Consequences of Employer's Risks. If and to the extent that any of the risks listed in sub-clause 17.3 above results in loss or damage to the Works, Goods or Contractor's Documents, the Contractor shall promptly give notice to the Engineer and shall rectify this loss or damage to the extent required by the Engineer. If the Contractor suffers delay and/or incurs Cost from rectifying this loss or damage, the Contractor shall give a further notice to the Engineer and shall be entitled subject to clause 20 [Claims and Disputes] to: (a) an extension of time for any such delay, if completion is or will be delayed, under sub-clause 8.4 [Extension of Time for Completion]; and (b) payment of any such Cost, which shall be included in the Contract Price. In the case of sub-paragraphs (f) and (g) of sub-clause 17.3 [Employer's Risks], Profit on the Cost shall also be included. After receiving this further notice, the Engineer shall proceed in accordance with sub- clause 3.5 [Determinations] to agree or determine these matters.

If the Contractor suffers delay and/or incurs Cost from rectifying this loss or damage, the Contractor shall give a further notice to the Employer and shall be entitled subject to Sub-Clause 20.1 [Contractor's Claims] to: (a) an extension of time for any such delay, if completion is or will be delayed, under Sub-Clause 8.4 [Extension of Time for Completion]; and (b) payment of any such Cost (or an appropriate proportion of such Cost where the loss or damage is caused by a combination of Employer's risks and other risks), which shall be added to the Contract Price. After receiving this further notice, the Employer shall proceed in accordance with Sub-Clause 3.5 /Determinations] to agree or determine these matters.

If the Contractor suffers delay and/or incurs Cost from rectifying this loss or damage, the Contractor shall give a further notice to the Employer/s and the financial institution providing the funding for the Project/s and shall be entitled subject to Sub-Clause 25.1 [Contractor's Claims] to: (a) an extension of time for any such delay, if completion is or will be delayed, under Sub-Clause 8.4 [Extension of Time for Completion], and (b) payment of any such Cost, which shall be added to the Contract Price. After receiving this further notice, the Employer shall proceed in accordance with Sub Clause 3.5 [Determinations] to agree or determine these matters.
Consequences of Employer's Risks. In the 1st sentence of the 2nd paragraph, insert “to the Works, Good or Contractor’s Documents” after the word “damage”.

  • CLASSIFICATION OF EMPLOYEES Section 1. A full-time employee shall be deemed to be any employee regularly scheduled to work forty (40) hours per week. A regular employee is one whose employment is reasonably expected to continue for longer than fifteen (15) months. Section 2. A part-time employee shall be deemed to be any employee regularly scheduled to work less than forty (40) hours per week. Section 3. The Company shall have the right to reduce employee classifications from full-time to part-time or to increase employee classifications from part-time to full-time. Should the Company deem it appropriate to reclassify full-time employees to part-time employees, it will seek volunteers from the affected group and then force in reverse order of seniority. Section 4. A temporary employee is one who is engaged for a specific project or a limited period, with the definite understanding that his/her employment is to terminate upon completion of the project or at the end of the period, and whose employment is expected to continue for more than three (3) consecutive weeks, but not more than fifteen (15) months. The termination of the employment of such temporary employees shall not be subject to the grievance or arbitration provisions of this Agreement. Section 5. Agency workers and independent contractors shall not be deemed to be employees of the Company and, as such, shall not be covered by any of the terms or conditions of this Agreement.
