Completion of Evaluation Cycle. a. The summative evaluation of a teacher shall be based upon student growth measures resulting from assessments that were administered in the previous school year for Value-Added Measures or the current school year for all other student growth measures, and performance that is assessed through evidence gathered during the walkthroughs and formal observations, including information in the OTES rubric and which has been previously discussed with the teacher in a timely fashion, related to professional responsibilities, that are conducted for the current school year. b. I. DUE PROCESS
1. Teachers who disagree with and provide evidence that identifies errors with, data sources, data collection or calculation, performance ratings, and/or the summative evaluation rating shall be permitted to request a different credentialed evaluator. Such requests shall be documented and may be approved by the District.
2. A teacher shall be entitled to Association representation at any conference held during this procedure.

Such unit members may be evaluated once every three years instead of annually as long as the teacher is making progress on his/her Professional Growth Plan. This will apply to school counselors who are rated Accomplished so long as the metric of student outcomes, provided that for the SGM component remains at least “average.” This most recent school year for which data is available, is Skilled or higher on the evaluation shall be rubric. Triennial evaluations conducted pursuant to this article are completed by the first day of May of the applicable school year, and the teacher shall receive a written report of the results 1 of the evaluation year and unit members are provided a written copy of their evaluation results by May 10.

d. In any year that a unit member is not fully evaluated pursuant to paragraphs (b) or (c) of this Section as a result of receiving a rating of “Skilled” Accomplished or Skilled on the unit member's most recent evaluation, an individual qualified to evaluate a unit member shall be evaluated every other year, provided that the SGM component remains conduct at least “average.” In the “off-years” teachers shall receive one (1) observation, which shall be comprised formal observation of the use unit member of the walkthrough form (Appendix K-7) which is informed by at least thirty (30) minutes and hold a post-observation conference with the unit member utilizing the observation form in Appendix D.
e. The Board may elect not to conduct an evaluation of observation time a unit member who was on leave from the school district for fifty percent (50%) or more of the school year, as calculated by the evaluator. In the event student growth measures are not maintained, as described above, the teacher may be returned to the annual evaluation schedule.
g. The Superintendent/designee may waive the annual evaluation for a unit member receiving an effectiveness rating of "Skilled" on the unit member's most recent evaluation conducted pursuant to this Article. Such unit members may be evaluated once every two years instead of annually as long as the teacher is making progress on his/her Professional Growth Plan. Completion of Evaluation Cycle. a. 1. The summative evaluation of a teacher Final Holistic Summative Evaluation rating shall be based upon student growth measures resulting from assessments that were administered a preponderance of the evidence, assessed in the previous school year for Value-Added Measures or the current school year for all other student growth measuresa holistic manner, and performance that is assessed through evidence aligned to the Ohio Educator Standards. Evidence gathered during the walkthroughs walkthroughs, observations and formal observations, including information in direct interactions between the OTES rubric evaluator and which has been previously discussed with the teacher in a timely fashion, related to professional responsibilities, that are conducted for the current school yearyear may be used.
b. 2. A teacher may provide evidence to the evaluator to support and inform an accurate reflection of the Evaluation Factors being evaluated. Examples include, but are not limited to, student information affecting educational process, student interest or learning style surveys, newsletters, classroom rules, lesson plans, portfolios, summative assessments, professional education organization work, education awards, and student work samples. All evidence presented will be considered in the evaluator’s assessment of the teacher.
3. The evaluation shall acknowledge, through the gathered evidence, the performance strengths of the teacher evaluated as well as performance deficiencies, if any.
c. 4. The evaluator shall note evidence of all information used to support the conclusions reached in the formal evaluation report.
d. 5. The evaluation report shall be signed by the evaluator; evaluator and the evaluation report shall be signed by the teacher to verify notification to the teacher that the evaluation shall be placed on file. The teacher's ’s signature shall not be construed as evidence that the teacher agrees with the contents of the evaluation report.the
e. 6. The evaluation report shall be completed, signed by both parties, and filed with the superintendent by Director of Human Resources no later than May 10.
f. Once every three (3) years 7. Any teacher who received an evaluation rating of “Skilled” may not be subject to another evaluation cycle until the board shall evaluate each second school year following the rating unless it is determined, in writing and through a preponderance of the evidence available to the evaluator, that the teacher assigned is not making progress on their professional growth plan.
8. Any teacher who received an evaluation rating of “Accomplished” on may not be subject to another evaluation cycle until the teacher’s most recent evaluation conducted under this articlethird school year following the rating unless it is determined, provided in writing and through a preponderance of the evidence available to the evaluator, that the SGM component remains at least “average.” This evaluation shall be completed by the first day of May of the applicable school year, and the teacher shall receive a written report of the results of the evaluation by the tenth day of May of that school year. Teachers whose most recent evaluation were assigned a rating of “Skilled” shall be evaluated every other year, provided that the SGM component remains at least “average.” In the “off-years” teachers shall receive one (1) observation, which shall be comprised of the use of the walkthrough form (Appendix K-7) which is informed by thirty (30) minutes of observation time by the evaluator. In the event student not making progress on their professional growth measures are not maintained, as described above, the teacher may be returned to the annual evaluation scheduleplan.
g. Final Summative Rating of Teacher Effectiveness (Effectiveness Rating) – The Superintendent shall annually file a report to the Department of Education only utilizing eTPES “Option 3.” The parties agree that should the ODE remove Option 3 from the eTPES choice options or requires another means of reporting9. Upon request, they will meet to negotiate this issue.

10. In any year that a teacher is not formally evaluated, an evaluator shall conduct at least one (1) formal observation of the teacher and hold at least one (1) conference with the teacher.
11. Teachers rated “Accomplished” or “Skilled” may voluntarily choose to be evaluated before the excused window expires.
