Break in Service. (a) If the Hours of Service method is used in determining either an Employee’s initial or continuing eligibility to participate in the Plan, or the nonforfeitable interest in the Employee’s account balance derived from Employer contributions, a Break in Service is a twelve (12) consecutive month period (during which the Employee has not completed more than five hundred (500) Hours of Service. (b) For purposes of determining whether a Break in Service has occurred in a particular computation period, an Employee who is absent from work for maternity or paternity reasons shall receive credit for Hours of Service which would otherwise have been credited to such Employee but for such absence, or in any case in which such hours cannot be determined, with eight (8) Hours of Service per day of such absence. The Hours of Service to be so credited under this paragraph shall be credited in the computation period in which the absence begins if the crediting is necessary to prevent a Break in Service in that period period, or, in all other cases, in the following computation periodsperiod.
(cb) With respect to determinations based on the Elapsed Time methodMethod - If the Employer has specified in the Adoption Agreement that the elapsed time method shall be used, then a Break in Service shall mean a Period of Severance of at least twelve-consecutive months. A Period of Severance is a severance continuous period of twelve (12) time during which the Employee is not employed by the Employer. Such period begins on the date the Employee retires, quits, or more consecutive monthsis discharged, or if earlier, the 12 month anniversary of the date on which the Employee was otherwise first absent from service. In the case of an Employee individual who is absent from work for maternity or paternity reasons, the twelve (12) twelve-consecutive month period beginning on the first anniversary of the first day date of such absence shall not constitute a Break in Service.
(dc) Notwithstanding the foregoing, in the case of an Employee who is absent from work beyond the first anniversary of the first day of absence from work for maternity or paternity reasons, such period begins on the second anniversary of the first day of such absence.
