Funding for the Project. (a) (Funding) Subject to these Terms and Conditions, the department will provide the Funding to the AFP as detailed in the Funding Specification. The Funds to be contributed by the department for the Project will not exceed the amount of Funds specified in the Funding Specification. This means that the AFP must fund any Project overruns and/or funding shortfalls.
(b) (Funding only to be used for new Work) Funds will only be made available to enable the AFP to undertake agreed Works and may not be applied towards a completed build or project. Further, funds must not be used for any components deemed ineligible for funding under this Program as per the Program Guidelines. Where an AFP intends to partially fund a Project involving agreed Works through other locally available grants, funding or donated services it must:
(i) have notified the department of any additional sources of funding at the time it applies for a grant of Funding. The AFP must notify the department of any other sources of funding that subsequently become available to it for the Works;
(ii) have given sufficient particulars of the additional sources of funding;
(iii) provide such other information, documents and assistance as the department may reasonably require from time to time; and
(iv) confirm the availability and amount of funding contributed by any additional sources as a precondition for funding agreement execution
(c) (Timeframes for payment of Funding) The Funding will be paid in accordance with the timeframe(s) and invoicing requirements as set out in the Funding Specification. Such Funding will be paid by electronic funds transfer directly into a bank account nominated by the AFP. Funding will only be made available when funding from all other sources (including the AFP contribution) have been expended. The department will use all care to ensure Funds are paid in a timely manner but is not liable for late payments.
(d) (Other contributions to Project costs) The AFP must itself contribute funding toward the total cost of the Project. For this Program, the AFP must contribute and spend an amount which is not less than 5% of the total costs of the Project (unless this is a crisis situation or otherwise agreed in writing by the department). The total cost includes all costs associated with the Project including the provision of and maintaining security and insurances, any legal costs and all other third party costs. Funding for the Project. 3.1 Subject to Parliamentary appropriation and to the provisions of this Agreement, Cancer Australia agrees to pay the Funds to the Participant in accordance with the payment schedule specified in Item E.
3.2 The funding to be contributed by Cancer Australia for the performance of this Agreement by the Participant will not exceed the amount of Funds specified in Item E.
3.3 Cancer Australia may at its discretion:
(a) defer,
(b) reduce; or
(c) not make a payment of Funds where it forms the reasonable opinion that the full payment is not properly required by the Participant because of Project surpluses or underspends.

(d) (Funding conditional) The Department’s obligation to provide the funding is conditional on the Department actually receiving an appropriate annual allocation from Parliamentary appropriation. If there is no appropriate annual allocation then there will be reduced or no funding.
(e) (No promise for future funding) There is no promise that the AFP will receive any additional or future funding, in connection with the Program or otherwise. There is also no promise as to what terms would apply to any further funding arrangements (if any).

3.4 Without limiting its rights, Cancer Australia may at its discretion:

(c) not make a payment of Funds until the Participant has performed all of its obligations that are required to be performed up to the date of that payment under this Agreement.
3.5 The Participant agrees to submit invoices for payment of the Funds in the manner specified in Item E. The amount of the invoice will not exceed the amount of Funds properly required by the Participant for its use in relation to the performance of this Agreement up to the date of the next invoice.
Funding for the Project. The Borrower is in the financial position to finance all costs in relation to the Project.

Funding for the Project. TPL shall provide NPS with a preliminary project budget. The parties agree to use good faith efforts to secure all funding for the design and construction of the Playground through both non-NPS public and private funding sources. It is the intention of the parties that NPS and TPL will agree on a joint plan, with potential sources, amounts, and responsibilities, to secure those funds. TPL shall have no obligation to perform the Work or portions of the Work which are not funded through these efforts. Funding for the Project will not come from NPS public funds but rather, will come from fundraising activities and other third party sources to the extent that adequate funding for the Project can be raised. It is expressly understood by the parties that no payment of NPS public monies will be required from the District for any TPL services rendered or received. Nothing in this MOU obligates NPS to pay monies to TPL.
