Commencement of Project. If a project is not operational within 60 days of the original start date of the award period or the date of award activation (whichever is later), the recipient must report by letter to the Department the steps taken to initiate the project, the reasons for delay, and the expected start date. If a project is not operational within 90 days of the original start date of the award period or the date of award activation (whichever is later), the recipient must submit a second statement to the Department explaining the implementation delay. Upon receipt of the ninety (90) day letter, the Department shall determine if the reason for delay is justified or shall, at its discretion, unilaterally terminate this agreement and re-obligate award funds to other Department approved projects. The Department, where warranted by extenuating circumstances, may extend the starting date of the project past the ninety (90) day period, but only by formal written adjustment to this agreement.
Commencement of Project. This Agreement shall be null and void and all Grant funds shall be repaid by the Grantee if, within 180 days after the date this Agreement is executed by Xxxxx Philanthropies, Inc., the project described in part A has not commenced and the Grantee has not made use of Grant funds for such project.

6.3.1 If a project is not operational within 90 days after the date of full execution of this Agreement, the Subrecipient must submit a second statement to the City explaining the implementation delay.
6.3.2 Upon receipt of the ninety (90) day letter, the City will determine if the reason for the delay is justified or will, at the City’s discretion, unilaterally terminate this agreement. Prior to the adoption of the Bond Resolution (i.e., January 29, 2004), no properties included in the Project, that are to be financed with the proceeds of the Bonds, had been acquired by the Company or any Related Person (as defined in the Code), and no physical work on the Project had been commenced by the Company or any Related Person, except to the extent permitted in such Bond Resolution.

Commencement of Project. BDI Pharmaceuticals shall commence performance of the Project immediately following the Effective Date.
Commencement of Project. Final Date for Commencement and Participating Organisation Written Agreements
14.1. All Projects under this Agreement must start by the Final Commencement Date (i.e. within six months of the Project’s Funding Offer being executed by the ARC in RMS).
14.2. Pursuant to clause 7, the Administering Organisation must not allow a Project to commence, nor Funding to be expended, until it has entered into a written agreement with each Participating Organisation in accordance with clause 11. The Administering Organisation must reach agreement with each other Participating Organisation and enter into a written agreement with each such organisation before the applicable Project Start Date as determined in accordance with this clause.
14.3. If the Administering Organisation wishes to defer the Project Start Date for up to six months beyond the Final Commencement Date, a written request justifying the requested deferral in terms of exceptional circumstances must be made to the ARC through the Administering Organisation’s Research Office by submitting a VFA request, prior to the Commencement Date.
