Easement Rights. Borrower has been granted all easements appropriate for the current use and operation of the Property, and any mortgage liens now or hereafter affecting any land burdened by such easements are subordinate to such easements.
Easement Rights. The easements and rights-of-way granted to Grantee under this Grant include, without limitation:
Easement Rights. Right of conditional easement of use (Easement Rights) on certain amenities and facilities such as gatehouse, roads, pathways, walkways, drainage and sewage pipeline and STP (if any), landscaped green areas and water bodies (collectively Specified Facilities). It is clarified that (1) the Developer shall have absolute right to modify the Specified Facilities and (2) the Specified Facilities shall be available in common with other clusters of buildings in the Said Complex (Other Clusters) and other developments and projects of the Developer (collectively Other Siddha Projects) and shall also be enjoyed in common by the owners of the Other Clusters and Other Siddha Projects (collectively Other Owners). The Said Flat, the Land Share, the Said Parking Space (if any), the Share In Common Portions and the Easement Rights collectively described in Part III of the 2nd Schedule below (collectively Said Flat And Appurtenances).
Easement Rights. Collectively, the right, title and interest in the BLM Easements conveyed to Buyer under the BLM Easements Assignment to Buyer, the right, title and interest in the Xxxxxx Easements conveyed to Buyer under the Partial Assignment of Xxxxxx Easements to Buyer, and the Nerd Farm Easement (but exclusive of the Improvements transferred pursuant to the Nerd Farm Easement).
Easement Rights. Collectively, the right, title and interest in the BLM Easements conveyed to Ultra Resources under the BLM Easements Assignment to Ultra Resources, the right, title and interest in the Xxxxxx Easements conveyed to Ultra Resources under the Assignment of Xxxxxx Easements to Ultra Resources, and the Release of Nerd Farm Easement and Transfer of Improvements (but exclusive of the Improvements transferred pursuant to the Nerd Farm Easement). Easements: The BLM Easements, the Xxxxxx Easements and the Release of Nerd Farm Easement and Transfer of Improvements.
Easement Rights. (a) The Cross Access Easements set forth herein shall run with and bind the Properties in perpetuity.
(b) The Parties covenant that (i) each shall have the quiet possession of the Easement Areas free from all encumbrances except matters of record as of the date hereof, (ii) each shall maintain its respective Easement Area free of all obstructions that would prevent or impede access over, across, or through in the Easement Area, and (iii) each shall not erect any structure on the Easement Areas or use the Easement Areas in such a way to interfere with the Parties’ unimpeded access to the same or permit others to do any of the above acts.
(c) Notwithstanding the foregoing, the Parties agree that in the event either Party requires work done to either of the Easement Areas or to the Properties that will impact the Easement Areas, they shall provide notice to the other Party and obtain approval from the other Party, not to be unreasonably denied.
(d) The City shall be responsible for the maintenance of the City Access Area.
(e) The Entity shall be responsible for the maintenance of the Entity Access Area.
Easement Rights. 1) Right of uninterrupted access to and from the flat.
2) Right of user of main entrance, common passages, Staircase, landing passages and common areas.
3) Opening and closing of door and windows of the flat uninterruptedly.
4) Use of stair case and Lifts.
Easement Rights. Developer hereby grants to the City, its agents, employees, officers, and contractors a permanent non-exclusive easement for the right of entry onto the property for the purpose of inspection and/or to accomplish any and all work or to take any and all corrective action deemed necessary by the City in its sole discretion pursuant to the terms of this Agreement.
Easement Rights. Grantee may access, maintain, repair, relocate, place, replace, remove, modify and operate the Utilities across, along, under, over, upon and through the Plant Easement Tract, and may enter upon the Plant Easement Tract to engage in all activities as may be necessary, requisite, convenient, or appropriate in connection therewith. Subject to the rights granted to Grantee herein, Grantee will, at all times after doing any work in connection with the Utility Easement, restore the surface of the Plant Easement Tract as nearly as reasonably practicable to substantially the condition prior to the undertaking of such work. Grantee shall use commercially reasonable efforts to promptly remedy any damage or other condition relating to any improvements (including, but not limited to, the Utilities) located in the Plant Easement Tract that pose a risk of injury or damage to persons or property, and Grantee shall take reasonable measures to warn others of any such condition with signage, barriers or other reasonable warning devices to the extent such damage, risk or condition is caused by the Grantee or Grantee's agents, employees or contractors.
Easement Rights. Right of perpetual easement on the roads and pathways situate inside the KAMALA DHAM project.
