus garage staff meetings.
I. With 48 hour notice to the Superintendent, the Association President or designee may contact the Board of Education directly via email to all Board members and/or be added to the Board agenda to speak to the Board in the open meeting. Each Board meeting agenda shall develop a union contact/information sheet include time for the Association President or designee to speak. The speaker must inform the Superintendent of the topic to be placed discussed at least 24 hours in advance.
J. The Association building representative will have permission to use individual school equipment, copiers, computers and all types of audio-visual equipment when such equipment is not otherwise in use. Association use of school buildings provided that:
A. Request is made and use arranged for in advance.
B. Supplies in connection with such equipment used will be furnished or paid for by the new classified hire packetsAssociation.

ASSOCIATION RIGHTS. On 1. Representatives of the Association shall have the right to use a designated institutional bulletin board located in Faculty Lounges in a conspicuous place. Association communications to employees shall be posted on bulletin boards so designated, and a copy given to the building principal. Designation of the bulletin board shall be made by mutual consent of the Association representative and the Principal.
2. The Association may use the District mail service and teacher mailboxes for communication to teachers. Such communication shall be dated and state the name of the organization sending the communication and a copy given to the building principal.
2.1. The TAL/CTA Office will be included on the district interoffice mail run at least once a day (Midday).
3. Authorized representatives of the Association shall be permitted to transact official Association business on school property at all reasonable times upon notification to the principal or before September 1 his/her designee.
4. The Association may designate representatives of the Association to receive paid leave of absence to attend an officially called Regional/State/National Association conference. Such conferences shall not exceed a total of twelve (12) days per year. The Association shall pay all conference and substitute expenses. The District conference request procedure will be used.
5. The Association shall be entitled to sixty (60) days release time each school year covered by the Agreement for use by the Association's representatives. The Association’s representatives shall, whenever possible, give 24 hour advance notice to site administrators when using Association days. The Association shall pay substitute expenses. Any substitute costs resulting from jointly attended bargaining training will be absorbed by the District. Days used by the Association for the annual negotiations training of its bargaining team shall not be charged to the sixty (60) days release time.
5.1. The first ten (10) days of release time are non-chargeable in order to provide funds for the purpose of purchasing liability insurance relative to Peer Assistance and Review (PAR) or other uses at the Association’s discretion.
6. Names, addresses, telephone numbers, and site assignments of all District teachers, if authorized by the teacher, shall be provided without cost to the Association no later than November 1st of each school year.
7. The District and the Association shall furnish to each other any information or documents which are reasonably necessary for each to fulfill its role in the negotiation process, including information regarding the placement of personnel on the respective salary schedules as of February 15, and other documents to the extent such documents are not communications among the members of the management of the District or otherwise confidential. Only one (1) copy of any document requested hereunder need be furnished. The Association shall be entitled to one (1) free copy of the Board's public agenda and minutes.
8. The District shall post all Board will Policies and current Rules and Regulations governing the Lancaster School District on the District network.
9. The Association agrees to provide the Union President District with the names of Association Officers and addresses Building Representatives no later than November 1st of each school year.
10. The District and the Association agree to refer matters of concern not addressed through negotiations to the TALC (Teachers Association of Lancaster Consultation Committee) process for study and rendering of recommendations.
11. The Lancaster School District (LSD) and the Teachers Association of Lancaster (TAL) recognize the need to maintain open-book budget processes at the District and at the sites.
12. The District will maintain a District Budget Advisory Committee which will include TAL participation.
13. EXPIRATION OF MOU’s
13.1. All MOU’s included within the Collective Bargaining Agreement will expire on June 30th of each year, unless extended by mutual consent of both parties or specifically and individually identified for extension to a later date.
13.2. All MOU’s will be re-examined at bargaining sessions prior to June 30 each year.
13.3. All MOU’s will be added with their incorporation and expiration date.
14. SITE SPECIFIC CONTRACT VARIATIONS
14.1. Site variances are limited to those contract variations that have no impact on other sites. All contract Articles are specifically excluded from any site variations in whole or in part unless they are part of the following list: Article IX, Class Size; Article X, Hours of Work; Article XI, Work Days; Article XXVI, Year- Round Education.
14.2. Site discussion may take place on specific contract language variations following a secret ballot conducted by the Building Rep.
14.2.1. Each numbered paragraph to be discussed must be individually identified and must be voted on specifically in order for it to be included in the discussion for possible variations.
14.2.2. No paragraph may be discussed for variation unless 90% of the assigned unit members vote ―yes‖ by secret ballot to include it. Each paragraph shall be voted upon individually as part of the overall ballot.
14.2.3. Part time or job share teachers are to vote in proportion with their assignment at the school.
14.2.4. Itinerant unit members such as speech therapists, music teachers, etc. are to vote in proportion to their assignment at the school.
