Control rights of the Client. (1) The Client shall have the right, in consultation with the Contractor, to carry out inspections during normal business hours or to have inspections carried out by inspectors to be named in individual cases. He shall have the right to satisfy himself of the Contractor’s compliance with this agreement by means of inspections, which as a rule must be notified in good time.

Control rights of the Client. (1) The Client may, at its own expense, convince itself of the technical and organisational measures taken by the Contractor in accordance with Annex 2 prior to the commencement of data processing and regularly thereafter and document the result. This can be done, among other things, by obtaining a self- disclosure from the Contractor, which the Contractor can also fulfil by submitting a suitable certificate from an expert, or by carrying out an on-site inspection.
Control rights of the Client. (1) The Contractor will allow the Client to review, in particular, compliance with the Contractor's technical and organizational measures. To this end, the Client may request information or conduct an on-site inspection. The Contractor may also demonstrate compliance with technical and organizational measures by observing approved codes of conduct pursuant to Art. 40 GDPR, updated certificates, reports or excerpts from reports of independent entities (e.g. auditor, IT security department or data protection officer), certification under a suitable certification process pursuant to Art. 42 GDPR or suitable certification through an IT security audit or data protection audit. The Contractor and Client agree that verification can also be provided in the form of other evidence plausibly demonstrating that the Contractor carries out its activities carefully and conscientiously in compliance with the requirements of the GDPR.

Any such audit or inspection shall be subject to reasonable notice to the Contractor, to occur no more frequently than once annually (unless otherwise required by an applicable regulatory agency), and further, such audit or inspection shall take no more than one business day to complete.. In case the client can pro- vide an audit report or certification which follows the normal business standards within the defined audit field, such as ISO27001 or IAE 3000 and 3402, then the Client can receive a copy of the audit report or certification whereafter the Contractors’ obligation according to this sec- tion 7 is fulfilled . This does not affect the right of the Contractor to carry out an on-site audit as described in point 7.1 in case of reasonable doubt. Insofar as the cost of the support of audits goes beyond the obligation to cooperate (Art. 28 (3) (h) EU GDPR), the Contractor may claim appropriate compensation.

  • Protection of Legal Rights of Third Parties Registry Operator must specify, and comply with, the processes and procedures for launch of the TLD and initial registration-­‐related and ongoing protection of the legal rights of third parties as set forth Specification 7 attached hereto (“Specification 7”). Registry Operator may, at its election, implement additional protections of the legal rights of third parties. Any changes or modifications to the process and procedures required by Specification 7 following the Effective Date must be approved in advance by ICANN in writing. Registry Operator must comply with all remedies imposed by ICANN pursuant to Section 2 of Specification 7, subject to Registry Operator’s right to challenge such remedies as set forth in the applicable procedure described therein. Registry Operator shall take reasonable steps to investigate and respond to any reports from law enforcement and governmental and quasi-­‐governmental agencies of illegal conduct in connection with the use of the TLD. In responding to such reports, Registry Operator will not be required to take any action in contravention of applicable law.

The Client commits to using the Service within the limits of the provisions of the Agreement, these Terms and Conditions and the applicable laws and regulations, including the General Data Protection Regulation (GDPR).
