Counting Years of Service for Vesting. For purposes of determining a Participant’s vested percentage, all of his years of service will be counted, however, if the Adoption Agreement specifically so provides, the following years of service will not be counted: (1) Years of service completed before age 18; and (2) years of service before the Employer maintained the Plan or a predecessor plan. A plan is a predecessor plan if it was terminated on or after the date it was required to comply with ERISA and within 5 years or after the effective date of the Plan. A plan is not treated as a predecessor plan with respect to an Employee unless he was a participant in such plan.

  • Years of Service A Participant’s Years of Service shall include all service performed for the Employer and ¨ Shall ¨ Shall Not include service performed for the Related Employer.

  • Year of Service An Employee must complete at least Hours of Service during a Vesting Computation Period to receive credit for a Year of Service under Article V. [Note: The number may not exceed 1,000. If left blank, the requirement is 1,000.]
