BARGAINING AGENCY. (a) The Company recognizes the Union as the sole collective bargaining agency for all employees at its retail stores in Ontario, except the stores in the Regional Municipality of Ottawa-Carleton, save and except Assistant Store Manager, persons above the rank of Assistant Store Manager, Graduate and Undergraduate Pharmacists, including Pharmacy Interns and Apprentice Pharmacists, and Office Staff. (b) A person classified as a Management Trainee is a member of the bargaining unit until such time as the Company advises the Union that the trainee has successfully, or otherwise, completed his training which shall be done within nine (9) months of each trainee's commencement of training. The Union will be advised in writing of names of management trainees. The Management Trainee Program is implemented solely for training purposes, in order to provide future managers with hands on experience of working in a store. Prior to placing a Management Trainee in any store, the Company agrees to provide the union with the name, the duration of placement and the location of placement of the Trainee. The Company agrees that the Trainee’s hours are separate and over and above from the store departments’ allotment of scheduled hours. A Management Trainee placement at the store will not exceed nine (9) months duration. Any concerns about the operation of the Management Trainee Program may be brought to the attention of senior management, and a meeting will be convened to discuss them. (c) The Company agrees that stores shall be staffed by Assistant Store Managers on the following basis; All stores shall have one (1) Assistant Store Manager, unless, i. The store is open for greater than 100 hours per week or has front store sales volumes in excess of $100, 000.00 per week, in which case there may be two (2) Assistant Store Managers. ii The store is open for greater than 100 hours per week or has front store sales volumes in excess of $150, 000.00 per week, in which case there may be three (3) Assistant Store Managers. Assistant Store Managers shall not be used to the extent that they cause a reduction of hours of any bargaining unit employees. (a) The term full-time employee or full-time employees whenever herein used, shall mean employees scheduled to work a normal work week forty (40) hours per week. (b) The term part-time employee or part-time employees whenever herein used, shall mean employees scheduled to work less than a normal work week of twenty-eight (28) hours per week and shall be covered only as specifically set out in Appendix “A”.

However, it is also understood that the Employer shall not be precluded from making such decisions that pertain to the reassignment of work now being performed by employees covered by this Collective Agreement providing such reassignments will remain in the jurisdiction of the Union and are handled in a manner that is mutually acceptable to both parties to this Agreement during the term of this Collective Agreement. (a) If the Employer transfers work set forth in Article 1.1 to a meat plant operated by the Employer within the present area jurisdiction of the Union, the Employer will recognize the Union as the bargaining agent for all employees, excluding office and clerical staff and supervisory personnel, employed by the Employer in said meat plant. In the event that a Management Trainee meat plant is certified by, or under a Collective Agreement with another trade Union at the time it is acquired by the Employer, the foregoing shall not apply. (b) If a full-time employee is terminated because: (i) The Employer transfers work set forth in Article 1.1 to a meat plant operated by the Employer, or (ii) The Employer purchases block ready meats, employees who have sixty (60) days continuous full-time service and up to one (1) year of continuous full-time service shall be given one (1) week’s notice in writing or pay in lieu thereof. One (1) weeks additional notice or pay in lieu thereof will be given to employees with more than one (1) years continuous full-time service for each additional year of continuous full-time service up to a maximum of twenty-six (26) weeks. (iii) The above notice or pay in lieu thereof shall not apply if the full-time employee: (1) is temporarily laid off; (2) accepts other employment with the Employer; (3) is terminated but is re-employed within ten (10) working days to full-time status duty; (4) is offered comparable work in the meat plant operated by the Employer. (iv) Employees who receive notice or pay in lieu thereof shall not be entitled to the benefits contained in Article 10 of this Agreement. Sub- articles (a) and (b) of this article shall not conflict with or supersede the provisions of Article 11 – Seniority of this Collective Agreement. (c) The Employer will give the Union no less than three (3) months’ notice prior to the opening of a newly built meat plant within the present area jurisdiction of the Union. The Employer or its subsidiaries will give preference in hiring prior to the opening of the new meat plant and for three (3) months after the opening of the new plant to qualified full-time employees displaced from the Employer’s retail stores. 1.3 There shall be a member of the bargaining unit until such on duty at all times custom meats are for sale in the meat and delicatessen departments, except during rest and meal periods when staff is not available. In the event this provision is violated then all time as during which meats are for sale and a member of the Company advises bargaining unit is not in attendance, will be computed at the Union journeyman rate of pay and distributed equally amongst the members of the bargaining unit in the store in which the violation occurs. These provisions shall not preclude the Company from setting up dealerships within the area covered by the certification, provided that such dealerships will not result in tho loss of employment of any of the Company's who are members of the bargaining unit until unit, and further that such dealerships are discussed with the Union before implementation and further that all dealers, if individuals, shall be required to be members of the Union and if they hire employees, an agreement acceptable to the Parties shall apply. Prior to placing a Management Trainee in any store, the Company agrees to provide the union with the name, the duration of placement and the location of placement of the Trainee. 