Common use of Contact While Off-Duty Clause in Contracts

Contact While Off-Duty. It is recognized that there may be occasions that demand an employee be contacted during their off-duty time by the Employer or supervisory personnel or by subordinates who report directly to the employee. In such cases, the time so worked will be credited to the hours worked for those working a flexible schedule or recognized as overtime for those employees not working a flexible schedule. In all such cases, it is understood that Clause 16.11 (Call-out) and 16.13 (Rest Interval) of the Master Agreement, Clause 6.02 of the Community Component Agreement and Clause 5.01 of the Hospital Component Agreement do not apply.
