COMPENSATION FOR LOSS OR DAMAGE TO PERSONAL PROPERTY. Claims for reimbursement must be processed in accordance with the Administrative Bulletin No. 518 - Compensation for Loss or Damage to Personal Property.
COMPENSATION FOR LOSS OR DAMAGE TO PERSONAL PROPERTY. The loss or damage to personal property of employees is subject to reimbursement under the following conditions: A. The loss or damage must result from an event which is not normally encountered or anticipated on the job and which is not subject to the control of the employee. B. Ordinary wear and tear of personal property used on the job is not compensated. C. Employee tools or equipment provided without the express approval of the Department Head and automobiles are excluded from reimbursement. D. The loss or damage must have occurred in the line of duty. E. The loss or damage was not a result of negligence or lack of proper care by the employee. F. The personal property was necessarily worn or carried by the employee in order to adequately fulfill the duties and requirements of the job. G. The loss or damage to employee’s eyeglasses, dentures or other prosthetic devices did not occur simultaneously with a job connected injury covered by Workers' Compensation. H. The amount of reimbursement shall be limited to the actual cost to repair damages. Reimbursement for items damaged beyond repair shall be limited to the actual value of the item at the time of loss or damage but not more than the original cost. I. The burden of proof of loss rests with the employee. J. Claims for reimbursement must be processed in accordance with the Administrative Bulletin on Compensation for Loss or Damage to Personal Property.
COMPENSATION FOR LOSS OR DAMAGE TO PERSONAL PROPERTY. (1) The University will compensate an employee for damage to their personal property if the damage is caused by: a. the negligence of the University, another employee, or both, in performing their duties b. a defect in the University's materials or equipment; or c. an employee protecting or attempting to protect the University's property from loss or damage. (2) This clause will not apply when an employee is entitled to compensation for the damage under the NSW Workers’ Compensation Act 1987.
COMPENSATION FOR LOSS OR DAMAGE TO PERSONAL PROPERTY. 50.1 The employer shall compensate an employee to the extent of damage sustained to his/her personal property where such damage is sustained: (i) due to the negligence of the employer, another employee, or both, in the execution of their duties; or (ii) by a defect in the employer's materials or equipment: or (iii) where an employee has protected or attempted to protect the employer's property from loss or damage. For the purpose of this sub-clause, personal property means an employee's clothes, spectacles, hearing-aid or tools of trade which are ordinarily required for the performance of his/her duties. 50.2 Compensation to the extent of damage sustained, shall be made, where in the course of work, clothing, spectacles, hearing-aids are damaged or destroyed by fire or molten metal or through the use of corrosive substances. 50.3 This clause shall not apply when an employee is entitled under the current workers compensation legislation for such damage.

The University is not responsible for loss or damage to personal property kept by a staff member on University premises unless the loss or damage results from lack of reasonable care by the University or by another staff member of the University in the course of performance of their work. 65.2. Compensation may be paid by the University to a staff member where the loss or damage is caused by a defect in the University’s material or equipment, or is suffered by the staff member in protecting the University’s property from loss or damage. The University may take into account the age and serviceability of the item or garment when determining the amount of compensation payable.

(b) For the purposes of this clause, personal property means an employee's clothes, spectacles, hearing-aid or tools of trade which are ordinarily required for the performance of duties. (c) This clause will not apply when an employee is entitled to payment under the relevant workers' compensation legislation for such damage.
