Consideration of Prior Discipline. The weight to be given prior discipline shall depend upon the seriousness of the prior offense, its similarity to the offense for which discipline is being imposed, and the amount of time which has elapsed since the prior offense.

Consideration of Prior Discipline. An employee may submit a written request to the Associate Vice President of Human Resources and Organizational Development that the College not consider in subsequent disciplinary actions, discipline that was provided to the employee more than three (3) years prior to the date of the written request, provided that the prior discipline did not involve an issue related to discrimination, harassment, safety and health, dishonesty, or was of the same nature as subsequent discipline.
Consideration of Prior Discipline. Management will not consider in subsequent disciplinary actions, discipline that was provided to the employee more than three (3) years prior, provided that the prior discipline did not involve an issue related to discrimination, harassment, safety and health, veracity, or was of the same nature as the subsequent discipline. After three (3) years the employee may submit a written request to the Director of Employee and Labor Relations for removal of such disciplinary actions. Removal prior to three (3) years may be approved at the discretion of the Director of Employee and Labor Relations. If the request is denied, a representative from the office of Employee and Labor Relations will discuss the issue with the employee if the employee asks to do so.

  • Termination of Prior Agreements The execution of this Agreement shall be deemed to constitute the termination as of the Effective Date of any and all prior agreements between an Acquiring Fund and an Acquired Fund that relates to the investment by any Acquiring Fund in any Acquired Fund in reliance on a participation agreement, exemptive order or other arrangement among the parties intended to achieve compliance with Section 12(d)(1) of the 1940 Act (the “Prior Section 12 Agreements”).
