CHECK RETENTION. SPS-EFT requires that MERCHANT retain and store the original check in a secure location for the period of at least ninety (90) days. In the event a Remote Capture Deposit (Check 21 Plus) transaction cannot be processed due to a poor quality check image, MERCHANT shall be notified by SPS-EFT in writing (and/or by phone, fax, or email) to manually deposit the check. Once notification has been received, MERCHANT is to deposit the check at their bank within 48 hours. Failure to deposit the check in Merchants’ bank account within 48 hours may result in a loss of guarantee. If the manually deposited check is subsequently returned by the check writers bank, MERCHANT shall mail the check to SPS-EFT (P.O. Box 6867, Destin, FL 32550) to submit for a claim for reimbursement (if merchant selected the Remote Check Deposit (Check 21) with Guarantee program on the front of this application). In any event, the instrument must be received by SPS-EFT within 45 days of SPS-EFT’s initial authorization of the instrument (if guarantee service is selected). If original check was not retained or was lost by merchant then MERCHANT acknowledges that SPS-EFT will not be able to process the Remote Check Deposit (Check 21 Plus) transaction, provide any sort of guarantee, or provide check collection services. Refer to section 4.4 regarding Image Requirements.

Refer to section 10 of this Schedule regarding Image Requirements.
CHECK RETENTION. After confirmation of a received image and the check has been credited to your account, you must mark the check “VOID” and securely store the original check for 10 days. The original check must be made available to us at our request. You may not present the original check or any image or substitute check for payment at any other financial institution. Promptly after expiration of the holding period, you must destroy the original check by cross-cut shredding or other acceptable means. After destruction, the image will be the only evidence of the original check. You agree you will never re-present the original check. You are solely responsible if anyone is asked to make a payment based on re-presentment of an original check. Credits to your account for checks deposited using Mobile Remote Deposit is provisional. If original checks are dishonored, rejected or otherwise returned unpaid by the drawee bank, or are rejected or returned by a clearing agent or collecting bank, for any reason, you agree that an original check will not be returned to you, but that we may charge back the amount of the original check and provide you with an image of the original check, or a substitute check. You agree to reimburse us for all loss, costs, damages or expenses cause by the processing of the returned item. Without prior bank approval, you will not attempt to deposit an original check if it has been charged back to you. Cedar Security Bank may debit any of your accounts to obtain payment for rejected or returned items and for any adjustment or warranty claims, whether or not made timely. Mobile Deposit may be temporarily unavailable due to system maintenance or technical difficulties including from the internet services provider, cellular service provider and software. Cedar Security Bank is not responsible nor liable and holds no responsibility for any loss or damage incurred by you due to service unavailability. If Mobile Deposit is unavailable, you may deposit original checks at one of our office locations or by mailing the original check to one of our branches at the address in the contact information section.
CHECK RETENTION. After you receive confirmation that we have received an image, you must retain your check in a secure area for at least 15 days and make the original check accessible to us at our request. Make sure your check has been deposited to your account before destroying the original check. Upon our request, you will deliver to us within 10 calendar days, at your expense, requested original checks in your possession, bearing the same endorsements as reflected by the image that you transmitted to us. If not provided in a timely manner, such amount will be reversed from your account. You agree that you will never re-present the original check. You understand that you are responsible to us for all losses and damages, including our reasonable attorney fees incurred in responding to any such payment demand, that we may incur if anyone is asked to make a payment based on an original check that has alread y been paid.

CHECK RETENTION. Contracting Agency shall be responsible for the safekeeping and destruction of the original checks that are uploaded in accordance with applicable banking industry standards for original check chain of custody, retention, and destruction.
