Cost of Completion. After giving effect to the applicable Construction Advance, the estimated as yet unpaid cost to the Construction Agent of completing the Construction pursuant to the Construction Documents shall not exceed the Available Construction Commitment.

Cost of Completion. (a) At the same time that the Company files its annual property tax return (Form PT-300) with the South Carolina Department of Revenue, the Company shall furnish to the County Assessor, County Auditor and County Treasurer on an annual basis through the end of the Investment period a report on the total amount invested by the Company with respect to the Project through such period, together with a copy of the Company’s Form PT-300 for such year. The Company shall also make all other filings required by Section 12-44-90 of the Act. (b) In the event that the cost of completion of the Project has not exceeded Five Million Dollars ($5,000,000) by the end of the Investment Period, beginning with the payment due for the last year of such Investment Period, the Fee Payments to be paid to the County by the Company shall become equal to the amount as would result from taxes levied on the Project by the County, municipality or municipalities, school district or school districts, and other political units as if the Project were taxable, but with appropriate reductions equivalent to all tax exemptions which would be afforded to the Company if the Project were taxable. In addition to the foregoing, the Company shall pay to the County an amount which is equal to the excess, if any, of (i) the total amount of ad valorem taxes that would have been payable to the County with respect to the Project for tax years through and including the last year of the Investment Period, taking into account and calculating appropriate reductions for all applicable exemptions and allowable depreciation over (ii) the total amount of Fee Payments actually made by the Company with respect to the Project for tax years through and including the last year of the Investment Period.
Cost of Completion. The actual total amount of all hard and soft construction costs to complete construction of certain improvements currently being made at the Real Property, as generally described in the construction budget attached hereto as Exhibit R (which costs may include, without limitation, landscaping, site work, signage, furnishings, legal costs, insurance, construction and development, construction coordination fees, professional fees, development fees, construction period debt service, and construction contingency).
Cost of Completion. The Certificate Purchaser and the Construction Lender shall have received a Certificate from the Prime Contractor, in form and scope satisfactory to each of them, certifying that after giving effect to the applicable Advance (or if the Certificate is given pursuant to Section 3.3.1 hereof, then after giving effect to the reduction of the Commitments), the estimated as yet unpaid cost to the Construction Agent of completing the Construction pursuant to the Construction Documents will not exceed the Available Commitments net of any portion of the Available Commitments that shall be allocated for Interest Payment Loans and Certificate Yield Payment Advances, and all such Construction is capable of attaining Substantial Completion by the Outside Completion Date and is proceeding in accordance with the schedule for Construction approved by the Participants prior to the Initial Advance Date, which schedule is attached as Schedule 3 to the Construction Agency Agreement.
Cost of Completion. The Certificate Purchasers shall have received a ------------------ certificate from Lessee, in form and scope reasonably satisfactory to each of them, certifying that after giving effect to the applicable Advance, the estimated as yet unpaid cost of completing the construction of the Financed Improvements in accordance with the Plans and Specifications will not exceed the Available Commitments, and all such construction of the Financed Improvements is capable of attaining Substantial Completion by the Construction Completion Date. If, at any time or from time to time, there is unavailable sufficient Available Commitments to fully pay for the completion of the Financed Improvements, Lessee, as Construction Agent, shall contribute its own funds to pay the costs of such completion prior to making any further request for any Advance to pay for such completion until the remaining Available Commitments are sufficient to fully pay for the completion of the Financed Improvements without further contribution from Lessee.
Cost of Completion. If the unpaid balance of the Contract Sum equals or exceeds the costs of completing the Work, including compensation for Architect's services and expenses made necessary thereby, and other damages due to the Owner, the difference shall be paid to the Contractor. If the unpaid balance of the Contract Sum is less than the costs of finishing the Work, including compensation for the Architect's services and expenses made necessary thereby, and other damages due to the Owner, Contractor shall immediately pay Owner the difference.
Cost of Completion. The Administrative Agent shall have received and approved a certificate from the applicable Prime Contractor, substantially in the form of Exhibit O, certifying the estimated cost of completing such Facility pursuant to its Plans and Specifications and evidencing that such estimated cost does not then exceed the Participation Agreement Available Commitments allocable to such Facility under Section 2.2(b).
