Basic Lease Term. The basic lease term of this Facility Lease for the Facility (the "Basic Lease Term") shall commence on the Closing Date and ---------------- shall terminate at 11:59 p.m. (New York City time) on February 8, 2035, subject to earlier termination in whole pursuant to Section 10, 13, 14 or 17 hereof or with respect to either Unit pursuant to Section 10 or 14 hereof.
Basic Lease Term. The basic lease term of this Facility Lease (the "BASIC LEASE TERM") shall commence on the Closing Date (the "BASIC LEASE COMMENCEMENT DATE") and shall continue for a period of 33 years and eight months, to and including _______ ___, 2034, subject to earlier termination pursuant to SECTIONS 10, 13, 14 or 17 hereof. The Facility Lessee shall have the right to renew this Facility Lease in accordance with SECTION 15 hereof. The Basic Lease Term and the Renewal Lease Terms are referred to as the "FACILITY LEASE TERM".
Basic Lease Term. The Basic Lease Term shall commence on the Delivery Date and, unless this Lease Agreement is terminated earlier pursuant to the provisions hereof, shall end on the Basic Lease Term Termination Date, provided that if the last day of the Basic Lease Term shall not be a Business Day, then the Basic Lease Term Frontier Lease Agreement (MSN 28760) Execution Copy -15- shall expire on the next preceding Business Day.
Basic Lease Term. During the Basic Lease Term, the Lessee shall assume liability for, and indemnify, protect, defend, save and keep harmless each Indemnitee, on an After Tax Basis, from and against, any and all Claims arising during the Basic Lease Term or thereafter that may be imposed on, incurred by or asserted against such Indemnitee (whether because of action or omission by such Indemnitee or otherwise), whether or not such Indemnitee shall also be indemnified as to any such Claim by any other Person, in any way relating to or arising in whole or in part out of (or alleged to in any way relate to or arise in whole or in part out of):
(i) any agreement for the purchase or ground lease of the Land (including the Ground Lease), or the assignment to the Lessor of any such purchase agreement or ground lease, any other document, instrument or agreement relating thereto or any of the transactions contemplated by any of the foregoing;
(ii) any of the Operative Documents or any of the transactions contemplated thereby, and any amendment, modification or waiver in respect thereof;
(iii) the Property or any part thereof or interest therein;
(iv) the purchase, design, construction, preparation, installation, inspection, delivery, nondelivery, acceptance, rejection, ownership, management, possession, operation, rental, lease, sublease, repossession, maintenance, repair, alteration, modification, addition or substitution, storage, transfer of title, redelivery, use, financing, refinancing, disposition, operation, condition, sale (including, without limitation, any sale pursuant to Section 16.2(c) or 16.2(e) of the Lease or any sale pursuant to Article XV, XVIII or XX of the Lease or Article V or Article VI of the Construction Agency Agreement), return or other disposition of all or any part or any interest in the Property or the imposition of any Lien (or incurring of any liability to refund or pay over any amount as a result of any Lien) thereon, including, without limitation: (A) Claims or penalties arising from any violation of law or in tort (on the basis of strict liability or otherwise), (B) latent or other defects, whether or not discoverable, (C) any Claim based upon a violation or alleged violation of the terms of any restriction, easement, condition or covenant or other matter affecting title to any of the Property, (D) the making of any Modifications in violation of any standards imposed by any insurance policies required to be maintained by the Lessee pursuant to the Lea...
Basic Lease Term. The basic lease term of this Facility Lease (the "BASIC LEASE TERM") shall commence on the Closing Date and shall end on September 14, 2033, subject to earlier termination pursuant to Section 10, 13, 14 or 17 hereof.
Basic Lease Term. With respect to each Uncompleted Property, commencing on the Basic Lease Term Commencement Date therefor, and, with respect to any Improved Property, commencing on the Acquisition Date therefor, and without limitation of the rights of any Tax Indemnitee under any other indemnification provision of this Article XIII (including the immediately preceding clause(i)), the Lessee shall pay and assume liability for, and does hereby agree to indemnify, protect and defend the applicable Property and all Tax Indemnitees, and hold them harmless against, all Impositions on an After Tax Basis.
Basic Lease Term. Subject to the provisions of this Article XIV, (x) if all or a portion of any Property is damaged or destroyed in whole or in part by a Casualty during the Basic Lease Term for such Property, any insurance proceeds payable with respect to such Casualty shall be paid directly to the Lessee, or if received by Administrative Agent or any Participant, shall be paid over to the Lessee for the reconstruction, refurbishment and repair of the affected Property, and (y) if the use, access, occupancy, easement rights or title to any Property or any part thereof is the subject of a Condemnation during the Basic Lease Term for such Property, then any award or compensation relating thereto shall be paid to the Lessee ; provided, however, that, in each case, if (A) any Lease Event of Default shall have occurred and be continuing or (B) such Casualty or Condemnation is an Event of Loss, then such award, compensation or insurance proceeds shall be paid directly to the Administrative Agent (as assignee of the Certificate Holders) or, if received by the Lessee, shall be held in trust for the Participants and shall be paid over by the Lessee to the Administrative Agent to be distributed by the Administrative Agent as follows: in the case of a Lease Event of Default, such amounts shall be distributed in accordance with the Participation Agreement, and in the case of an Event of Loss, such amounts shall be applied in the Agent Lessor's and the Administrative Agent's reasonable discretion to the restoration of such Property or toward the payment of the applicable Property Cost of the affected Property on the applicable Partial Termination Date in accordance with Section 15.1.
Basic Lease Term. The basic lease term of this Project Lease for the Project (the "Basic Lease Term") shall commence on the Closing Date and shall terminate at 11:59 p.m. (New York City time) on January 3, 2028 (the "Basic Lease Term Expiration Date"), subject to earlier termination in whole pursuant to Section 10, 13, 14, 17 or 22 hereof.
Basic Lease Term. Unless earlier terminated, the term of the Lease shall consist of a base term commencing on the Closing Date and ending the first to occur of:
(a) the seventh (7th) anniversary of the Closing Date (the “Scheduled Termination Date”); and