14.2.5. Voting on site contract variances is limited to active members of the Teachers Association of Lancaster.
14.2.6. Teachers on leave of absence at the time of balloting may not vote on contract variances.
14.3. Discussion may begin on specific language variations for specific numbered paragraphs following an affirmative vote of at least 90% of the specified staff members.
14.3.1. Site unit members will elect, by secret ballot, conducted by the Building Rep no more than three site contract variance negotiators to work with a representative from TAL Bargaining Team or the TAL Consultations Team appointed by the TAL President.
14.3.2. These members will comprise a collaborative site negotiation team to work with administrative representatives to design site specific contract variances.
14.3.3. A representative from TAL’s Executive board shall be present at the voting by secret ballot.
14.3.4. The District may choose a representative to be present at the counting of the ballots.
14.4. Proposed changes will be submitted to the Superintendent or designee for approval.
14.5. Proposed changes will be submitted by the Building REP to the TAL Executive Board for approval.
14.6. Following approval by the District Office and the TAL Executive Board the Building REP will conduct a vote of approval by staff members.
14.6.1. Variances must be approved by at least 70% of the staff members. Upon request, the Board 14.6.2. Vote will provide the Union President with the names and addresses, job classification, and building assignment of newly-hired bargaining unit membersbe by secret ballot.
14.7. The Association will LSD Board of Trustees and the TAL REP Council must approve all variances in regular session.
14.8. All variances are to be accorded approved by April 1st of each year in order to be included as a contract variance for the following privileges:year unless specifically exempted from this requirement by the TAL Executive Board and the TAL REP Council.
A. Use 14.8.1. All transfer opportunities to sites with variances must be posted with a note that a variance is in place at the site.
14.8.2. Transferees to a contract variance site must adhere to all variances in place or scheduled to take place at the site.
14.8.3. Transferring unit members must assume responsibility for referring to the general contract for specific variance language related to the potential work sites.
14.9. All site variances expire at the end of designated bulletin boards, including head custodial rooms, kitchen and main bulletin boards, for posting non-political notices of official Association business one (1) school year unless the staff has specifically voted by secret ballot in each building with the location and space designated an election conducted by the building administrator. Each designate bulletin board will be used exclusively for OAPSE information;
B. One copy of REP to continue the Board meeting agenda;
C. Use of school buildings the same as any organization in accordance with established Board policy;
D. Reasonable use of the Administration Building’s copying equipment by the Association’s President or his/her designee at the rate established by the Administration. Reasonableness as used herein shall be determined by the Superintendent. For the purpose of this Section, “political” refers to issues and candidates other than internal Association politics. ASSOCIATION RIGHTS. On 4.1 VUSD recognizes that its relationship with XXXXX is a partnership that works to accomplish mutual interests and wants to nurture that relationship with open communication and access to information. Given the legislative mandate to provide direct access to new employees during an orientation process, VUSD agrees that it will provide no less than 10 working days’ notice to VESPA of any scheduled group orientations for new employees (Gov. Code Section 3556) and allow no less than 30 minutes for VESPA to present to the new employees. Updated information on new employees will be provided every 120 days unless mutually agreed it is unnecessary (Gov. Code Section 3558). For individual or before September 1 of each school small group orientations spread out through the fiscal year, VESPA is encouraged to submit material describing the Board function and importance of union membership. VUSD agrees to provide those materials to employees during the orientation process. Additionally, VUSD will allow access to representatives of VESPA to new employees at work sites during non-duty hours. However, additional released time for membership recruitment will not be provided to VESPA representatives unless the cost is reimbursed to VUSD. ASSOCIATION RIGHTS. On 6.1 Inter-school mail facilities and District email may be used for distribution of Association communications so long as such communications are labeled as Association materials and contain the name of the authorizing Association official. Provided the District acts in accordance with the above, the Association shall hold the District harmless against any suits brought against the District as a result of the Association's use of such facilities.
6.2 School facilities and equipment may be used for Association meetings at reasonable times provided that such meetings and equipment use shall not interfere with the normal school operations. The Association shall pay the reasonable costs of all materials and supplies incidental to such use and for any repairs to equipment necessitated as a result thereof.
6.3 Upon request, the District shall furnish to the Association information reasonably available for its use as exclusive bargaining representative. The District will also distribute copies of all Board meeting minutes to attendance units and the Association president immediately after their preparation. In addition, materials made available to the news media and the general public shall be provided the Association president prior to the meeting or at the meeting, if not available before September 1 that time.
