Common use of Break in Seniority Clause in Contracts

Break in Seniority. An Employee's seniority shall be lost when he/she is terminated voluntarily (except as provided in paragraph B(3)), discharged for cause, laid-off for a period of twelve (12) consecutive months or a period exceeding the length of the Employee's continuous service, whichever is less, exceeds an authorized leave of absence, or fails to respond within five (5) days exclusive of Saturdays, Sundays and holidays to an offer of work sent by registered mail, return receipt requested. A copy of that offer will be mailed to the Union.
