Base Sublease Rent. (a) Commencing on the Sublease Commencement Date, and continuing on the first day of each month thereafter through the Sublease Expiration Date, Subtenant shall pay to Sublandlord, in advance on the first day of each calendar month during the Sublease Term, without notice or demand, and without any set-off, counterclaim, abatement or deduction whatsoever, in lawful money of the United States, by check payable to Sublandlord, base sublease rental in the amount of eight thousand nine hundred eighty and 67/100 ($8,980.67) (the “Base Sublease Rent”).
(b) If for any reason the Sublease Term does not commence on the first day of a calendar month or end on the last day of a calendar month, Base Sublease Rent for any partial calendar month shall be prorated by multiplying the monthly Base Sublease Rent by a fraction, the numerator of which is the total number of days of the partial calendar month and the denominator of which is the total number of days in the full calendar month. The first installment of Base Sublease Rent shall be due upon receipt by Subtenant of fully executed copies of this Sublease and Landlord’s consent thereto and in any event, prior to Subtenant’s entry in the Subleased Premises.
Base Sublease Rent. Commencing on the Sublease Rent Commencement Date, and continuing on the first day of each month thereafter through the Sublease Expiration Date, Subtenant shall pay to Sublandlord, in advance, without notice or demand, and without any set-off, counterclaim, abatement or deduction whatsoever, except as may be expressly set forth in this Sublease, in lawful money of the United States, by wire transfer of funds or by check payable to Nektar Therapeutics, base sublease rental (“Base Sublease Rent”) as follows: Sublease Rent Commencement Date – Last day of 7th month following Sublease Rent Commencement Date (the “Reduced Rent Period”)* $ 17,000.00 ** If the Reduced Rent Period shall expire prior to October 5, 2012, then from the first day following expiration of the Reduced Rent Period – 10/5/12 $ 34,209.10 From the later to occur of: (i) the first day following expiration of the Reduced Rent Period; or (ii) 10/6/12 – 10/5/13 $ 35,215.25 10/6/13 – 10/5/14 $ 36,221.40 10/6/14 – 10/5/15 $ 37,227.55 10/6/15 – 10/5/16 $ 38,233.70 *If the Sublease Rent Commencement Date does not occur on the first (1st) day of a calendar month, the period from the Sublease Rent Commencement Date to the first (1st) day of the next calendar month shall be included in the 8th month following the Sublease Rent Commencement Date for purposes of determining the monthly Base Sublease Rent rate applicable for such partial month **During this period, Base Sublease Rent is payable only with respect to 10,000 rentable square feet of the Subleased Premises. A payment of Base Sublease Rent for the first month of the Sublease Term in the amount of $17,000.00 shall be delivered to Sublandlord concurrently with Subtenant’s execution of this Sublease.
Base Sublease Rent. During the Initial Sublease Term, Subtenant shall pay to Sublandlord, as base sublease rent for the Premises, in lawful money of the United States of America, without any deduction, offset, prior notice or demand, in advance on the first date of each month of the Initial Sublease Term $12,809.15. Subtenant’s obligation to pay Base Sublease Rent shall commence on the Commencement Date. Notwithstanding the foregoing, Base Sublease Rent payable for any partial month in which the Commencement Date occurs or which the Term expires, shall be prorated on a daily basis based on the actual number of days in such month.
Base Sublease Rent. Commencing on the Sublease Commencement Date, and continuing on the first day of each month thereafter through the Sublease Expiration Date, Sublessee shall pay to Sublessor, in advance, without notice or demand, and without any set-off, counterclaim, abatement or deduction whatsoever, except as may be expressly set forth in this Sublease, in lawful money of the United States, by wire transfer of funds or by check payable to ShangPharma Innovation base sublease rental (“Base Sublease Rent”) in the amount of $3,195.00. For the avoidance of doubt, Xxxxxxxxx’s rent obligations under the Master Lease shall be independent of, and not conditional upon, Sublessee’s payment of its rent obligations under this Sublease. The parties agree that the Base Sublease Rent set forth above includes the costs for Shared Services as described in Section 3.3(a) below.
Base Sublease Rent. During the Sublease Term, Subtenant will pay Sublandlord as rent for the Sublease Premises (the “Base Sublease Rent”), as follows: March 1, 2017 to February 28, 2018 $ 14.50 psf NNN per annum March 1, 2018 to February 28, 2019 $ 15.00 psf NNN per annum March 1, 2019 to February 29, 2020 $ 15.50 psf NNN per annum March 1, 2020 to May 31, 2020 $ 16.00 psf NNN per annum June 1, 2020 to January 31, 2024 To Be Determined Base rental rates for June 1, 2020 to January 31, 2024 to be determined after Sublandlord negotiates a renewal for the office portion of the Lease with the Landlord. After such renewal is executed, Sublandlord shall create an amendment to this Sublease Agreement stating base rental rates as the lesser of i) the negotiated renewal base rental rate with Landlord, with annual escalations or ii) $20.00 psf NNN, with annual escalations with no further negotiation or agreement needed by Subtenant. If the base rental rate as negotiated with Landlord is higher than $20.00 psf NNN, and the Sublandlord desires for the Subtenant to poay the higher rate, then the amendment of the Sublease Agreement must be agreed upon by both Subtenant and Sublandlord. In the event the parties are unable to reach an agreement on such rates before April 1, 2018, this Agreement shall terminate as of May 31, 2020. For purposes of this Agreement, annual Base Sublease Rent shall be computed by multiplying the number of Rentable Square Feet within the Sublease Premises by the rate psf as shown above for each year of the term of this Agreement. Accordingly, for clarity, the parties agree that the Base Sublease Rent for the first year of this Agreement is One Hundred Fifty Thousand Two Hundred Seventy-Eight and 00/ths U.S. Dollars to be adjusted for each succeeding year of this Agreement thereafter.
