AT&T SOUTHWEST REGION. 5-STATE shall provide a toll free facsimile number to CLEC for the submission of requests for Resale Services and Lawful Unbundled Network Elements under this Agreement; CLEC shall provide AT&T SOUTHWEST REGION 5-STATE with a toll free facsimile number for notices from AT&T SOUTHWEST REGION 5-STATE relating to requests for Resale Services and Lawful Unbundled Network Elements under this Agreement.

AT&T SOUTHWEST REGION. 5-STATE - As used herein, AT&T SOUTHWEST REGION 5-STATE means Southwestern Xxxx Telephone, L.P. d/b/a AT&T Arkansas, AT&T Kansas, AT&T Missouri, AT&T Oklahoma and/or AT&T Texas.
AT&T SOUTHWEST REGION. 5-STATE will charge Customer a per-Query and a per-Query Transport rate as set forth in Appendix I Pricing of this Agreement for each Query Customer initiates into the respective LIDB and/or CNAM Database, including those Queries for which AT&T SOUTHWEST REGION 5-STATE returns a Complete or Partial Screen. When per-Query and per-Query Transport rates both apply, AT&T SOUTHWEST REGION 5-STATE and AT&T CALIFORNIA may change either of these rates, or both such rates, at any time so long as the sum of the rates is equal to or less than the sum of those rates on Appendix I Pricing of this Agreement. AT&T CALIFORNIA will charge Customer a per-query rate as set forth in Appendix 1, Pricing of this Agreement for each CNAM Query that Customer initiates into LIDB, including those Queries for which AT&T CALIFORNIA returns a Complete or Partial Screen. AT&T CALIFORNIA will charge Customer a per-Query and a per-Query Transport rate as set forth in Appendix I, Pricing of this Agreement for each GetData Query that Customer initiates into the respective LIDB, including those Queries for which AT&T CALIFORNIA returns a Complete or Partial Screen. AT&T-12STATE may increase its per-Query and/or per-Query Transport rates any time after the initial term of this Agreement upon written notice of such rate increase given a minimum of sixty (60) days prior to the effective date of such increase to Customer. If Customer acts as a Data Clearinghouse and/or Billing Clearinghouse, AT&T-12STATE will provide a minimum of ninety (90) days written notice, so that the notice may be communicated by Customer to its Clients. Upon such notice Customer may terminate this Agreement without any termination liability by providing advance written notice. AT&T-12STATE may reduce its per-Query Rates and/or Per Query Transport rates at any time and without notice. All tariffed rates and/or charges, whether rate increases or rate decreases, will be applicable upon the effective date of said tariff changes, without notice beyond the normal tariff process. AT&T-12STATE will charge Customer a Nonrecurring Charge for Service Establishment for each point code Customer requests AT&T SOUTHWEST REGION 5-STATE and/or AT&T CALIFORNIA to activate, change, rearrange, or modify for Customer, Customer's Query-Originating Carrier Companies, and Customer's Client's Queries. AT&T SOUTHWEST REGION. 5-STATE’s -- late payment charges in the amount reflected in AT&T SOUTHWEST REGION 5-STATE’s Tariff FCC No. 73, or the highest rate allowed by law, whichever is lower. AT&T CONNECTICUT -- late payment charges in the amount reflected in AT&T CONNECTICUT's Tariff FCC No. 39 or the highest rate allowed by law, whichever is lower. Depending on Customer’s choice of method for transporting its Queries and Responses, Customer may be required to purchase certain other services, especially services that may be provided pursuant to effective tariffs (e.g. tariffed SS7 interconnection). In this event, the prices, terms, conditions, and billing for such services will be specified in the applicable tariff(s), and this Agreement, in no way, shall be construed to circumvent the prices, terms, and conditions, or billing as specified in the applicable tariff(s).

