COMBATING TRAFFICKING IN PERSONS. (this clause is applicable to all contracts) The Contractor agrees to be bound by and to comply with the terms and conditions of the clause entitled "Combating Trafficking in Persons (FEB 2009)," which is contained in Section 52.222-50 of the Federal Acquisition Regulation (section 52.222-50 of title 48 of the Code of Federal Regulations), including the requirement to include such terms and conditions in all subcontracts.
COMBATING TRAFFICKING IN PERSONS. FHI 360 requires that the Vendor uphold the principles of FHI 360’s Combating Trafficking in Persons policy (located on the FHI 360 Compliance Office website at xxxxx://xxx.xxx000.xxx/about-us/compliance-office). Vendor and its personnel must refrain from and take steps to prevent any conduct that violates the policy. Vendor or Vendor personnel who witness conduct prohibited by the policy or who identify that Vendor personnel have engaged in such conduct should promptly report the conduct orally or in writing within 24 hours (or as soon as possible under the circumstances) to the FHI 360 Office of Compliance and Internal Audit (OCIA) by one of the following means: (1) via email at Xxxxxxxxxx@xxx000.xxx; (2) via OCIA’s Ethics and Compliance Hotline: 0- 000-000-0000 in the U.S.; +0-000-000-0000 outside the U.S.; Skype: +0-000-000-0000; or Country-specific hotline numbers listed on FHI 360’s reporting website; or (3) via OCIA’s anonymous reporting website (xxxx://xxx.xxx000.xxx/anonreportregistry). FHI 360 requires all Vendors and Vendor personnel to cooperate fully with investigations of policy violations and provide truthful information to investigators. In addition, Vendor must comply with any funder requirements incorporated into this Agreement. If this Agreement is funded in whole or in part with Federal contract funds, the provisions set forth in FAR 52.222-50 (Combating Trafficking in Persons) and FAR 52.222-56 (Certification Regarding Trafficking in Persons Compliance Plan) shall be applicable to this Agreement. Failure to comply with this provision may result in termination of this Agreement.

This includes all activities involving trafficking in persons, the procurement of commercial sex acts, and the use of forced labor as outlined in U.S. laws and regulations, including but not limited to the Trafficking Victims Protection Act of 2000 (22 U.S.C. 78) and Executive Order 13627. If Seller becomes aware of any prohibited activity, they will immediately notify Procurement Compliance as XxxxxxxXxxxxxxxxx@XXXxxx.xxx including:
1) The known details of the prohibited trafficking activity, including type of activity, timeframe and location and the occurrence(s), and any other information Seller used to assess the credibility of the detection or notification of the activity:
2) Any actions Seller has taken to remediate; and
3) Any actions Seller has taken to refer the trafficking related activity information to law enforcement or other public authorities. Seller’s failure to comply with this provision may be considered a material breach of this Agreement.
COMBATING TRAFFICKING IN PERSONS. The United States Government has adopted a zero tolerance policy regarding trafficking in persons. Subcontractor and its employees shall not:
(1) Engage in severe forms of trafficking in persons during the period of performance of any Task Order;
(2) Procure commercial sex acts during the period of performance of any Task Order; or
(3) Use forced labor in the performance of any Task Order.

COMBATING TRAFFICKING IN PERSONS. Pursuant to 22 USC 7104(g), of the Trafficking Victims Protection Act (TVPA) of 2000, as amended (22 USC 7104), see 2 CFR Part 175, this Agreement may be terminated without penalty if SUBGRANTEE or any subcontractor or subgrantee paid with Subgrant funds:
a. Engages in severe forms of trafficking in persons or has procured a commercial sex act during the period of time this Agreement or any subcontracts or subgrants are in effect; or
b. Uses forced labor in the performance of activities under this Agreement or under any subcontracts or subgrants.
c. SUBGRANTEE agrees that it shall notify and require all of its subgrantees or subcontractors to notify, its employees of the prohibited activities.
d. ODJFS has the right to immediately and unilaterally terminate this Agreement if any provision in this section is violated and ODJFS may implement Section 106(g) of the TVPA.
