Costs Excluded. The term Cost of the Work shall not include any of the following items:
1. Payroll costs and other compensation of Contractor’s officers, executives, principals (of partnerships and sole proprietorships), general managers, safety managers, engineers, architects, estimators, attorneys, auditors, accountants, purchasing and contracting agents, expediters, timekeepers, clerks, and other personnel employed by Contractor, whether at the Site or in Contractor’s principal or branch office for general administration of the Work and not specifically included in the agreed upon schedule of job classifications referred to in Paragraph 11.01.A.1 or specifically covered by Paragraph 11.01.A.4, all of which are to be considered administrative costs covered by the Contractor’s fee.
2. Expenses of Contractor’s principal and branch offices other than Contractor’s office at the Site.
3. Any part of Contractor’s capital expenses, including interest on Contractor’s capital employed for the Work and charges against Contractor for delinquent payments.

Costs due to the negligence of Contractor, any Subcontractor, or anyone directly or indirectly employed by any of them or for whose acts any of them may be liable, including but not limited to, the correction of defective Work, disposal of materials or equipment wrongly supplied, and making good any damage to property.
5. Other overhead or general expense costs of any kind.

2. Expenses of CONTRACTOR’s principal and branch offices other than CONTRACTOR’s office at the Site.
3. Any part of CONTRACTOR’s capital expenses, including interest on CONTRACTOR’s capital employed for the Work and charges against CONTRACTOR for delinquent payments.

Costs due to the negligence of CON- TRACTOR, any Subcontractor, or anyone directly or indirectly employed by any of them or for whose acts any of them may be liable, including but not limited to, the correction of defective Work, disposal of materials or equipment wrongly supplied, and making good any damage to property.
5. Other overhead or general expense costs of any kind and the costs of any item not specifically and expressly included in paragraphs 11.01.A and 11.01.B.

2. Expenses of DESIGN/BUILDER’s principal and branch offices other than DESIGN/BUILDER’s office at the Site.
3. Any part of DESIGN/BUILDER’s capital expenses, including interest on DESIGN/BUILDER’s capital employed for the Work and charges against DESIGN/BUILDER for delinquent payments.
4. Costs due to the negligence of DESIGN/BUILDER, any Subcontractor, or anyone directly or indirectly employed by any of them or for whose acts any of them may be liable, including but not limited to, the correction of defective Work, disposal of materials or equipment wrongly supplied and making good any damage to property.

2. Expenses of DB Entity's principal and branch offices other than DB Entity's office at the Site.
3. Any part of DB Entity's capital expenses, including interest on DB Entity's capital employed for the Work and charges against DB Entity for delinquent payments.
4. Costs due to the negligence of a DB-Related Entity, including but not limited to the correction of defective Work, disposal of materials or equipment wrongly supplied, and making good any damage to property.
5. Other overhead or general expense costs of any kind and the costs of any item not specifically and expressly included in Paragraph 10.01.
Costs Excluded. The Cost of Construction shall not include:
1. Expenses of the Construction Manager's principal office and officers other than the site office except as specifically provided in Section D.
2. Overhead and general expenses, except as may be expressly included in Section D.
3. The Construction Manager's capital expenses including interest on the Construction Manager's capital employed for the work.
4. Threshold inspections.
5. Testing specifically excluded from and/or in addition to that included in the Construction Manager's GMP Proposal.
Costs Excluded. The Cost of the Work and Contractor’s General Conditions shall not include any Non-Reimbursable Costs.

2. Expenses of NEI's principal and branch offices other than NEI's office at the Site when required.
3. Any part of NEI's capital expenses, including interest on NEI's capital employed for the Work and charges against NEI for delinquent payments.
4. Costs due to the negligence of NEI, any Subcontractor, or anyone directly or indirectly employed by any of them or for whose acts any of them may be liable, including but not limited to the correction of defective Work, disposal of materials or equipment defective in nature or wrongly supplied, and making good any damage to property.
5. Other overhead or general expense costs of any kind and the costs of any item not specifically and expressly included in Paragraph 5.02A.
Costs Excluded. The term Cost of the Work shall not include any of the following items:
1. Payroll costs and other compensation of Construction Manager at Risk’s officers, executives, principals (of partnerships and sole proprietorships), general managers, estimators, attorneys, auditors, accountants, purchasing and contracting agents, expediters, timekeepers, clerks, and other personnel employed by Construction Manager at Risk whether at the Site or in Construction Manager at Risk’s principal or a branch office for general administration of the Work and not specifically included in the agreed upon schedule of job classifications referred to in Paragraph 4.01.A.1, all of which are to be considered administrative costs covered by the Construction Manager at Risk’s fee.
2. Expenses of Construction Manager at Risk’s principal and branch offices other than Construction Manager at Risk’s office at the Site.
3. Any part of Construction Manager at Risk’s capital expenses, including interest on Construction Manager at Risk’s capital employed for the Work and charges against Construction Manager at Risk for delinquent payments.
4. Costs due to the negligence of Construction Manager at Risk, any Construction Subcontractor, Engineer or other Project Design Professionals, or anyone directly or indirectly employed by any of them or for whose acts any of them may be liable, including but not limited to the correction of defective Work, disposal of materials or equipment wrongly supplied, and making good any damage to property.
5. Other overhead or general expense costs of any kind, and the costs of any item not specifically and expressly included in Paragraph 4.01.A.