AT&T SOUTHWEST REGION. 5-STATE - Section 34 of the FCC No. 73 Access Services Tariff. 3.3 AT&T-12STATE provides WSPs the optional use of the AT&T-12STATE LNP database via the SPNP Query Service-Database. When WSP orders SPNP Query Service-Database, AT&T-12STATE shall charge and WSP agrees to pay the SPNP Query Service-Database service charges set forth in the appropriate tariff cited in 3.2 above. The WSP’s Signal Transfer Point (STP), tandem, and/or end office’s LRN software will determine the need for, and triggers, the query. AT&T-12STATE’s LNP database will determine if a number has, or has not, been ported and will provide LRN if a number is ported.
AT&T SOUTHWEST REGION. 5-STATE is to provide LNP in that MSA in the requested switches within six (6) months of receipt of BFR. Per the FCC’s First Memorandum Opinion And Order On Reconsideration (March 1997, ¶65,66), switches that were not requested to be LNP capable in the initial LNP deployment in the top 100 MSAs can be requested to be made LNP capable. The following time frames begin after an MSA’s Phase end date has been reached:

  • ELECTRICAL SERVICES A. Landlord shall provide electric power for a combined load of 3.0 xxxxx per square foot of useable area for lighting and for office machines through standard receptacles for the typical office space.

  • Western will as requested by the Manager oversee the maintenance of all books and records with respect to the investment transactions of the Fund in accordance with all applicable federal and state laws and regulations, and will furnish the Directors with such periodic and special reports as the Directors or the Manager reasonably may request.

  • Utilities, Services Landlord shall provide, subject to the terms of this Section 11, water, electricity, heat, air conditioning, light, power, sewer, and other utilities (including gas and fire sprinklers to the extent the Project is plumbed for such services), refuse and trash collection and janitorial services (collectively, “Utilities”). Landlord shall pay, as Operating Expenses or subject to Tenant’s reimbursement obligation, for all Utilities used on the Premises, all maintenance charges for Utilities, and any storm sewer charges or other similar charges for Utilities imposed by any Governmental Authority or Utility provider, and any taxes, penalties, surcharges or similar charges thereon. Landlord shall not cause any Utilities to the Premises which are not currently separately metered to be separately metered. Tenant shall pay directly to the Utility provider, prior to delinquency, any separately metered Utilities and services which may be furnished to Tenant or the Premises during the Term. Tenant shall pay, as part of Operating Expenses, its share of all charges for jointly metered Utilities based upon consumption, as reasonably determined by Landlord. No interruption or failure of Utilities, from any cause whatsoever other than Landlord’s willful misconduct, shall result in eviction or constructive eviction of Tenant, termination of this Lease or the abatement of Rent. Tenant agrees to limit use of water and sewer with respect to Common Areas to normal restroom use. Landlord’s sole obligation for either providing emergency generators or providing emergency back-up power to Tenant shall be: (i) to provide emergency generators with not less than the capacity of the emergency generators located in the Building as of the Commencement Date, and (ii) to contract with a third party to maintain the emergency generators as per the manufacturer’s standard maintenance guidelines. Landlord shall have no obligation to provide Tenant with operational emergency generators or back-up power or to supervise, oversee or confirm that the third party maintaining the emergency generators is maintaining the generators as per the manufacturer’s standard guidelines or otherwise. During any period of replacement, repair or maintenance of the emergency generators when the emergency generators are not operational, including any delays thereto due to the inability to obtain parts or replacement equipment, Landlord shall have no obligation to provide Tenant with an alternative back-up generator or generators or alternative sources of back-up power. Tenant expressly acknowledges and agrees that Landlord does not guaranty that such emergency generators will be operational at all times or that emergency power will be available to the Premises when needed.

  • Security Services CONTRACTOR shall provide security services designed for preventing escapes, maintaining order, providing care, custody, control, supervision and management of the inmate population. A successful security program depends heavily on staff training, effective administration, and the establishment of inmate programs. The organization, staffing, and administration of the security program are vital to the Facility. The direction provided by a well-organized and clearly articulated operations manual, and emergency planning provides a solid base for successful administration. The final operations manual shall be submitted to the Bureau prior to the Service Commencement Date and shall be reviewed annually and updated as needed. Documentation of the review shall be provided annually to the On- Site Contract Monitor. Changes to the plan require written permission by the Contract Manager. The Department reserves the right to require changes to plans submitted to the Bureau.
