Common use of BENEFITS DURING UNPAID LEAVES OF ABSENCE Clause in Contracts

BENEFITS DURING UNPAID LEAVES OF ABSENCE. An educational support employee shall suffer no loss of fringe benefits or seniority for approved unpaid leaves of absence of less than thirty (30) calendar days. The educational support employee on an approved leave of absence for more than thirty (30) days without pay or benefits shall have the option of continuing as a participant in the existing insurance benefit program at the expense of the educational support employee, while on such leave. All benefits to which an educational support employee was entitled at the time the approved leave of absence commenced, including unused accumulated sick leave, will be restored upon return to service. An employee on an extended leave of absence will be re-employed in an appropriate position as soon as a vacancy occurs after the request for reinstatement. If the employee declines the position, there is no further obligation for employment. Unless mutually agreed upon, educational support employees taking leave under any provisions of this section will normally return only at the beginning of the school year for ten-month employees or fiscal year for twelve-month employees.