1.02 The Company agrees that as a condition of continued employment, all employees who are or may be covered by the Trainee’s hours Certificate of Bargaining Authority issued to the Union by the Industrial Relations Board of British Columbia must become Members of the Union within thirty (30) calendar days of commencing employment and remain Members during the life of this Agreement. 1.03 All present and new full-time employees of the Company who are separate or may be covered by the Certificate of Bargaining Authority issued to the Union by the Industrial Relations Board of British Columbia shall pay to the Union, as a condition of employment, and over not later than thirty (30) calendar days after the commencement of his employment, dues, initiation and above reinstatement fees by payroll deduction, as may from time to time be established by the Union for its Members, in accordance with its Constitution and/or By- Laws. 1.04 Notwithstanding the provisions of Article 1.04 preceding, the Company shall deduct from each new employee an amount equal to the Union dues from the store departments’ allotment employee's first payroll cheque after completion of scheduled hoursfive (5) days of work in a calendar month and add that employee's name and the said amount to the closest applicable check-off; i.e., if the check-off for that month has not been remitted to that check-off; if the month's check-off has been remitted, it shall be added to the following month's check-off, and shown as the previous month worked. 1.05 All deductions as required under Article 1.04 and 1.05 shall be made in each calendar month the employee is employed by the Company. 1.06 The term "employee" as used in and for the purpose of this Agreement shall include all persons employed in the Company's operations and as covered by the Labour Relations Board Certification and without restricting the generality of the foregoing shall not include foremen and those having authority to hire or discharge employees, office workers, supervisory officials, salesmen, and watchmen. A Management Trainee placement at the store Supervisors will not exceed nine (9) months duration. Any concerns about the operation of the Management Trainee Program may be brought to the attention of senior management, and a meeting will be convened to discuss them. (c) The Company agrees that stores shall be staffed do work normally done by Assistant Store Managers on the following basis; All stores shall have one (1) Assistant Store Manager, unless, i. The store is open for greater than 100 hours per week or has front store sales volumes in excess of $100, 000.00 per week, in which case there may be two (2) Assistant Store Managers. ii The store is open for greater than 100 hours per week or has front store sales volumes in excess of $150, 000.00 per week, in which case there may be three (3) Assistant Store Managers. Assistant Store Managers shall not be used to the extent that they cause a reduction of hours of any bargaining unit employees. (a) The term full-time employee or full-time employees whenever herein used, shall mean employees scheduled to work a normal work week forty (40) hours per week. (b) The term part-time employee or part-time employees whenever herein used, shall mean employees scheduled to work less than a normal work week of twenty-eight (28) hours per week and shall be covered only as specifically set out in Appendix “A”.

BARGAINING AGENCY. (a) Section The Company or anyone authorized to act for it recognizes the Union as the sole collective col- lective bargaining agency as certified by the Labour Relations Board for the Province of British Columbia, for its employees covered by this Agreement and hereby consents and agrees to negotiate with the Union, or any Committee thereof in any and all employees at its retail stores matters affecting the re- lationship between the said and em- ployees set forth in Ontariothis Agreement, except who are members of the stores in union and who become members of the Regional Municipality Union, which is chartered by the United Food and Commercial Workers, International Union, Local looking towards a peaceful and amicable settlement of Ottawa-Carleton, save any differences that may arise between the Com- pany and except Assistant Store Manager, persons above the rank of Assistant Store Manager, Graduate and Undergraduate Pharmacists, including Pharmacy Interns and Apprentice Pharmacists, and Office StaffUnion. Section (ba) A person classified as a Management Trainee is a member of The Company agrees to retain in its employ, within the bargaining unit until such as out- lined in Section Article II, of this Agreement, only members in good standing. The Company shall be free to hire new employees who are not members of the union, provided said non- members, whether part time as the Company advises or full time em- ployees, shall be eligible for membership in the Union that the trainee has successfully, or otherwise, completed his training which shall be done within nine (9) months of each trainee's commencement of trainingafter attaining seniority. The Union will be advised in writing of names of management trainees. The Management Trainee Program is implemented solely for training purposes, in order to provide future managers with hands on experience of working in a store. Prior to placing a Management Trainee in any store, the Company agrees to provide each new employee at the union time of employment with a form letter outlining to the new employee his or her responsibility in regard to Union Membership, and to provide the Union in writing with the namename and address of each employee to whom they have presented the form letter, along with the employee’s date of hire, the duration of placement and the location of placement contents of the Traineeletter to be such that it is acceptable to the Company. The Company further agrees that to provide the Trainee’s hours are separate and over and above from the store departments’ allotment of scheduled hours. The term part-time Company will procure from each new and probationary employee or part-time employees whenever herein used, shall mean employees scheduled to work less than a normal work week of twenty-eight (28) hours per week the necessary mem- bership applications and membership in the Union will be granted after attaining seniority. Monies deducted during any month shall be covered only as specifically set out in Appendix “A”forwarded by the Company to the Treasurer of the Union not later that the fifteenth (15th) day of the month for which dues are de- ducted and accompanied by a printed statement of the names of the employees for whom the deductions were made.