6.4 The Association President will provide the District with a list Designated Association Representatives at the beginning of each school year. Designated Association Representatives shall be granted reasonable paid time to perform Association duties during regular scheduled work hours without loss in pay, benefits, leave accrual, or seniority. The District will grant the Association and its members a total of twenty (20) days leave for Association business, including, but not limited to, the Board will provide Oregon Education Association Representative Assembly. Said leave shall be under the Union President with exclusive control of the names and addresses Pendleton Association of bargaining unit members. The employee shall be informed prior to such written reprimand being placed in his/her personnel file and shall be given a copy. The written reprimand shall be signed and dated by the employee to indicate that he/she has seen it; however, such signature does not indicate agreement with its content. The employee has the right to respond in writing, if he/she chooses to do so. His/Her written response shall be attached to the material and placed in his/her personnel file. Failure of the employee to respond in writing to any written reprimand shall not be construed to indicate agreement with its content. After receiving a written reprimand that specifically indicates that future suspension and/or termination is possible, the employee may request a meeting with the Director of Facilities or designee to discuss the matter. The employee may have a representative(s) of the Association present at this meeting. Following the meeting with the Director of Facilities or designee, the employee may request a meeting with the Director of Human Resources to discuss the matter. The Director of Facilities or designee may be present at this meeting. In the event the Director of Facilities or designee, or the Director of Human Resources schedules a meeting with the employee to discuss the matter, the employee may have a representative(s) of the Association present at this meeting(s). The meeting(s) specified within this paragraph should not be held during the normal working hours of the employee. The parties involved shall arrange, by mutual agreement, the meeting time(s). The content of the written reprimand that specifically indicates that future suspension and/or termination is possible shall not be subject to the grievance procedure. However, in the event of a suspension and/or termination, the content of the materials and the written response may be introduced into evidence by either party.
Section 9. Employees shall be permitted to see their personnel file and may duplicate any information in the file except information secured in the course of employing the employee.
Section 10. The Board shall supply the Association with a copy of each job description covered by this Agreement.
Section 11. The Board shall provide the Association president the names of all employee applicants for bargaining unit vacancies within five (5) work days following Human Resources’ disposition concerning the filling of a vacancy(ies).
Section 12. A maximum of two (2) Association negotiating team members, not from the same building, who are regularly scheduled to work during negotiations meetings with the Board’s team may be allowed with permission of the Director of Facilities to participate in such meetings and make up missed work time due to such meetings. This makeup is to be completed before the next school day.
Section 13. The Board shall provide the Association president, within fourteen (14) calendar days after the applicable action, with the following:
A. Names of all newly hired employees;
B. Names of all employees whose employment relationships have been terminated, unless the employee requests his/her name not be provided.
Section 14. The parties agree that the Board will not implement the subcontracting of work performed by bargaining unit employees covered by this Agreement which would result in a layoff and/or a reduction in normal work hours without adhering to the following schedule and provisions:
A. The Association President shall be notified in writing of the specific work area(s) being considered for subcontracting a minimum of ninety (90) calendar days prior to the date of the Board decision to subcontract.
B. The Association President shall be given the written specifications being supplied and required of potential subcontractors for the specific work area(s) being considered for subcontracting. These specifications are to be provided within thirty (30) calendar days from the date of notification in Part A above. If the Board fails to comply with either of the provisions specified above (A or B), the Board shall refrain from subcontracting such work until the Board complies with all of the provisions (A and B), commencing with the notification specified in Part A above. Subcontracting in this section covers only work that is now performed by bargaining unit employees during normal working hours. This does not include work that the Board has contracted for maintenance or repairs of buildings.
Section 15. The Association President shall be provided the same “Board Packet” as provided the President of the EAEA not less than twenty-four (24) hours prior to each Board of School Trustees meeting.

ASSOCIATION RIGHTS. On A. A reasonable number of Association representatives shall have the right of access to areas in which employees work so long as the representatives do not interfere with the work performance of any employee.
B. The Association shall have access to two bulletin boards: (1) one in the mailroom of the Administration Building and (2) one in the Faculty Center (BONH-330) of Xxxxxxx Xxxx. E. The Association shall be permitted the use of facilities and equipment subject to the same regulations governing other users as specified in the District policy on use of facilities.
F. The Association shall be provided materials that are available to the public. When materials are requested that are not readily available in the form requested, the Association shall pay for the staff time and supplies necessary to produce the materials, providing such material is subject to the time limitations of staff and work priorities. An estimate of cost, when applicable, shall be provided to the Association.
G. The Association shall reimburse the District for all telephone toll charges when used for Association purposes.
H. Representatives of the Association may be granted leave for Association business. Said leave shall total not more than five (5) days per year and shall not accumulate from year to year. The Association will provide or reimburse costs of substitute(s) for its representative(s) on such leave.
I. The Association shall receive 20% reassigned time to conduct its business.
J. Human Resources shall provide the Association with the name and address of each school year, faculty member within 10 days of the Board will start of employment.
