– Claim to Benefits. No Employee or other beneficiary shall have any right or claim to benefits under the Health and Welfare Plan except as specified in the policy or policies or contract or contracts or self-funded benefits procured or entered into pursuant to Articles II and III herein. Any disputes as to eligibility time, amount, or duration of benefits shall be resolved by the appropriate insurance carrier or Third-Party Administrator, under and pursuant to the policy or contract, and the Employees or other beneficiary shall not have any right or claim with respect to such determination against the Trust. In the case of self-funded benefits in the Program, any dispute as to eligibility, type, amount, time or duration of such benefits shall be decided by the Trustees, and all disputes shall be finally settled pursuant to Article VIII of this Agreement.

– Claim to Benefits. No employee or other beneficiary shall have any right or claim to benefits under the Trust except as specified in an Apprenticeship Program or other training plan or program. Any disputes as to eligibility, type, amount, time or duration of benefits provided shall be resolved by the Trustees, who shall have discretion to interpret any Apprenticeship Program, in accordance with rules and regulations which may be established by the Trustees.
