Common use of Break in Seniority Clause in Contracts

Break in Seniority. Seniority shall be broken when an Employee: (a) Terminates voluntarily; (b) Is discharged; (c) Exceeds an authorized leave-of absence; (d) Is laid off for a period in excess of twelve (12) months, or (e) is absent for a period exceeding twelve (12) months due to a workers’ compensation injury.

Break in Seniority. Seniority shall be broken when an EmployeeA break in seniority will occur if: (a) Terminates voluntarily;A. an employee quits, or (b) Is discharged;B. an employee is discharged for just cause, or (c) Exceeds C. an authorized leave-employee takes an unauthorized leave of absence; (d) Is , or D. an employee is laid off for a period in excess of more than twelve (12) months, or (e) is absent for a period exceeding twelve (12) months due to a workers’ compensation injuryE. an employee leaves the bargaining unit.

Break in Seniority. Seniority shall be broken when A break in seniority will occur if an Employee: (a) Terminates voluntarily; (b) Is discharged; (c) Exceeds employee resigns or is discharged for cause. A break in seniority will also occur if an authorized leave-employee has a total lapse of absence; (d) Is laid off for a period in excess employment of twelve (12) months, or (e) is absent for a period exceeding twelve (12) 12 months due to a workers’ compensation non- occupational illness or injury; or except as otherwise required by law 12 months or more due to an authorized leave of absence or layoff.

Seniority shall be broken when A break in seniority will occur if an Employee: (a) Terminates voluntarily; (b) Is discharged; (c) Exceeds employee resigns or is discharged for cause. Seniority A break in seniority shall be broken when occur only in cases of a voluntary resignation by an Employee: (a) Terminates voluntarily; (b) Is discharged; (c) Exceeds employee, a discharge for just cause, failure to return to work after a leave of absence has expired, an authorized leave-of absence; (d) Is laid off for administrative leave required by the Agency, and failure to return to work after a period in excess of twelve (12) monthsrecall from layoff, or (e) is absent for a period exceeding twelve (12) months due failure to a workers’ compensation injuryreturn to work from the annual furlough period.

Break in Seniority. Seniority shall be broken when an EmployeeA break in service or seniority will occur upon: (a) Terminates voluntarilyResignation; (b) Is dischargedFailure to return to work at the end of an approved leave; (c) Exceeds an authorized leave-Termination for just cause, or, in the case of absencea Trial employee, Relief or Temporary employee, for any cause; (d) Is laid off Layoff for a period in excess of twelve (12) months, or (e) is absent for a period exceeding twelve (12) months due to a workers’ compensation injuryor more.
