Chief Executive. (CE), in relation to a Health Service Provider, means the person appointed as Chief Executive of the Health Service Provider under section 108(1) of the Act.

Chief Executive. 7.2.1 In accordance with any rules that the Committee may determine, one of the Staff members shall be appointed (and, as the case may be, removed and reappointed) as the senior Staff member of the Joint Office (Chief Executive).

7.2.3 Subject to Clause 7.2.4, the Chief Executive:
(a) shall have the authority and responsibility to undertake the functions delegated to him by the Committee pursuant to this Agreement, without further approval of the Committee or the Parties;
(b) shall, together with the Staff, carry out the functions imposed on or delegated to him pursuant to this Agreement; and
(c) may, subject to Schedule 7, delegate the performance of his functions.
7.2.4 At any time, the Committee may, in relation to any function which is delegated to the Chief Executive, withdraw from him the authority and responsibility to undertake that function.
7.2.5 The Chief Executive's authority and responsibility shall be subject to the limitations set out in Schedule 6, or as otherwise prescribed by the Committee from time to time.
Chief Executive. OFFICER (CEO) The Chief Executive Officer reports to the Deputy Minister and is accountable to the Board of Directors. The Chief Executive Officer is responsible for:
a. Managing the day-to-day financial, analytical, and administrative affairs of the Agency in accordance with the mandate of the Agency, TB/MBC and government directives, accepted business and financial practices, and this MOU.
b. Advising the Chair on the requirements of and the Agency’s compliance with the AAD, as well as other TB/MBC and government directives and policies, and Agency by-laws and policies, including annually attesting to the Chair on the Agency’s compliance with mandatory requirements.
c. Applying policies and procedures so that public funds are used with integrity and honesty.
d. Providing leadership and management to the Agency staff, including human and financial resources management, in accordance with the approved business plan, accepted business and financial practices and standards, the Agency’s constituting instrument, and government directives.
e. Establishing and applying a financial management framework for the Agency in accordance with applicable Minister of Finance/Treasury Board controllership directives, policies and guidelines.
f. Translating the goals, objectives and strategic directions of the Board into operational plans and activities in accordance with the Agency’s approved business plan.
g. Ensuring that the Agency has the oversight capacity and an effective oversight framework in place for monitoring its management and operations.
h. Keeping the Board, through the Chair, informed with respect to implementation of policy and the operations of the Agency.
i. Establishing and applying systems to ensure that the Agency operates within its approved business plan.
j. Establishing and applying the Agency’s risk management framework and risk management plan as directed by the Chair/Board.
k. Supporting the Chair and the Board in meeting their responsibilities, including compliance with all applicable legislation, directives, policies, procedures and guidelines.
l. Carrying out in-year monitoring of the Agency’s performance and reporting on results to the Board through the Chair.
m. Keeping the Ministry and the Chair advised on issues or events that may concern the Minister, the Deputy Minister and the Chair in the exercise of their responsibilities.
n. Seeking support and advice from the Ministry, as appropriate, on Agency management issues.

Chief Executive. The salaries and expenses of the chief executive of a political subdivision are unallowable.
Chief Executive. The Executive Committee may from time to time delegate all or any of its rights, powers, duties and responsibilities under this Agreement to the Chief Executive upon such terms and conditions as the Executive Committee thinks fit.

Chief Executive. 17.1.1 Subject to Clause 15.7.4, a chief executive of the Executive Committee (the "Chief Executive") shall be appointed and be subject to removal and replacement by resolution of the Executive Committee passed by 70 per cent or more of the votes of all Committee Members (after consultation with the Pool Chairman). 17.1.2 The Chief Executive shall undertake such duties and responsibilities and exercise such powers in relation to the Executive Committee and its activities as the Executive Committee may from time to time assign to or vest in him.
17.1.3 The Chief Executive shall have the right and shall be obliged to attend all meetings of the Executive Committee and all meetings of the Pool Members in general meeting. The Chief Executive in his capacity as Chief Executive shall have no voting rights under this Agreement. If for any reason the Chief Executive is unable to attend any such meeting, he shall nominate a representative to attend in his place.
17.1.4 The Executive Committee shall make arrangements for the remuneration of the Chief Executive and the payment of his costs and expenses and the same shall be recovered in accordance with the PFA Accounting Procedure or as otherwise directed by the Executive Committee from time to time.
Chief Executive. 4.1.1 As the Accountable Officer, the Chief Executive has the responsibility for countering fraud in its broadest terms. Accountable Officers are required to have adequate arrangements in place for the deterrence, prevention and detection of fraud. In line with central guidance, these arrangements should encompass robust systems of preventative and detective controls to reduce the risk of fraud and contribute to the promotion of an anti-fraud culture. The Accountable Officer should also use CFS to assist in the investigation of actual, and alleged, losses involving patients’ funds where evidence exists of systematic fraud.
4.1.2 In October 2008 the SGHSCD issued circular CEL 44 (2008) noting that all frauds must be reported to CFS regardless of who the suspect or victim is, whether it is prosecuted criminally, civil action or by discipline, or whether the fraud was actual or attempted. The Accountable Officer must ensure that systems are put in place to notify CFS of all reports of fraud, so that complete records of fraud against NHS Scotland are available.
