COMPENSABLE INJURY OR ILLNESS. If an employee is injured on the job, and is eligible for and receives worker’s compensation, the employee, to the extent she/he has available accumulated sick leave, will be paid the difference between his or her regular rate of pay, and any sum received from Worker’s Compensation. The employee will be charged for sick leave on a pro-rated basis. Example: Employee AB has 30 days sick leave accumulated. AB slips and falls at work, and misses 100 days of work due to injury. AB is paid 2/3 her normal rate of pay by Xxxxxx’s Compensation. AB will receive an additional 1/3 of her normal rate of pay for 90 days. On the 91st day, the sick leave of the employee is exhausted, and the employer makes no more contribution. The employee is charged for use of sick leave at the rate of 1/3 of a day on each work day, because the employee is being paid at 1/3 her normal rate.
