Suspensions Pending Investigation. When the Employer suspends an employee without pay for the purposes of investigating an allegation of any form of misconduct, the Employer shall advise the employee of the expected approximate length of time the Employer may require to carry out such investigation. The Employer shall be prudent and expeditious in its investigation.

Suspensions Pending Investigation. A suspension pending investigation may be without pay until the investigation is complete and a determination of the appropriate discipline is made and communicated to the nurse and the Association, provided that such an investigation and report is completed within a seven (7) calendar day period. This seven calendar day period shall be extended, if the nurse is unavailable to meet with the Medical Center within this time period, until such meeting takes place. Any nurse on suspension shall have the right to be informed of the general nature of the investigation, and shall receive notice of the status of the Medical Center’s investigation on a weekly basis.

Suspensions Pending Investigation. A suspension pending 19 investigation will be with pay (exception may occur based on severity of incident 20 and/or positive drug test) until the investigation is complete and a determination 21 of the appropriate discipline is made and communicated to the nurse and the 22 Association. After seven (7) days, upon inquiry from the nurse or the Association 23 to the Director of Human Resources or designee, the Medical Center will 24 regularly report on the status of the investigation. Once the investigation is 25 complete appropriate discipline, if warranted, will be administered, which may 26 include initial lost pay. Withheld pay, if any, shall be considered part of the final 27 discipline if suspension without pay is warranted otherwise the nurse shall be 28 paid for time loss.

Suspensions Pending Investigation. The University may suspend an employee with pay, or, in the case of hourly employees, without pay, in order to investigate allegations of serious misconduct. A suspension pending investigation may warrant immediately relieving the employee from all work duties and/or require removing the employee from the premises. If an hourly employee is suspended without pay and the University determines that the employee did not commit an offense warranting suspension or discharge, the employee will receive back pay for the period of the investigatory suspension based on the terms of their appointment letter. Back pay will be remitted within a reasonable amount of time following the end of the suspension. Being placed on investigatory suspension is not itself a disciplinary action and is not subject to grievance procedures in Article 8 of this Agreement.
