Bidding and Proposal Phase. 1.5.1 In conjunction with the development of the Guaranteed Maximum Price and at other times as appropriate to the Project, the Architect/Engineer shall assist the Owner and Construction Manager by receiving and recording requests for Bid and Request for Proposal (“RFP”) Documents, receiving and resolving questions about Bid and RFP Documents; preparing addenda, issuing addenda, and accounting for addenda issued; attending pre-bid and pre-proposal conferences and HUB meetings; evaluating bids and proposals; and assisting in preparing and awarding multiple contracts for construction. Architect/Engineer shall answer inquiries from bidders and proposers at Owner’s request, and shall prepare and issue any necessary addenda to the bidding or proposal documents. 1.5.2 The Architect/Engineer shall assist the Construction Manager and Owner in investigating the responsibility of apparent low bidders or proposers and inform Owner in writing of its findings and recommendations. For proposers selected by qualifications and by competitive sealed proposals, the Architect/Engineer shall assist the Construction Manager and Owner in investigating qualifications and other pertinent proposal information and inform the Owner in writing of its findings and recommendations. 1.5.3 In the event the Guaranteed Maximum Price proposal received for the Project exceeds the Final Amount Available for the Construction Contract as approved by the Board of Regents,, if the Architect/Engineer is required to make revisions to the Contract Documents, the Architect/Engineer shall be entitled to compensation, as an Additional Service for changes to the Contract Documents that result from scope changes directed by the Owner that materially impact costs or revisions to the Contract Documents directed by the Owner that resulted in an increase in the AACC. The Owner reserves the right to accept a proposal and award a construction contract that exceeds the Final Amount Available for the Construction Contract, if such award is determined by Owner to be in the Owner’s best interest.

The Architect/Engineer shall assist the Owner with any contract negotiations with the selected Contractor. 1.5.3 In the event the best value proposal received for the Project exceeds the Final Amount Available for Construction Contract established at the completion of the Construction Document Phase, the Architect/Engineer, without charge to the Owner, and if so directed by Owner, shall revise the drawings and specifications as necessary to bring the cost of the Project within the Final Amount Available for Construction Contract. The Owner reserves the right to accept a proposal and award a construction contract that exceeds the Final Amount Available for Construction Contract, if such award is determined by Owner to be in the Owner’s best interest. 1.5.4 The Architect/Engineer shall provide the models and drawings in native file format to all bidders upon request.

If the A/E has not altered the scope or quality level of the project without approval by the ODR, then the A/E will be compensated as an Additional Service for changes to the Construction Documents needed to satisfy Owner’s budget limitations. The Owner reserves the right to accept a proposal and award a construction contract that exceeds the Final Construction Cost Limitation, if such award is determined by ODR to be in the Owner’s best interest. The A-E’s Fee will not be adjusted if the Owner decides to accept such a proposal. The A-E shall furnish and deliver to the Owner two compact disks of the complete documents of the Final Revised Construction Documents in a format acceptable by the Owner for the Owner’s record (i.e. all drawings, specifications, product data, cost estimates, etc.).

For proposers selected by qualifications and by competitive sealed proposals, Architect shall assist Owner in investigating qualifications and other pertinent proposal information, and in the writing of the findings and recommendations. 1.5.4 In the event the lowest acceptable bid or proposal received for the Project exceeds the Construction Cost Limitation, Architect, without charge to Owner, and if directed to do so by Owner, shall make such revisions to the drawings and specifications as may be necessary to bring the cost of the Project within the Construction Cost Limitation. Architect shall make these revisions to the drawings and specifications as expeditiously as possible. Owner reserves the right to accept a bid or proposal and award a construction contract that exceeds the stipulated Construction Cost Limitation, if such award is determined by Owner to be in the Owner’s best interest, rather than to require Architect to revise the drawings and specifications.