Base Sublease Rent. Commencing on the Sublease Commencement Date and continuing on the first day of each month thereafter through the end of the Sublease Term, Subtenant shall pay to Sublandlord, in advance, without notice or demand, and without any set-off, counterclaim, abatement or deduction whatsoever, except as may be expressly set forth in this Sublease, in lawful money of the United States, by wire transfer of funds or by check payable to Zynga Inc., 000 Xxxxxx Xxxxxx, Xxx Xxxxxxxxx, Xxxxxxxxxx 00000 (until and unless a different address is provided by Sublandlord), base sublease rental (“Base Sublease Rent”) of Eighty-five Thousand Six Hundred Eighty-three and 00/100 Dollars ($85,683.00) per month throughout the duration of the Sublease Term. Subtenant shall pay to Sublandlord Eighty-five Thousand Six Hundred Eighty-three and 00/100 Dollars ($85,683.00) upon execution of this Sublease as Base Sublease Rent for the first full month of the Sublease Term following the Sublease Commencement Date. If the Sublease Term begins or ends on a day other than the first or last day of a month, the Base Sublease Rent for the partial month shall be prorated on the basis of a thirty (30) day month.
Base Sublease Rent. Extension Term Rent, Subtenant’s Operating Expense Contribution (including Deferred Opex), and all other amounts payable by Subtenant to Sublandlord hereunder are collectively referred to herein as “Rent.”
Base Sublease Rent. As used herein, the “Sublease Rent Commencement Date” shall mean July 1, 2017, provided if the Sublease Commencement Date is delayed beyond the Target Delivery Date, the Sublease Rent Commencement Date will be delayed by one day for each such day of delay. Commencing on the Sublease Commencement Date, and continuing on the first day of each month thereafter through the Sublease Expiration Date, Sublessee shall pay to Sublessor, in advance, without notice or demand, and without any set-off, counterclaim, abatement or deduction whatsoever, except as may be expressly set forth in this Sublease, in lawful money of the United States, by wire transfer of funds to Sublessor, base sublease rental (“Base Sublease Rent”) as follows: Rent Month 61-7/31/2022 (if applicable) $51.66 $ 343,013.79 * The month in which the Sublease Rent Commencement Date occurs is “Rent Month 1” for the purposes of the foregoing chart.
Base Sublease Rent. (a) Commencing on the Occupancy Date, Subtenant shall pay base rent for the Sublease Premises in the amounts set forth on Exhibit C hereto (“Base Sublease Rent”). Base Sublease Rent shall be due and payable without invoice, notice or demand on the Occupancy Date and on the first (1st) day of each calendar month thereafter during the Sublease Term in advance, without offset, abatement, reduction or deduction. If the Occupancy Date shall be on any day other than the first (1st) day of a calendar month, then on the Occupancy Date Subtenant shall pay Base Sublease Rent for the remaining portion of such month including and after the Occupancy Date, prorated (based on the first full month’s Base Sublease Rent) on a per diem basis.
(b) Subtenant acknowledges and agrees that Sublandlord has assigned all of its rights, title and interest in and to any and all Base Sublease Rent payable hereunder to Master Landlord. Sublandlord hereby directs Subtenant to pay and Subtenant agrees to pay all Base Sublease Rent payable hereunder by Subtenant directly to Master Landlord via wire transfer, ACH draft or other electronic funds transfer to
(c) Notwithstanding (a) and (b) of this Section 3, Subtenant’s performance and obligation to pay under this Sublease is contingent upon an annual appropriation by the Legislature of the State of Florida.
Base Sublease Rent. 2.1.1 During the initial Sublease Term, Sublessee shall pay to Sublessor an annual rental payable monthly, in advance, in equal installments (“Base Sublease Rent”) for the Subleased Premises as follows: Monthly Annually Per RSF Sublease Commencement Date - September 30, 2006 $43,666.25 $523,995.00 $15.00 October 1, 2006 - September 30, 2007 $46,577.33 $558,928.00 $16.00 October 1, 2007 - September 30, 2008 $49,488.42 $593,861.00 $17.00
2.1.2 All monthly installments of Base Sublease Rent will be due and payable on or before the first day of each calendar month during the Sublease Term to the address set forth in Section 13.9 below; provided, however, that, if the Sublease Term commences or ends on other than the first and last day, respectively, of a calendar month, the Base Sublease Rent for the fractional calendar month will be prorated on a per diem basis and, with respect to the commencement of the Sublease Term, shall be payable on the Sublease Commencement Date.
