Board Appeal. The Board of Directors of Xxxxxxx shall not withdraw, modify or amend its resolution to recommend that the Bankruptcy Court approve this Agreement, Sellers' Ancillary Documents and the transactions contemplated hereby and thereby, unless required by the Bankruptcy Court or such withdrawal, modification or amendment is consistent with the Bidding Procedures.
Board Appeal. If the employee is suspended by the Superintendent, the employee shall, within three (3) working days of the suspension, be given a written notice advising of the suspension, stating the reasons therefore, the duration thereof, whether it is with or without pay, and the employee' s right to have a hearing in person before the Board for review of the Superintendent' s action. The employee must notify the Board of Education in writing within five (5) working days of the meeting with Superintendent or other designee of a request for a hearing. If no request is made, the Board will review the written report and either (1) reverse or approve the Superintendent's decision to suspend, (2) suspend the employee, or (3) take whatever other disciplinary action it deems appropriate.
