Base rate for new employees. 9.3.3.1 In accordance with Clause 9.3.1 and 9.3.2, the base rate for new employees is to be the equivalent of the salaries table as listed in Clause 9.1.2 and any applicable salary increase. 9.3.3.2 By the end of June each year Management and the Employee will enter into a Performance Review. This review is undertaken on an individual basis with the employee and the Employer. The performance review is conducted in accordance with mutually agreed processes.

The aggregate of any payments that otherwise would have been paid to the Executive during the period between the date of termination and the New Payment Date shall be paid to the Executive in a lump sum on such New Payment Date. Thereafter, any payments that remain outstanding as of the day immediately following the New Payment Date shall be paid without delay over the time period originally scheduled, in accordance with the terms of this Agreement.

  • Payments to Specified Employees Notwithstanding any other Section of this Agreement, if the Employee is a Specified Employee at the time of the Employee’s Separation from Service, payments or distribution of property to the Employee provided under this Agreement, to the extent considered amounts deferred under a non-qualified deferred compensation plan (as defined in Code Section 409A) shall be deferred until the six (6) month anniversary of such Separation from Service to the extent required in order to comply with Code Section 409A and Treasury Regulation 1.409A-3(i)(2).
