Common use of Calculation of Overtime Rate Clause in Contracts

Calculation of Overtime Rate. For the purpose of calculating the hourly rate, an employee's biweekly rate shall be divided by seventy (70) for employees on thirty-five (35) hours per week, and multiplied by the applicable overtime rate. Should the hourly rate arrived at result in a fraction of one (1) cent, it shall be taken to the next highest full cent before multiplying the applicable overtime rate.
